CALL MEETING TO ORDER Mayor Ertel called the Federal Way city Council regular meeting to order at the hour of 7:05 p.m., on the 16th day of July, 1991, in Council Chambers, City Hall, Federal Way, Washington. II. PLEDGE OF ALLEGIANCE Councilmember Webster led the flag salute. III. COUNCIL ROLL CALL Council Present: Mayor Debra Ertel, Deputy Mayor Mary Gates and Councilmembers Jim Handmacher, Lynn Templeton, Joel Marks and Jim Webster. Excused Absence: Councilmember Bob Stead. city Staff Present: City Manager J. Brent McFall, City Attorney Sandra Driscoll, city Clerk Maureen Swaney and Deputy city Clerk Chris Green. Councilmember Templeton thanked city Council and Staff for their concern following his injury. IV. AUDIENCE COMMENT Barbara Barnev, 30503-7th Ave SW, Federal Way, on behalf of the Federal Way PTA Council, presented the Mayor and Council with a sustaining membership for their approval of the grant to fund clothing purchases for needy children in the community. Ron Zaffino, 4332 SW Dash Point Road, Federal Way, spoke in opposition to the existing sign code; he feels the city needs to sustain growth in the area. Mr. McFall explained City Staff is currently working with Mr. Zaffino, however, city code provisions limit their ability to allow variances. V. CONSENT AGENDA A. B. C. Approval of Minutes/July 2, 1991 Approval of Voucher Award of 1991 Asphalt Overlay Project Bid Councilmember Handmacher requested Item #C be pulled from the consent agenda. Motion by Councilmember Templeton to approve consent agenda with prior amendment to minutes and Item #C pulled; second by Councilmember Handmacher. Motion passed as follows: Templeton Gates Marks Stead yes Handmacher yes Ertel yes Webster excused absence yes yes yes City Manager McFall introduced Public Works Director Philip Keightley, who reported the recent asphalt overlay proj ect bid was awarded to low bidder, Woodworth & Company, which is lower than earlier cost projections. Motion by Councilmember Handmacher to approve asphalt overlay project bid award to Woodworth & Company; second by Councilmember Templeton. RESOLUTION (Next Resolution No. 91-66) A. city Center Local Development Grant A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, SUPPORTING THE COOPERATIVE AGREEMENT BETWEEN THE CITY OR FEDERAL WAY AND THE GREATER FEDERAL WAY CHAMBER OF COMMERCE IN ITS APPLICATION FOR LOCAL DEVELOPMENT MATCHING FUND GRANT APPLICATION ENTITLED, "A COMMUNITY VISION OF A CITY CENTER FOR FEDERAL WAY". FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES July 16, 1991 - Page 3 Mr. McFall offered a city staff report and explained the Council committee and Planning commission have already reviewed and approved the draft resolution for presentation to Council. Motion by Councilmember Webster to approve City Center Local Development Grant Resolution No. 91-66; second by Councilmember Handmacher. Discussion: Long Range Planning Manager Larry Springer responded to various council questions regarding the grant application. Motion to approve Resolution No. 91-66 "City Center Local Improvement Grant" passed as follows: Templeton yes Handmacher yes Gates yes Ertel yes Marks no Webster yes Stead excused absence VII. COUNCIL BUSINESS A. Ethics Board Appointments (City Staff Contact: Steve Anderson) Assistant city Manager Steve Anderson offered an explanation of the background of the Ethics Code Resolution--six finalists were interviewed by the Council on July 2nd and 9th, from which three position selections will be made; the Chair will serve a 3-year term with the other two members serving 2-year and 1-year terms. Motion by Deputy Mayor Gates to approve the following persons and terms for appointment to the Ethics Board: David Larson/Chair 3-year term; John Terry 2-year term; Rev Sheryl Peterson 1-year term. Arts commission Recommendations for contracting services (City staff Contact: Cheri McCabe) Recreation and Human Services Superintendent Cheri McCabe introduced Nancy Ise, Chair of Human Services Commission, who introduced her committee and reported to Council, followed by a question and answer period. There was discussion regarding preservation and relocation of the Denny cabin, at which time Historical Society Member Shirley Charnell expanded on the needs and requirements for moving the cabin as soon as possible. Motion by Councilmember Webster to approve the requested $6,000 funding for the cabin, wi th a provision that $3,000 be contributed immediately to assist in its relocation, and the remainder held in abeyance until such time as a permanent location is selected; second by Councilmember Marks. It was clarified that the estimated cost for dismantling and storing the cabin was more than $6,000, and that a permanent location had not yet been identified. Councilmember Webster amended his earlier motion to approve funding for the Arts Commission projects utilizing $lO,OOO budgeted for Arts and an additional $3,885 in contingency funds, noting the Historic Society could use the entire $6,000 toward cabin dismantling and relocation costs; second by Councilmember Marks. Soundview Manor Plat from B to A List (City Staff Contact: Stephen Clifton) Land Use Manager Greg Moore presented a brief staff report. He reported the Council Planning, Public Works & Transportation Committee has reviewed and recommended transfer of the project from the "B" list to the "A" list, which results in engineering and final plat plan reviews being conducted by Federal Way City Staff instead of King County. Surface Water Small Capital Authorization (City Staff Contact: Cary Roe) Improvement Projects Surface Water Manager Cary Roe distributed and presented updated information to Council. Based on review and approval by the Planning, Public Works & Transportation Committee, as well as the available budget, city Staff recommends a portion of the identified projects be completed in 1991, with the remaining projects completed in 1992 and 1993. Motion by Councilmember Handmacher to approve city Staff CIP Listing recommendations; second by Councilmember Marks. CITY MANAGER REPORT Mr. McFall announced the Public Hearing on the 6-Year Transportation Plan will be held Tuesday, July 23, 1991, at 7:30 p.m., in Council Chambers. He also announced the city's latest official population statistics from the State, as of April 1st, is 70,660. The joint study meetings of the oversite committee for Water/Sewer and City will be held July 17th and 18th at 7:00 p.m., and are meant to be informational only. He explained the committee hopes to have recommendations available later this Fall. Mr. McFall requested Mayor Ertel convene a 30-minute executive session prior to adjournment of the meeting for purpose of discussing negotiations for property acquisition. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES July 16, 1991 - Page 6 In response to Councilmember Webster's question regarding the latchkey program for the city, Mr. McFall reported funding will be through both Federal Way School and City agencies, with hopes of commencing the program in the Fall of 1992. IX. COUNCIL REPORTS councilmember Webster reported the Parks, Recreation & Human Services Committee will meet tomorrow at 7: 30 a.m., to review Parks/Recreation Commission applications. Deputy Mayor Gates reported the Administration & Public Safety Committee will meet Friday, July 19th, at 7:00 a.m., to discuss city Manager Evaluation Form, City Council Rules & Procedures, Cablevision Extension and Unattended Children in Vehicles Draft Ordinance. The next meeting will be July 26th, to possibly discuss Dance Hall Draft Ordinance. councilmember Handmacher announced the Planning, Public Works & Transportation Committee will meet July 31st at 7:00 p.m.. He reported he is unable to attend the July 23rd TIP Public Hearing. He also announced Metro representatives will present transportation information at the special/study session on July 29th. Councilmember Templeton announced he is unable to attend the upcoming King County Human Services Roundtable; Recreation/Human Services Superintendent Cheri McCabe will attend, as will councilmember Webster if possible. Mayor Ertel advised she will attend the Roundtable Mini- Retreat in Bellevue on behalf of councilmember Templeton. x. AUDIENCE COMMENT H. David Kaplan, 30440-27th Ave So, Federal Way, reported on the Community Council's recent meeting and thanked the Council for their support of the Evergreen Airstrip property purchase. Shirlev Charnell, 30602 Pacific Highway So, #K303, on behalf of the Historical Society, thanked the Council for their assistance in funding the preservation of the two historical cabins. She has also received offers for help in moving the Denny cabin from Fire District Chief Bob Hash and puget Power Business Manager Kevin Beck. One suggestion made would be to utilize the Denny cabin as a future parks' informational center. XI. EXECUTIVE SESSION To discuss negotiations for property acquisition pursuant to RCW 42.30.ll0(b). Mayor Ertel recessed the regular meeting at 8:40 p.m., and announced the City Council would convene for a 30- minute executive session to discuss property acquisition, and would return to Council Chambers at 9:10 p.m.. At 9:05 p.m., Assistant City Manager Ken Nyberg announced the Council extended the executive session to 9:30 p.m.. At the hour of 9:25 p.m., Assistant City Manager steve Anderson announced the executive session is extended to 9:45p.m.. Mayor Ertel announced the executive session adjourned at 9:40 p.m., with no action taken, and reconvened the regular meeting. XII.
