City Council Chambers - City Hall 33530 First Way South * * * * * * * * * * CALL MEETING TO ORDER Mayor Ertel called the Federal Way City Council regular meeting to order at the hour of 7:00 p.m., on the lst day of October, 1991, in Council Chambers, City Hall, Federal Way, Washington. PLEDGE OF ALLEGIANCE Councilmember Webster led the flag salute. COUNCIL ROLL CALL council Present: Mayor Debra Ertel, Deputy Mayor Mary Gates and Councilmembers Jim Handmacher, Lynn Templeton, Joel Marks, Bob Stead and Jim Webster. city Staff Present: city Manager J. Brent McFall, City Attorney Sandra Driscoll, city Clerk Maureen Swaney and Deputy city Clerk Chris Green. PROCLAMATION Domestic Violence Awareness/Month of October Mayor Ertel read and presented the proclamation to Nancy McEleney, Member of Kinq County Women's Advisory Board. SPECIAL PRESENTATION September and October city Staff "SPIRIT" Awards City Manager McFall introduced and presented plaques to the followinq Spirit Award winners: ORIGINAL FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES October 1, 1991 - Page 2 September award went to Community Development/Public Works Department Receptionist Rhonda Watson for her kindness, caring and compassion and for placing the interests of others above her own. October award winners were Accounting Manager Dick Scott, Financial Analyst Brenda Trent, Accounting Technician John Caulfield and Finance Administrative Secretary Becky Metcalf, all members of the Finance Department team instrumental in preparing the City's first Comprehensive Annual Financial Report. VI. AUDIENCE COMMENT Rav Schow, 33130 Pacific Highway South, Federal Way, requested clarification of Evergreen Airstrip purchase agreement. Jere Peterson, 32931-6th Ave SW, Federal Way, urged City to better control vehicle speeds and install stop signs on SW 330th and 6th Ave SW. Rick Gardner, 309 SW 321st, Federal Way, as spokesperson for Campus Woods residents, distributed a written study packet to all Councilmembers, which information contains the residents' public safety findings for vehicular speeds at 6th Ave SW and SW 330th. Councilmember Handmacher reported his committee will take a look at their study during the next meeting; city Staff will give notice of the meeting to interested citizens. Barbara Gardner, 309 SW 321st, Federal Way, also voiced concern about excessive speeds on 6th Ave SW and SW 330th. Doua Shafer, 32628-6thAve SW, Federal Way, addressed the issue of drivers' low visibility of residents exiting their driveways on 6th Ave SW. Susan Honda, 32419-6th Ave SW, Federal Way, expressed concern about the safety of children crossing 6th Ave SW, as well as those waiting for and exiting school buses; she requested stop signs and crosswalks for the area. Roaer Murdock, 3252l-6th Ave SW, Federal Way, also expressed concern about public safety and requested stop signs and crosswalks on 6th Ave SW. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES October 1, 1991 - Page 3 Dale Ranstrom, 32513-6th Ave SW, Federal Way, reinforced concerns of other residents regarding public safety in the 6th Ave SW neighborhood. Councilmember Marks requested a response to Mr. Schow's inquiry regarding the Evergreen Airstrip agreement, as well as expressing concern for public health and safety in the airstrip vicinity. Mayor Ertel suggested Mr. Schow meet with City Attorney Driscoll and city Manager McFall to review the contract. She also recommended the Council discuss the matter in an upcoming study session. councilmember Webster said the Parks, Recreation and Human Services Committee will review the subject at its next meeting. Deputy Mayor Gates thanked the 6th Avenue residents for their concerns and traffic survey, and indicated Councilmembers share their concern for public health and safety. VII. CONSENT AGENDA A. B. C. Approval of Minutes - September 17, 1991 Approval of Voucher - October 1, 1991 Interlocal with King County for Art in the Park Motion by Councilmember Stead to approve consent agenda; second by Councilmember Templeton. PUBLIC HEARING A. 1992 city of Federal Way Budget Mayor Ertel opened the public hearing at 7:37 p.m., and invited citizens with comments to come to the podium. The following persons addressed the Council: Richard Knudson, 33l09-l0th PI SW, Federal Way, requested the allocation of funds for increased litter cleanup along the main streets in the West Campus area; he presented a letter to Council on the subject. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES October 1, 1991 - Page 4 Peter Townsend, 27508-12th Ave SW, Federal Way, opposes any tax increase and disagrees with the recently released classification study. Toska Rodriauez, 2627 So 302nd, Federal Way, spoke in favor of the proposed arts budget of $2 per capita, as the City needs a "vision" to promote arts in the community. Carol Berlin, 700 So Marine Hills Way, Federal Way, also favors the $2 per capita for arts, especially for funding the Philharmonic. There being no further public comment, Mayor Ertel closed the public hearing at the hour of 7:48 p.m.. IX. RESOLUTIONS A. Southampton Court Final Plat Approval A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, APPROVING THE FINAL PLAT OF SOUTHAMPTON COURT, DESIGNATED AS KING COUNTY BUILDING AND LAND DEVELOPMENT FILE NO. 387-22. Motion by Councilmember Handmacher to approve Southampton Court final plat; second by Councilmember Stead. Councilmember Handmacher reported the plat has been reviewed by the Planning Commission, as well as the Planning, Public Works and Transportation Committee, and both have recommended approval. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES October 1, 1991 - Page 5 Motion by Councilmember Handmacher to approve West Lake final plat; second by Councilmember Marks. Councilmember Handmacher reported this is another plat received from King County, which has been reviewed by the Planning Commission and the Planning, Public Works and Transportation committee; both have recommended approval. Motion to approve Resolution No. 91-79 "West Lake Final Plat Approval" passed as follows: Handmacher yes Templeton Gates yes Ertel Marks yes Stead Webster yes C. 800 Mhz Bond Issue Support yes yes yes A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, SUPPORTING THE KING COUNTY NOVEMBER 5, 1991, GENERAL ELECTION BOND ISSUE FOR 800 MHZ REGIONAL RADIO SYSTEM. Mayor Ertel invited Assistant Fire Chief Dave Crossen to present an explanation of the proposed resolution. He reported this will allow a link between fire and police personnel, as well as providing a future backbone communication system for the City's entire vehicle fleet. He explained there are no additional frequencies available with the existing system, and this will allow better access and communications for all citizens. Deputy Mayor Gates reported the present system could possibly fail during an earthquake, whereas the new system would remain operative. Chief Crossen further reported the homeowner's cost of the system is seven cents per thousand, making a total of $7 per $IOO,OOO of assessed valuation. Motion by Councilmember Marks to approve Resolution No. 91-80 "supporting King County Bond Issue for 800 Mhz Radio System"; second by Deputy Mayor Gates. King County Levy for Emergency Medical Services Support A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, SUPPORTING THE KING COUNTY NOVEMBER 5, 1991, GENERAL ELECTION BALLOT MEASURE AUTHORIZING A COUNTYWIDE PROPERTY TAX LEVY OF $.025 PER THOUSAND OF ASSESSED VALUE TO SUPPORT EMERGENCY MEDICAL SERVICES. Chief Crossen reported this levy approval will not create any new taxes since it is a reissue of the past 6-year period; it will be effective from 1992 through 1997. Motion by Deputy Mayor Gates to approve Resolution No. 91-81 "Supporting King County Ballot Measure Authorizing Assessment for Emergency Medical Services"; second by Councilmember Marks. Economic Development Council Membership City Manager McFall explained this will allow the city to provide economic growth by allow the City to join with both King County and pierce county Economic Development groups for the cost of one membership (ten cents per capita or the sum of $7,066), which will take effect January 1992. Deputy Mayor Gates said the issue has been reviewed by the Administration Committee and its members feel involvement with these organizations is in the best interests of the city; it will not create a budget impact this year. Motion by Councilmember Marks to approve memberships in both King County Economic Development Council and pierce County Economic Development Board; second by Deputy Mayor Gates. Designation of Voting Delegate and Alternate to National League of cities Motion by Deputy Mayor Gates to appoint Councilmember stead as voting delegate, with councilmember Handmacher and Mayor Ertel as alternates; second by Councilmember Templeton. City Staff Cost of Living Adjustment As an added item, Councilmember Webster reminded Council of their previous motion to place staff cost of living adjustment (2% on 1/91 and 2% on 7/91) on hold until the classification study was completed. Since the study reflects the majority of employees are at or below market value, he feels a 2% salary increase from July 1991 would be in concert with the Council's original intent. Councilmember Stead feels the issue should be set aside until the Administration Committee has reviewed the survey. Deputy Mayor Gates reported discussion of the classification study is scheduled for the October 8th meeting, and will be brought back to the Council as soon as possible. Councilmembers Handmacher and Templeton concurred with having the committee first review the study. Councilmember Webster said the monies withheld were placed into he contingency reserve and are available at this time, with a cost to the city of approximately $16,500. Councilmember Marks understands Councilmember Webster's concern, but feels the study is badly flawed and all problems need to be worked out before the issue is presented to the full Council. A consensus of Councilmembers feel the cost of living issue should be referred back to the Administration Committee prior to a vote of the Council. XI. CITY MANAGER REPORT Mr. McFall introduced Long Range Planning Manager Larry springer who reported on last night's puget Sound Planning Council meeting. Information regarding the proposed bylaws were distributed to Councilmembers. Also FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES October 1, 1991 - Page 8 discussed was the King County Planning Council, which last met on September 20th; recommendation has been for a 15-member body of six from Seattle (3 votes), three from Suburban Cities (3 votes) and six from King County (6 votes). Councilmembers questioned the City's membership in the Planning Council. Mr. McFall explained dues were not paid to COG, but the Council might be interested in joining the Planning Council for remainder of the year, so Federal Way would be included in issues. The money is available through contingency funds, however, the City has not yet received notification of the required dues. councilmember Handmacher expressed concern that Federal Way might be "left out in the cold" if there is no representation, however, he isn't interested in paying any monies to COG. Councilmember Stead also expressed concern about the distribution of funds. City Manager McFall reported dues are based on population. He will have City Staff would explore the issue and report back to Council regarding a pro rata share. It was noted that Larry Springer and Philip Keightley have been appointed to the King county Regional Liaison Committee for county-wide planning issues. Mr. McFall introduced Public Works Director Philip Keightley who presented his Department's request for additional City staff. He explained the City could save over $164,656 per year, plus improve service to citizens, by hiring five full-time positions to replace persons currently contracted through independent consultants or King county. In addition, the department requested the hiring of a new Surface Water Engineer. The annual savings to the City for the six new positions would be approximately $82,744, in lieu of contracting for services. New Public Works Department positions requested are as follows: Senior Engineer, Junior Engineer, Secretary, Surface Water Engineer and two Field Inspectors. Motion by Councilmember Handmacher to authorize City Manager to fill the six posts requested by Public Works Department, and make necessary adjustments in existing contracts; second by Councilmember Marks. Councilmember Handmacher reported the request has been reviewed by the Planning, Public Works and Transportation committee, which recommended approval action be referred FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES October 1, 1991 - Page 9 to council of Whole. councilmember Marks said he would like to take a vote at this time, but wants additional time to consider the request. XII. COUNCIL REPORTS councilmember Handmacher reported the Planning, Public Works and Transportation Committee will meet October 8th, and again on October 14th, at which time they will discuss the traffic problems on 6th Ave SW, as outlined by citizens during tonight's meeting. He will meet with the community Council and METRO on October 3rd to discuss transit issues in the area. Deputy Mayor Gates reported the Administration Committee met this morning and will meet October 8th at 6:00 p.m., to review the classification study. She also reported she has been involved with the International Conference of CARE and Tacoma Regional Leadership at no cost to the City. She feels representation is important since Federal Way is located between two world seaports. Councilmember Webster reported the Parks, Recreation and Human Services Committee will meet tomorrow at 7:30 a.m.. He will be in Vale, Colorado next week at a parks symposium at no cost to the city. Councilmember Templeton reported he will be out of town for the next two Council meetings, and expressed his support for the proposed budget/human services items. Councilmember Marks requested a schedule for upcoming budget presentations. Mr. McFall reported department presentations are scheduled to start October 15th, with the ability to make timetable adjustments if conflicts arise. To discuss pending litigation pursuant to RCW 42.30.110(i) Mayor Ertel recessed the regular meeting at 8:47 p.m., and announced the city Council would convene for an executive session to discuss pending litigation. She also announced there would be no business conducted following adjournment of the executive session. Mayor Ertel announced the executive session adjourned at 9:15 p.m., with no action taken, and reconvened the regular meeting. xv. ADJOURNMENT There being no further business to come before the Council, Mayor Ertel adjourned the regular meeting of the Federal Way city Council at the hour of 9:15 p.m.. ~~~~ N.
