I.
CALL MEETING TO ORDER
Mayor Ertel called the Federal Way city council regular
meeting to order at the hour of 7:04 p.m., on the 15th
day of october, 1991, in council Chambers, City Hall,
Federal Way, Washington.
II.
PLEDGE OF ALLEGIANCE
Councilmember stead led the flag salute.
III.
COUNCIL ROLL CALL
Council Present: Mayor Debra Ertel, Deputy Mayor Mary
Gates and councilmembers Jim Handmacher, Joel Marks and
Bob Stead. Excused Absence: Councilmembers Lynn
Templeton and Jim Webster.
city Staff Present: city Manager J. Brent McFall, city
Attorney Sandra Driscoll, city Clerk Maureen swaney and
Deputy city Clerk chris Green.

AUDIENCE COMMENT
Sandra McCord, Assistant Superintendent/Federal Way
School District, invited cooperation between city and
School District; she also indicated her support for arts.
H. David Kaplan, 30204-27th Ave So, Federal Way, inquired
as to the name of the person selected for the Planning
Commission vacancy.
Georae Lee, 2101 So 324th #194, Federal Way (Belmore
Park), addressed problems he has encountered in obtaining
City building permits.

Councilmember Handmacher explained the Planning/public
Works/Transportation Committee met last night and
recommended Luana Joslin be appointed to the Planning
Commission vacancy.
Motion by Councilmember Handmacher to approve Luana

VI.
PUBLIC HEARING
A.
street Vacation/Portion of South 335th Street
Mayor Ertel opened the public hearing at 7:13 p.m.
City Staff report was presented by Street Systems Manager
Ken Miller followed by a Council question and answer
period. Councilmember Handmacher suggested a condition
be added to require the property owner to provide cost of
establishing access onto 335th Street, instead of 6th
Avenue. Councilmember Stead inquired if the vacation
could be conditioned on the property being deeded back to
the city if an east/west access becomes advisable in the
future. City Attorney Driscoll said she would have to
review the issues more thoroughly and get back with the
Council regarding their concerns.
Mayor Ertel opened the public comment portion of the
public hearing at 7:23 p.m., and invited citizens to
participate. The following individual addressed the
Council:
Helmut Wallenfels, Weyerhaeuser company representative,
explained why the company had submitted an application
for the street vacation. They would like to control
access to the area for the safety and security of their
employees and vehicles. He also responded to questions
by several Councilmembers.
There being no further public comment, Mayor Ertel closed
that portion of the public hearing at 7:31 p.m..
Councilmembers addressed additional concerns regarding
the street vacation, including set back requirements, at
which point Mayor Ertel suggested a Council decision be
tabled to the next regular meeting. Mr. McFall explained
the public hearing requirement has now been satisfied.
Following additional discussion, a unanimous decision was
made to have city sta{f will take an in depth look at the
vacation request and report back to the Council on
November 5th.
Mayor Ertel closed the public hearing on the street
vacation at 7:36 p.m..

VII.
RESOLUTIONS
A.
Campus Ridge Final Plat
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, APPROVING THE FINAL PLAT OF CAMPUS
RIDGE, DESIGNATED AS KING COUNTY BUILDING AND LAND
DEVELOPMENT FILE NO. S89POO16.
Senior Planner Stephen Clifton presented the City Staff
report. He explained the plat has been reviewed by the
Planning/Public Works/Transportation Committee, which
recommended final approval.
Motion by Councilmember Handmacher to approve Campus
Ridge Final Plat; second by Councilmember Stead. Motion
to approve Resolution No. 91-82 "campus Ridge Final Plat"

B. Mirror Lake Terrace Preliminary Plat
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, APPROVING THE PRELIMINARY PLAT OF MIRROR
LAKE TERRACE, KING COUNTY BUILDING AND LAND DEVELOPMENT
FILE NO. S89PO053 WITH CONDITIONS.
Mr. Clifton also presented the City staff report for
Mirror Lake Terrace. He explained the Hearing Examiner
previously reviewed the plat application. Councilmember
Handmacher reported the Planning/Public Works/
Transportation Committee recommended the addition of
pedestrian crossing signals, of which the developer would
pay a pro rata share of the costs. Councilmember Stead
inquired if the review would have to be reopened to
include an assessment for the added signals; Ms. Driscoll
said the resolution would adequately reflect it.
Motion by Councilmember Stead to approve Mirror Lake
Terrace Preliminary Plat; second by Councilmember

C. King County Housing Authority
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, AUTHORIZING THE EXECUTION OF A
COOPERATION AGREEMENT WITH THE KING COUNTY HOUSING
AUTHORITY PERMITTING THE ACQUISITION OF UP TO FIVE (5)
UNITS OF FEDERALLY ASSISTED LOW-INCOME HOUSING AND
DECLARING A NEED FOR THE KING COUNTY HOUSING AUTHORITY TO
FUNCTION WITHIN THE CITY OF FEDERAL WAY.
Mr. McFall called upon Assistant City Manager Anderson to
address the Council on the issue. Mr. Anderson reported
he previously met with Dan Watson of the King County
Housing Authority, who is present to answer any Council
questions. He explained King County currently has
houses available that meet the guidelines, but it
requires city Council approval to meet HUD requirements.
Steve Anderson then introduced Mr. Watson who offered an
explanation to Council, as well as answering their
questions. Councilmember Handmacher expressed concern
about certain language in the agreement, and said he
would feel more comfortable in having city Staff review
and make changes prior to the Council approving the
proposed resolution. Mr. McFall reported he understands
any delay might create problems with several of the real
estate transactions now pending.
Mr. Watson introduced selling agent Susan Ramos who
expressed her concern about losing at least two units if
the agreement approval with HUD is delayed. She
explained four units have previously met all criteria,
but two of the sellers are reluctant to extend their
offers for an additional period of time.
Mayor Ertel suggested this item be set aside and brought
back following the Arts Commission presentation--to allow
City Staff adequate time to review, make the necessary
changes and come back to the Council with the revised
documents. Councilmembers concurred with Mayor Ertel's
suggestion, saying they would be more comfortable with
making revisions to the proposed resolution and agreement
at this time, and not delay the process if at all
possible.

VIII.
COUNCIL BUSINESS
A.
Arts Commission Contract Recommendations
Arts Commission Chair Nancy Ise presented a summary of
the Commission's recommendations for 1992 contracted
services. She thanked commission members for their
dedication and time spent setting the recommendations.
IX.
RESOLUTIONS (CONTINUED)
City Attorney Driscoll presented the following revisions
to the proposed housing authority resolution and
cooperative agreement:
Page 2 of the resolution adds the word "existing" to read
"five (5) units of existinq low-income housing". The
attached cooperation agreement would be revised to
"delete paragraphs 4 (b), (c), and (d), as well as the
entirety of paragraph 5".

No. 91-84 "Cooperation Agreement with the King County
Housing Authority", including attached cooperation
agreement, as amended; second by Councilmember Stead.

CITY MANAGER REPORT
Mr. McFall reminded the Council of the scheduled
executive session to discuss property acquisition and
pending litigation prior to adjournment of the meeting.
XI.
COUNCIL REPORTS
In Councilmember Webster's absence, it was reported the
next meeting of the Parks/Recreation/Human Services
Committee will be held October 25th at 7:30 a.m..
Deputy Mayor Gates reported the next Administration
Committee will be October 22nd at 7:30 a.m., at which
time they will be reviewing an amendment to the existing
Temporary Business License Ordinance.

Councilmember Handmacher reported the Planning/public
Works/Transportation Committee met last night to discuss
the 6th Avenue public safety hazards, and will meet again
on October 28th. The Planning commission will be
discussing the recycling program, so the public hearing
can be scheduled for the November 5th Council meeting.
It is hoped the program can be implemented by March 1992.
Public Works Director Philip Keightley explained the
necessity for approving the process as soon as possible.
Motion by Councilmember Handmacher to commence process
for adoption of the Waste Reduction and Recycling
Implementation Plan as adopted by Ordinance No. 90-73 in
August 1990; second by Councilmember Stead. Motion

XII.
AUDIENCE COMMENT
Pat Fulmer, expressed his support for arts per capita
tax, not only for current, but future arts programs.
H. David KaDlan, asked for a clarification of Mr.
Fulmer's statement regarding the arts.
It was unanimously concluded by Councilmembers that the
tentatively scheduled budget presentation study session
be held at a later date.
XIII.
EXECUTIVE SESSION
A.
To discuss property acquisition pursuant to
RCW 42.30.110(b)
B.
To discuss litigation or potential litigation pursuant to
RCW 42.30.1l0(i)
Mayor Ertel recessed the regular meeting at 8:42 p.m.,
and announced the Council would convene for an executive
session to discuss property acquisition and pending
litigation. She also announced there would be no
business conducted following adjournment of the executive
session.

Mayor Ertel announced the executive session adjourned at
10:20 p.m., with no action taken, and reconvened the
regular meeting.
XIV.
ADJOURNMENT
There being no further business to come before the
Council, Mayor Ertel adjourned the regular meeting of the
Federal Way City Council at the hour of 10:20 p.m..
