CALL MEETING TO ORDER Deputy Mayor Gates called the Federal Way City Council Regular Session to order at the hour of 7:05 p.m., on the 19th day of March, 1991, in Council Chambers, City Hall, Federal Way, Washington. PLEDGE OF ALLEGIANCE Councilmember Marks led the Council, audience in the flag salute. ci ty Staff and COUNCIL ROLL CALL council Present: Deputy Mayor Mary Gates and Councilmembers Jim Handmacher, Lynn Templeton, Joel Marks, Bob Stead and Jim Webster. Excused Absence: Mayor Debra Ertel. City Staff Present: city Manager J. Brent McFall, City Attorney Sandra Driscoll, City Clerk Maureen Swaney and Deputy City Clerk Chris Green. AUDIENCE COMMENT Anqie Hunt, Lakota Junior High student, presented her cultural arts fair exhibit depicting the history of the city of Federal Way; the exhibit will be on display at City HalL Pat Malone, 32004-41st Ave SW, Federal Way, questioned the proposed traffic code and expressed her concern about the banning of bicycles on sidewalks within the City. Andrew Cowan, 32733-30th Ave SW, Federal Way, also expressed concern about the banning of bicycles on sidewalks; he suggested certain sidewalk routes be designated for bicycles. Betty Cowan, 32733-30th Ave SW, Federal Way, further expressed concern about bicyclists and requested certain bicycle paths be designated within the City. Bonnie Wegner, 2318 SW 336th, Federal Way, who manages Twin Lakes Cyclery, expressed her concern about safety of bicycle riders; she feels streets are extremely dangerous, so use of sidewalks or designated paths should be allowed. Dennis Martin, 2013 S 304th, Federal Way, is concerned about costs involved with undergrounding facilities and opposes proposed ordinance. Brian Bernecker, 406 SW 316th, Federal Way, underground proposed ordinance due to costs. Roy Simmons, 35531-6th Ave SW, Federal Way, opposes proposed underground ordinance; he feels road improvements should be a priority; also undergrounding should be put to a vote of the citizens. opposes Gaylon Tevis, 7122 SW 356th, Federal Way, opposes proposed underground ordinance because of cost to individuals, as well as loss of some property for right- of-way. Nancy Weibl, 2005 SW 356th, Federal Way, opposes proposed underground ordinance due to cost. CONSENT AGENDA A. Approval of Minutes B. Councilmember Handmacher pulled Item D from consent agenda for further discussion. Motion by Councilmember Handmacher to approve Item D of the consent agenda; second by Councilmember Templeton. ENACTMENT ORDINANCE Underground Ordinance AN ORDINANCE OF THE CITY OF FEDERAL WAY, WASHINGTON, REGULATING FOR THE GENERAL WELFARE THE CONSTRUCTION OF NEW AND THE CONVERSION OF EXISTING AERIAL ELECTRICAL OR COMMUNICATION FACILITIES UNDERGROUND WITHIN THE CORPORATE LIMITS OF THE CITY; PROVIDING CERTAIN MINIMUM REQUIREMENTS AND PROCEDURES RELATING THERETO; REQUIRING CONNECTIONS AND DISCONNECTIONS OF SERVICE AFFECTED THEREBY AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. Motion by Councilmember Templeton to approve Ordinance No. 91-90 "Underground Facilities"; second by Councilmember Handmacher. Discussion: Specifics of 16th and 356th Street projects were discussed, as well as concerns about senior citizen and hardship housing costs to install underground facilities. There were also questions regarding commercial vs. residential properties. Call for question by Councilmember Templeton. Motion by Councilmember Stead to table the proposed ordinance and refer back to committee; second by Councilmember Marks. Councilmember Webster moved to table the Council vote on the ordinance until the end of the meeting, and requested a legal opinion regarding the suggested amendments by Councilmember Handmacher; second by Councilmember Handmacher. INTRODUCTION ORDINANCE Traffic Code no yes yes AN ORDINANCE OF THE CITY OF FEDERAL WAY, WASHINGTON, ADOPTING A TRAFFIC CODE AND PROVIDING FOR PENALTIES FOR VIOLATIONS. Introduction reading by Deputy Mayor Gates. Motion by Councilmember Marks to refer proposed ordinance back to committee to discuss bicycle regulations; second by Councilmember Stead. VIII. RESOLUTION puget Sound Regional Council A RESOLUTION OF THE CITY OF FEDERAL WAY, WASHINGTON, PROVIDING FOR THE CREATION OF THE REGIONAL PLANNING ORGANIZATION FOR THE CENTRAL PUGET SOUND AREA. FEDERAL WAY CITY COUNCIL MINUTES March 19, 1991 - Page 5 Motion by Counci1member Handmacher to approve Resolution No. 91-53 "Regional Planning Organization"; second by Councilmember Webster. Merit Decision/Franciscan Health Services Land Use Manager Greg Moore made presentation to council by using overhead graphics for illustration. He also introduced Richard Katsman, Vice-President of st. Francis Hospital, who expanded on the presentation. Counci1member Handmacher said it is his understanding that the issue will be placed on the Planning Commission's agenda as it does have merit. The city's concern relates to wetland enhancement or replacement for which city staff will establish the criteria. Motion by Councilmember Handmacher to adopt the merit decision for Franciscan Health Services, and refer the issue to the Planning Commission for placement on their agenda; second by Councilmember Stead. Seattle Center Renovation Bond Issue ci ty Manager McFall reported on the bond issue and explained the City Council has been requested to adopt a position. Motion by Counci1member Webster to forward the City Council recommendation that the bond issue be placed on the ballot for citizen vote, with no recommendation on the issue; second by Councilmember Stead. Councilmember Handmacher expressed concern that a school bond issue might be placed for a vote at the same time as the renovation issue. Amendment to earlier motion proposed by Counci1member Handmacher, to clarify City Council recommendation to FEDERAL WAY CITY COUNCIL MINUTES March 19, 1991 - Page 6 reflect that a renovation bond issue not be placed on the same ballot as any other bond issues within the County; second by Councilmember Templeton. Councilmember Webster accepted the friendly amendment as offered by Councilmember Handmacher. Law Department will draft a letter according to Council's recommendation. Additional motion by Councilmember Marks to table the proposed ordinance to evaluate impact on properties; second by Councilmember Stead. CITY MANAGER REPORT City Manager McFall reported on the recent storm water damage in the city. XII. COUNCIL REPORTS Councilmember Webster reported the next meeting of Parks, Recreation & Human Services will be tomorrow at 7: 30 a.m.. Councilmember Stead reported he attended the National League of cities in New York last week; he will be submitting a written report to Council shortly. Councilmember Marks reported the Arts Commission will be meeting Thursday at 7:30 a.m.. Councilmember Handmacher reported the next meeting of the Planning, Public Works & Transportation Committee will be next Monday at 7:00 p.m.. Deputy Mayor Gates reported there will be a joint meeting between the Administration & Public Safety Committee and the Fire District Commissioners this Thursday at 7: 30 p.m., in the Fire District Offices. XIII. AUDIENCE COMMENT Brian Bernecker, 406 SW 316th, Federal Way, thanked the Council for their amendment to the underground facilities ordinance. Roy Simmons, 35531-6th Ave SW, Federal Way, thanked the Council for their additional consideration and amendment to the underground ordinance. XIV.
