CALL MEETING TO ORDER Mayor Ertel called the Federal Way City council Regular Meeting to order at the hour of 7: 03 p.m., on the 7th day of May, 1991, in council Chambers, city Hall, Federal Way, Washington. II. PLEDGE OF ALLEGIANCE Mayor Ertel introduced the Lakeland Elementary Boy Scout Troop who led the flag salute. III. COUNCIL ROLL CALL council Present: Mayor Debra Ertel, Deputy Mayor Mary Gates and Councilmembers Jim Handmacher, Lynn Templeton, Joel Marks and Bob Stead. Excused Absence: Councilmember Jim Webster. city Staff Present: City Manager J. Brent McFall, City Attorney Sandra Driscoll, City Clerk Maureen Swaney and Deputy City Clerk Chris Green. IV. AUDIENCE COMMENT John Karl, 35620 Pacific Highway South, Federal Way, owner of the Siesta Motel, inquired about "jake" brake restrictions within the city, as he is concerned about excessive truck noise. Lisa Huong, 33330 Pacific Highway South, Federal Way, owner of motel located near New China Restaurant, expressed concern about loud music from the restaurant which is causing her loss of patron business. H. David KaDlan, 30240-27th Avenue South, Federal Way, as a representative of the Community Council, extended an invitation to the City Council and City staff to attend their annual picnic on August 1st. PROCLAMATION "Emergency Medical Services Week" *** May 12-18, 1991 Following the reading, Mayor Ertel introduced Penny Hulse, Federal Way Fire Department Public Education Specialist, and presented the proclamation to her. Ms. Hulse extended an open invitation to attend the Department's Open House on May 15th. VI. CONSENT AGENDA A. B. C. Minutes Approval Voucher Approval Establish Special Session on May 14, 1991 Re: Western Securities Rezone Motion by Councilmember Stead to approve Consent Agenda; second by Deputy Mayor Gates. Criminal Code/prostitution/Amendment to Ord No 91-91 AN ORDINANCE OF THE CITY COUNCIL OF FEDERAL WAY, WASHINGTON, RELATING TO THE CRIMINAL CODE, ADDING DEFINITIONS AND THE ELEMENT OF INTENT TO THE CRIME OF PROSTITUTION, AMENDING FEDERAL WAY ORDINANCE 91-91. Deputy Mayor Gates explained the amendment has been reviewed in the Administration & Public Safety Committee and recommended for adoption by the CounciL City Attorney Driscoll advised that in order to avoid potential challenges, an immediate adoption of the amendment would be beneficial. Motion by Councilmember Stead to suspend rules; second by Deputy Mayor Gates. Fire Lane Violation/Amendment to Ord No 90-61 AN ORDINANCE OF THE CITY OF FEDERAL WAY, WASHINGTON, AMENDING ORDINANCE 90-61, RELATING TO PENALTY PROVISIONS FOR VIOLATION OF FIRE LANE ORDINANCE. City Attorney Driscoll explained the necessity of implementing the amendment as soon as possible, as it changes the violation from a misdemeanor to an infraction. Motion by Deputy Mayor Gates to suspend rules; second by Councilmember Handmacher. CITY MANAGER REPORT Mr. McFall introduced Assistant City Manager Ken Nyberg, who gave a detailed report on the new postal facilities being constructed in the city. He explained the Federal FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES May 7, 1991 - Page 4 Government is not required to abide by city codes, and there is a concern about storm drainage and fire protection systems. Several Counci1members expressed concern about traffic and right-of-way problems, as well as costs incurred for city staff involvement. Mr. Nyberg advised he will have some information available following tonight's meeting, as well as obtaining more complete information prior to the next planning, Public Works & Transportation Committee meeting. Mr. McFall explained the City is attempting to work out problems with postal authorities on a local basis. Mr. McFall requested an executive session for approximately 30 minutes. Councilmember Handmacher suggested council reports and audience comment be allowed prior to the executive session, so the audience could leave if they preferred to do so. A change in the agenda was made. IX. COUNCIL REPORTS Mayor Ertel reported on the Korean Consul General's recent visit to the city. Counci1member Handmacher reported the next Planning, Public Works & Transportation Committee meeting would be held May 13th. He also invited everyone to attend the WSDOT Open House on May 15th at Lakeland Elementary School. Discussion will include widening of SR 161 between Jovita Blvd and So 356th, and improvements from So 356th to SR 18. Councilmember Templeton had nothing to report at this time, however, he extended his appreciation to the Mayor and Counci1members who attended the "Little League" field opening last weekend. Deputy Mayor Gates reported the next meeting of the Administration and Public Safety Committee would be held May 17th; they will be reviewing proposed council rules and regulations and critiquing the city manager evaluation process. She reported she will be attending the AWC nominating committee this Thursday and invited comments and suggestions from other councilmembers. Councilmember Templeton read a letter from the Multi- Service Center regarding its literacy program; they are requesting support letters from the City council. Mayor FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES May 7, 1991 - Page 5 Ertel reported City Manager McFall is drafting a letter to be signed by all Councilmembers, however, it might be more advantageous to have each person send an individual response to the Center. Mr. McFall responded he will have ci ty Staff inquire which method would be more effective. Councilmembers Marks and Stead had nothing to report at this time. Mayor Ertel reported on her recent attendance at the Urban Land Institute; she felt it was extremely beneficial and would like to see the City obtain video tapes and printed materials for a future City Council and city Staff library. She requested appropriate information and catalogues be circulated. There will also be a Lotus software package offered within approximately six months, which could be very helpful to the city. x. AUDIENCE COMMENT H. David KaDlan, 30240-27th Avenue South, Federal Way, expressed his concern about the city's liability with the new postal building, if construction doesn't comply with building requirements within the City. XI. EXECUTIVE SESSION To Discuss Negotiations for Property Acquisition RCW 42.30.1l0(b) Motion by Councilmember Marks to recess the regular meeting and call an executive session; second by councilmember Stead. Motion passed as follows: Handmacher Gates Marks Webster yes Templeton yes Ertel yes Stead excused absence yes yes yes Mayor Ertel recessed the regular meeting at 7:40 p.m., and announced a 5-minute break, followed by a 30-minute executive session which will commence at 7:45 p.m.. Mayor Ertel announced the executive session adjourned at 8: 13 p.m., and reconvened the regular meeting at the hour of 8:14 p.m..
