SPECIAL Special Presentation of Poster Contest Awards, D.A.R.E., PRESENTATION- Say No to Drugs program was conducted at this time. The Say No To Drugs poster contest was sponsored by the Federal Way Elks, Dick Poster Contest Mayer, presenting the awards assisted by Stan Fuller and Awards officers Rutschli and McDonald, DARE Key Chains also distributed. The winning posters were displayed at the front of the Council Chambers, certificates presented as follows: AUDIENCE COHMENT Mark Twain School dangers to students - No traffic control, sidewalks and animal control needed. Grand prize Winner: Anthony Perez, Grade 6, Lake Dolloff Elementary School, his entire class to receive ice cream as well. 5th Grade: 1st Place Jung -Eun Park, Valhalla Elementary 4th Grade: 2nd Place Michael Lujan, Lakeland Elementary 5th Grade: lst Place Jennifer Page, Nautilus Elementary 2nd Place, Sandra Harrell, Panther Lake Elementary 6th Grade: 1st Place, Jaylynn Johnson, Brigadoon Elementary 2nd Place, Kara Butts, Nautilus Elementary Poem on back of Jennifer's poster was read to the assembly. Mayor Ertel thanked the Elks and D.A.R.E. for this community educational program and congratulated the students for their winning posters and thanked all for coming to the council meeting. Kathy Campola, 28624 21st Avenue South, Federal Way, 98003, called attention to need for sidewalks and traffic control in vicinity of Mark Twain Elementary School. Parked cars are on one side and some junk cars are left there, no buses and concern expressed for safety of the children, dogs also loose in the area. Public Services Committee will review the matter. -I- FEDERAL WAY CITY COUNCIL Regular Meeting April 17, 1990 AUDIENCE COMMENT (Coot.) City urged to Edward Stickel, 1228 S.W. 296th Street, Federal Way, 98023, defer action stated the city Logo should reflect the city name and council on Logo until was urged to defer official selection of a city Logo until city name is voters have decided regarding an official name. This matter resolved under review by Council of the Whole. Massage Leslee Jo Peterson submitted letter and brochure regarding Practitioners massage therapists and on behalf of the Federal Way "Massage request for for Health" therapists expressed objection to reference in word change in the proposed ordinance to massage ap rlors, felt to be a ordinance stigma to the massage health profession. It was also felt as health care professionals they should not be required to be further licensed and regulated by the city already being licensed by the state and that licensed massage practitioners be exempt from the ordinance. This matter is under review by the Public Services Committee. Council Al Brandt, 29014 20th Avenue South, Federal Way, spoke in Salaries objection to any increase in council salaries, community council members working for years with no salary. Also, not knowing what revenues will be available should be a consideration, the other cities with salaries comparable to that proposed being incorporated longer. Mark Twain Lisa Grimes, 2120 South 279th Street, Federal Way, 98003, School area called attention to map distributed of the Mark Twain school Retention Ponds area and retention pond locations and 12ft. deep in spots after the rains and needing attention as concerns safety of the children. Spring Cleanup Mary Ehlis, 31009 49th Avenue S.W. urged participation in Program Spring Clean Program on Saturday at 9:00 a.m., bags to be provided also refreshments,starting at the water and sewer district property. Car litter bags were distributed. F.W. Elks, Neil Burkel, 32736 35th Ave. SW, Federal Way, a member of interest in the Elks, noted the organization has sold its building and land for new is now looking for land and the parcel they are interested in building has been reclassified as MP and a Lodge would no longer be permitted. City Manager McFall advised a planning staff member will contact Mr. Burkel. PROCLAMATIONS Proclamation by Mayor Ertel was read joining with the Welcome to Council, City staff and Citizens of Federal Way in greeting Brent McFall new City Manager Brent McFall and extending him a warm welcome to the City of Federal Way. Victim Rights Proclamation by Maryor Ertel proclaimed April 22 through 28, Week 1990 as "Victim Rights Week" in Federal Way, all citizens requested to join in the observance. -2- Federal Way City Council Regular Meeting April 17, 1990 PROCLAMATIONS (Cont.) "Sexual Assault Proclamation by Mayor Ertel proclaimed April 22 through Awareness Week" April 28, 1990 as "Sexual Assault Awareness Week" in the 4/22/90- 4/28/90 City of Federal Way and all citizens were urged to join in the observance. CONSENT AGENDA Consent agenda items are distributed in advance of the council meetings, require routine council action and are adopted in a single motion without discussion. Minute Approval Councilmember Handmacher called attention to correction to 2/14/90, 2/27/90 minutes of 2/27, Pg. 12, RS 7600 should be RS 9600. 3/6, 3/13 and 3/20/90 VOUCHER APPROVAL Finance Committee Chairman, Councilmember Gates, reported Nos. 100098- 1000115,Committee approval of Vouchers Nos. 100098-100115/100117 - 100117- 1000156, 1000156 in total sum of $120,304.07, and certification $120,304.07 as to receipt of merchandise and /or services received. Council approval for payment was recommended. CORRESPONDENCE Summons & Complaint, City vs. Icing County, et al - Vacation Vacation,(S. 312th) of portion of G. W. Foster Road (South 312th) (Information - portion of G.W. Attorney Wallace previously authorized to appeal the Foster Rd. vacation of this street) Speed on 6th Letter from Edgar A. Engelhardt, 32083 6th Ave. SW., Federal Avenue - danger Way, 98023 advised of car count on 6th Ave. SW, between 320th to children and 330th in Campus Woods and over 1200 cars monitored in 24 hours. In concern for safety of the children in the area it was requestion that the streets be made one way or stop signs be installed. Referred to the Public Services Committee. Legislation Letter from Stephen R. Safety of Carolanne Watness, Principal, Twin Lakes Elementary School, children in expressed concern regarding further commercial and business Twin Lakes area development in the Twin Lakes area as regards student safety. Lack of bus service to Hoyt Road area and more cars, strangers big trucks, noise and construction serving to confuse and frighten the children, over 200 in each of 3 recesses. Patterson, Jr., 3955 S.W. 316th Street, noted request received from Ed Stickel urging friends to drop a line concerning a city Logo and that consideration of such was agreed to be premature when a city name change petition is in process. OLD BUSINESS COMMITTEE REPORTS Budget, Finance and Insurance Committee, Budget Review Meeting 4/27/90 at 7:00 a.m. Councilmember Gates, Chairman of the Budget, Finance and Insurance Committee, announced a meeting was-held Friday, 4/13/90 at 7:00 a.m. to begin looking at -the budget from the standpoint of the first revenues to come into the city (but not Sales Tax or Property Tax,) the city solvent and operating month to month at present. Council discussed the need for a Code Enforcement Officer as well as a receptionist for that area, due to number of phone calls coming in. The Code Enforcement Officer is budgeted and can be expedited, the receptionist to be funded through reserves in that budget. MOVED BY GATES, SECONDED BY HANDMACHER, TO AUTHORIZE THE CITY MANAGER TO HIRE A CODE ENFORCEMENT OFFICER AND RECEPTIONIST FOR THE BUILDING AND LAND USE AREA WITH OTHER DUTIES ASSIGNED AND FUNDING TO BE FROM THE CURRENT BUDGET ACCORDINGLY. CARRIED. Meeting was announced for 4/27/90, at 7:00 a.m. Human Services Councilmember Templeton, Chairman of the Human Services Committee Committee announced meeting on Friday, 4/20/90 at 7:00 a. m. Meeting, 4/20/90 Maureen McLaughlin, Director of Human Services with King 7.00 a.m. County to be present and Bob Davis from the group called PHASES. Land Use Committee Councilmember Handmacher, Chairman of the Land Use and Transportation Committee, announced meeting 4/23/90 at Meeting 4/23/90 7:00 p.m. the primary agenda item to make first cuts in 7:00 p.m. applicants for Planning Commission, 54 applications in hand to date. Meeting on Monday open to all councilmembers, Executive Session that meeting to be an Executive Session the 54 names to be Planning Commission cut to 18, criteria for selection circulated to council for Selection review prior to the meeting. Staff was requested to place dots on a map so council might have an idea of the geographic spread of applicants. Parks & Recreation, Councilmember Webster, Chairman of the Parks & Recreation, Cultural Arts Cultural Arts Committee, reported meeting and discussion on Committee the Panther Lake site in terms of the drainage situation and the need for a schematic master plan for that site. Some further study is required concerning the cost, report to be forthcoming later. Also, Randy Pearson, State Parks & Recreation Commission staff, Hylebos expert, reviewed the map and how various projects within the open space bond -4- FEDERAL WAY CITY COUNCIL Regular Meeting April 17, 1990 OLD BUSINESS (Cont.) C014MITTEE REPORTS Parks & Recreation Cultural Arts Committee Meeting 5/2/90 7:30 a.m. Facilities and Personnel Committee Review of Council rules & procedures Public Services Committee Meeting 4/27/90 8:00 a.m. ADMINISTRATIVE REPORTS issue fit in with the existing Hylebos wetlands state park and whether the Brooklake Community Club should be included, the concensus was to include through title report and appraisal phase and then another look will be taken in that regard. The proposed steering committee for the Comprehensive Plan for a Master Parks & Recreation Program, to be further discussed at study session of the council, recommendation to be made to drop the council member from the committee. Meeting was announced to be held on May 2, 1990 at 7:30 a.m., agenda to make first cut of consultants making proposals for the Comprehensive Plan for Parks & Recreation and Open Space. Councilmember Stead, Chairman of the Personel and Facilities Committee, reported review of site planning for the two sites for city hall, the new City Manager requested to make a report at meeting tomorrow. Meeting announced for Wednesday, April 25, 1990 at 7:30 a.m. to discuss council procedures and general rules and regulations. Councilmember Marks, Chairman of the Public Services Committee, reported review of seven ordinances and on Friday, April 27 at 8:00 a.m., the committee will meet to again hear from Jerry Graham regarding recycling. Letter from Major Moore requested the Gilmore Research Group talk to the council about community policing, time to be set. City Manager Brent McFall reminded the Council of the public hearings scheduled for Preliminary Plats in May and confirmed retreat scheduled for May 4 and 5, 1990, location not yet determined. ORDINANCES /RESOLUTIONS ORDINANCES Proposed ordinance was read adopting safety requirements Swimming pools, for swimming pools, hot tubs or spas and fixing a time hot tubs or spas when the same shall become effective. Some discussion ensued regarding discrepancies and unclear wording and it was subsequently MOVED BY WEBSTER, SECONDED BY HAND - MACHER, TO REFER THE ORDINANCE BACK TO THE CITY ATTORNEY FOR CLARIFICATION AND RETURN FOR CONSIDERATION NEXT WEEK. NO. 90 -52 Ordinance was read regulating electronic security devices; Electronic containing a severability clause; setting an effective date Security and approving an ordinance summary for publication. Massage Parlors Ordinance was read providing for the regulation and and Public licensing of Massage Parlors and Public Bathhouses; Bathhouses containing a severability clause and approving an ordinance summary for publication. MOVED BY STEAD, SECONDED BY GATES, TO REFER THE ORDINANCE BACK TO THE PUBLIC SERVICES COMMITTEE TO ALLOW INPUT FROM THE LICENSED-MASSAGE PRACTITIONERS. CARRIED. ORD. 90 -54 An Ordinance of the City of Federal Way, Washington was Permit System read, establishing a permit system and regulations for the for Fireworks sale, handling, discharge and display of fireworks. MOVED BY HANDMACHER, SECONDED BY GATES, TO REMOVE THE LANGUAGE "UNLESS ACCOMPANIED BY A PARENT" CARRIED. MOVED BY HAND - MACHER, SECONDED BY GATES, TO ADOPT THE ORDINANCE AS AMENDED. ROLL CALL VOTE FOLLOWED RESULTING IN FIVE AYES, AND TWO NO VOTE, TEMPLETON AND WEBSTER OPPOSING. CARRIED. Salaries of Ordinance was read providing for salaries of councilmembers Councilmembers or Mayors whose terms begin on or after January 1, 1992, after 1/1/92 providing for annual increases in said salaries and pro- viding an effective date. MOVED BY STEAD TO ADOPT THE ORDINANCE. MOTION DIED FOR LACK OF A SECOND. It was called to attention that statute RCW 35A.13.040 requires that salary be set, such salary to be effective 1/1/93. Objection expressed to C.P.I. wording in the proposed ordinance, matter to be further discussed at a later time. MOVED BY HANDMACHER TO TABLE THE MATTER UNTIL THE FIRST WEEK IN MAY AND THAT THE MATTER BE DISCUSSED FURTHER IN STUDY SESSION PREVIOUS THERETO. MOTION SECONDED BY GATES. CARRIED. -6- Federal Way City Council Regular Meeting April 17, 1990 ORDINANCES /RESOLUTIONS RESOLUTIONS RES. No. 90 -25 A Resolution of the City of Federal Way, Washington was read establishing a route corridor for the extension of S.W. 344th Street within the city limits of the city. MOVED BY HANDMACHER, SECONDED BY TEMPLETON, TO ADOPT RESOLUTION NO. 90 -25. CARRIED. NEW BUSINESS: Hylebos park Councilmember Webster, Chairman of the Parks & Recreation property Cultural Arts Committee, reported receipt of Interlocal acquisition Agreement with Washington State Parks & Recreation Commission as concerns their acting as our agent in securing title Interlocal insurance and appraisals and acquistion of the Hylebos park Agreement under property acquisition. The Committee will review the document Review and present recommendation at the neat council meeting. Letter of Intent Councilmember Webster reported need for letter of intent to to apply for the Interagency Commission for Outdoor Recreation which is the matching grant state agency which administers the matching grant program funds to acquire for acquisition and /or development of outdoor recreation areas outdoor recrea- in the state for both state and local agencies. Part of the tion areas in application process for an agency to be eligible to apply Federal Way is that a letter of intent be sent to the IAC prior to May 1, giving an indication of intent to apply for a grant for the acquisition of a piece of property. It does not. obligate the city but keeps the city eligible for matching funds in the event it wishes to participate MOVED BY WEBSTER, SECONDED BY GATES, TO AUTHORIZE THE CITY MANAGER TO SEND A LETTER TO THE INTERAGENCY FOR OUTDOOR RECREATION INDICATING THAT THE CITY OF FEDERAL WAY MAY BE MAILING APPLICATION FOR MATCHING GRANT FONDS FOR A PIECE OF PROPERTY FOR PARKLANDS DURING THE CALENDAR YEAR OF 1990. MOTION CARRIED. Human Services Councilmember Templeton, Chairman of the Human Services Providers and Committee inquired regarding release of funds to the various contracts for human service providers in the city. Attention was called funding -Staff to the need for contract agreements to be executed wherein assistance fund recipients specify the services to be provided and any needed conditions that that city may have on the use of those funds along with a reporting requirement as to activities and the level of support being provided with that funding. Council - member Templeton advised of the need for staff to assist with these programs and also a staff member needed to be assigned to assist with negotiations for the Community Development Block Grant Program for a two -year cycle. City Manager McFall was requested to provide the necessary staff support for the Human Services Committee meeting on Friday and for the Community Development Block Grant Program. Joint Planning Councilmember Handmacher called attention to proposed agree - with King Co. ment with King County for joint planning and it was determined the matter would be discussed at the upcoming special meeting. -7- FEDERAL WAY CITY COUNCIL Regular Meeting April 17, 1990 NEW BUSINESS: (Coot.) Letter regarding Discussion ensued regarding requests concerning the Mark Twain School Mark Twain School area and hazards to the children, area and the also as regards potential problem of retention ponds Retention problem in the area. The two matters were referred to the in that area Public Services Committee. Hylebos Wetlands Deputy Mayor Gates reminded council of the Earth day Park - Earth Day Bog Walk event at Hylebos wetlands park area inviting Bog Walk participation,some dramatic improvements to be seen in the area. Goodwill Games Councilmember Gates, in response to citizen requests discussion as to how to get onto the agenda for the next council session to talk about the Goodwill Games and city par- ticipation. This matter was referred to the next study session on 4/24/90. AUDIENCE COMMENT Inquiry regarding Ralph Horn, 25954 130th Place SE, Rent, inquired regarding processing of Bayview Town House project not appearing on either Exhibit permit A or B, permit already for pick up when the city was in- corporated and this not included. The project has been reviewed by the Land Use Committee and was approved for finalization by the County. MOVED BY HANDMACHER, SECONDED BY WEBSTER, THAT PERMIT C 88 -1693 KNOWN AS BAYVIEW TOWN HOUSES, BE REFERRED BACK TO KING COUNTY FOR PROCESSING. CARRIED. Smoke Detector BOB HASH, Interim Fire Chief, 32446 7th Place South, Program in called attention to remarks concerning smoke alarms Federal Way in Federal Way residences. He advised that the fire department has had a program in place for several years that when a firefighter goes into a residence where there is no smoke alarm in operation a smoke detector is installed free of charge (not usually in rental units); that this is one of the most significant life saving equipment known. The fire department stands ready to assist the city in such program. The Fire Chief confirmed a representative would be present at the Public Services Committee meeting on Friday. Farewell Roast Councilmember Webster reminded the assembly of farewell and Toast for dinner at the Twin Lakes Golf and Country Club for Interim City Manager City Manager Al Locke tomorrow evening and those desiring Al Locke to make remarks or make presentations were requested to advise the staff so they could be included on the program.
