I.
CALL MEETING TO ORDER
Mayor Ertel called the Federal Way city council regular
meeting to order at the hour of 7: 04 p. m., on the 3rd day
of September, 1991, in council Chambers, City Hall,
Federal Way, Washington.
II.
PLEDGE OF ALLEGIANCE
Councilmember Webster led the flag salute.
III.
COUNCIL ROLL CALL
councilmembers Present: Mayor Debra Ertel, Deputy Mayor
Mary Gates and councilmembers Jim Handmacher, Lynn
Templeton, Joel Marks, Bob Stead and Jim Webster.
city Staff Present: city Manager J. Brent McFall,
Assistant City Attorney Carolyn Lake, City Clerk Maureen
Swaney and Deputy city Clerk Chris Green.
IV.
AUDIENCE COMMENT
John Karl, 35620 Pacific Highway So, Federal Way,
expressed concerns on various issues, i.e., Brooklake
Community Center activities, local motel owner/operator
problems and "jake brake" restrictions within city.
David Wooden, 2511 So 286th PI #D-I04, Federal Way,
manager of Matrixx, spoke in opposition to the proposed
dance hall ordinance.
Jullianne Bruce, 33310 Pacific Highway South, Federal
Way, owner of Matrixx, spoke in opposition to the
proposed dance hall ordinance.
Casev Leifson, l307 So L st, Tacoma, also spoke in
opposition to the proposed dance hall ordinance.

INTRODUCTION ORDINANCES
A.
Dance Hall
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, PROVIDING FOR THE LICENSING AND
REGULATIONS OF PUBLIC DANCES AND DANCE HALLS,
ESTABLISHING LICENSING REQUIREMENTS, PENALTIES,
ESTABLISHING GROUNDS FOR REVOCATION OF LICENSES AND
ESTABLISHING AN EFFECTIVE DATE.
Mayor Ertel presented first reading of the ordinance and
asked Deputy Mayor Gates to give a brief presentation
from Administration Committee meeting discussion on the
issue. Police Chief Bob Evans was asked for an update
report on recent problems and department concerns
regarding Matrixx, and responded to inquires from several
councilmembers.
B.
Amendment to Portion of SEPA
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, RELATING TO THE ENVIRONMENTAL POLICY,
PROVIDING FOR APPEALS FROM A HEARING EXAMINER DECISION TO
BE FINAL AND FURTHER APPEALS TO BE TAKEN TO SUPERIOR
COURT, AMENDING FEDERAL WAY ORDINANCE NO. 90-40.
Mayor Ertel presented first reading of the ordinance.
Councilmember Handmacher gave a brief report on the
proposed ordinance, as discussed at recent Planning/
Public Works/Transportation Committee meetings.

C.
Approval of Water System Plan
AN ORDINANCE OF THE CITY COUNCIL OF FEDERAL WAY,
WASHINGTON, APPROVING THE WATER SYSTEM PLAN OF THE
FEDERAL WAY WATER AND SEWER DISTRICT COMMISSIONERS,
PURSUANT TO RCW 57.16.010, AND AMENDING FEDERAL WAY CODE
TITLE 20.230 (ORDINANCE NO. 90-40) TO ADOPT THE FEDERAL
WAY WATER AND SEWER DISTRICT WATER SYSTEM PLAN AS A CITY
OF FEDERAL WAY SEPA POLICY.
Mayor Ertel presented first reading of the ordinance.
Councilmember Handmacher reported the Planning/public
Works/Transportation Committee and Planning Commission
have both recommended passage of the ordinance.

FOR STREET VACATION PROCESS; AMENDING RESOLUTION NO.
90-18.
Motion by Councilmember Handmacher to approve Street
Vacation Fee Schedule Resolution; second by Deputy Mayor
Gates. Motion to approve Resolution No. 91-71 "Street

Suburban cities Association/Staffing & Funding Proposal
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, RELATING TO PARTICIPATION IN THE KING
COUNTY SUBURBAN CITIES ASSOCIATION, PROVIDING FINANCIAL
SUPPORT THEREFOR, AND CALLING FOR THE PROVISION OF STAFF
FOR THE ASSOCIATION.
Motion by Councilmember Stead to approve Suburban cities
Association Resolution; second by Councilmember
Templeton. Following lengthy discussion by Council,
motion to approve failed as follows:

Motion to amend proposed resolution by Councilmember
Handmacher to state as follows: "section 1. Remain
unchanged. "section 2. Federal Way opposes the
inclusion of expenditures for staff in the Suburban
cities Association budget as recommended by the Emergent
Issues Committee of the association and opposes the by-
law change as currently recommended by the Emergent
Issues committee, and directs the Mayor to cast a
negative vote on behalf of the city of Federal Way on
both these issues at the September II, 1991, meeting of
the King County Suburban cities Association"; second by
Councilmember Stead.
Prior to a vote on the amended resolution, Councilmember
Handmacher offered the following friendly amendment:
"The City Council urges the Suburban cities Association
to adopt a by-law change that more accurately reflects
per capita relationship of the cities and review the
staffing issue after those by-law changes are complete,
or clarify that Federal Way is interested in further
discussion on the process" ; Councilmember Stead
concurred.
Councilmember Webster moved to table action to end of
agenda, at which time City Staff would present actual
language to express intent of the amended SCA resolution;

Approving Issue Paper/Cooperative Work Programs/City &
Water/Sewer District
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, APPROVING A REPORT ENTITLED "ISSUES FOR
FUTURE COORDINATION BETWEEN THE CITY AND THE FEDERAL WAY
WATER AND SEWER DISTRICT".

Coordination Issues Resolution; second by Councilmember

Mayor Ertel called a five-minute recess at 8:34 p.m.
Mayor Ertel reconvened the regular meeting at 8:39 p.m.,
and announced the next agenda item.
IX.
COUNCIL BUSINESS
A.
Comprehensive Housing Affordability Strategy
Long Range Planning Manager Larry Springer gave a short
report and introduced Housing Consultant Tom Phillips who
provided additional housing information to Council. Mr.
Springer explained a public hearing is required and will
possibly be held in late October or early November. He
also reported the Council is required to delegate a
hearing authority, for which city Staff recommends naming
the Human Services commission to act as such authority.
Motion by Councilmember Marks to appoint Human Services

Merit Decisions/Amend Zoning Code to Delete Process
Assistant City Attorney Carolyn Lake explained the action
before the city Council is to make a merit decision to
delete the current merit decision process and refer it to
the Planning Commission for action and recommendation; it
will then be brought back to the Council for approval.
Councilmember Handmacher reported the Planning/Public
Works/Transportation Works/Transportation Committee has
recommended approval and referral to the Planning
Commission for further review. He further explained if
the proposed change is adopted, it will not prevent the
public from making recommendations for changes to the
zoning code, it would simply change the process by which
that is currently done. An affirmative vote by Council
at this time will not change anything, it merely requests
review by the Planning Commission.
Motion by Councilmember Handmacher to determine the
proposal has merit and recommends referral to Planning
Commission for review; second by Councilmember Marks.

Process & Priorities for Funding 1992 HS Applications
Parks/Recreation/Human Services Director Joe Stevens
introduced Human Services commission Chair Helen
Middlebrooks who presented the Commission's human service
priorities, application evaluation criteria and
funding/role option recommendations to Council. She
reported Recreation/Human Services superintendent Cheri
McCabe is preparing a priority chart to assist the
Commission. Ms. Middlebrooks also introduced members of
the Commission in attendance.

D.
Bid Award/Sacajawea Tennis Court Illumination Project
Maintenance and operations Superintendent Jennifer
Schroder presented the Council with an explanation of the
tennis court illumination project, and requested Council
to award contract to low bidder, Ed Rosendin Electric, in
the amount of $51,000. Councilmembers asked varying
questions about the types of recommended illumination, as
well as inquiry about the length of the current lease on
the subject property. Mr. McFall reported information
will be available at the next regular meeting.
Motion by Councilmember Webster to approve the
illumination project and award the contract to the low
bidder, contingent upon city Staff's review of the
current lease period; second by Councilmember Stead.

CITY MANAGER REPORT
A.
Comprehensive Park, Recreation & Open Space Plan
Mr. stevens distributed the written Comprehensive Park,
Recreation and Open Space Plan to Council, as prepared by
Consultant J. C. Draggoo & Associates. He also
recognized the Parks Advisory Task Force for its diligent
work the past nine months.
B.
Overlay Presentation
Public Works Director Philip Keightley presented an
updated status report on current overlay projects. He
also reported on surface water projects, including the
dredging of Hylebos Creek. He reported on his
participation in the Growth Management Act meetings, as
well as discussions with the City of Tacoma for surface
water and transportation issues. He is also involved
with the steering committee for transportation and
regional water issues, and is a board member of the State
city Engineers organization.

City Manager McFall reported the city Center grant
funding has been received and costs will be supplemented
by private sector, as well as that of City assistance
through Staff time and effort.
Mr. McFall advised the joint meeting with Fire and
Water/Sewer on Golfun property usage will be reset to
sometime in October since september 26th was not
convenient for everyone. He reminded Council there will
not be a study session on September 10th, and further
reminded them of the tabled SCA resolution, which needs
to be brought back for action at this time.
Motion by Councilmember Handmacher to remove the Suburban
Cities Association proposed amended resolution from the
table for further action; second by Deputy Mayor Gates.

Following additional discussion and concern about the
proposed amended SCA resolution, it was agreed by Council
to schedule a study session for September 10th for the
purpose of discussing the issue more thoroughly prior to
taking action. Mayor Ertel will be attending the SCA
meeting on September 11th and will be asked at that time
to report on the Council's action on the resolution.
Mayor Ertel announced the SCA resolution action will be
tabled to the September 10th special session.
XI.
COUNCIL REPORTS
Councilmember Webster reported the next meeting of Parks/
Recreation/Human Services Committee will be held tomorrow
at 7:30 a.moo
Deputy Mayor Gates said the next meeting of the
Administration Committee will be September 13th at 7:00
a.m.; the agenda will be Council Rules and Procedures.
Councilmember Handmacher reported the next meeting of the
Planning/Public Works/Transportation Committee will be
September 9th at 7:00 p.m., with agenda to be announced.

XII.
AUDIENCE COMMENT
Jullianne Bruce, 33310 Pacific Highway, Federal Way,
further discussed her opposition to the proposed dance
hall ordinance.
H. David Kanlan, 30240-27th Ave So, Federal Way, urged
the Council to retain the current hearing examiner
appeals process. He also urged a thorough review of the
city housing authority issues.
XIII.
