Council MIN 05-14-1991 Special FEDERAL WAY CITY COUNCIL SPECIAL SESSION MINUTES May 14, 1991 - 7:00 P.M. City Hall - Council Chambers 33530 First Way South Federal Way, Washington WESTERN SECURITIES REZONE Re: Rezone Application No. RZ-90-0001; Vicinity of the Northwest Comer of 1st Avenue South and SW 348th Street, Federal Way, Washington. Mayor Ertel opened the Special Session of the Federal Way City council on the 14th day of May, 1991, at the hour of 7:07 p.m., in council Chambers, City Hall, Federal Way, Washington, for the purpose of continuing deliberations to approve, condition or deny this rezone request. The public hearing on Western Securities rezone request was closed by the City council on February 19,1991, for the purpose of allowing City Staff adequate time to prepare additional drainage and traffic information requested by the City Council. The Mayor announced that no additional public testimony would be taken on this request. Council Present: Mayor Debra Ertel, Deputy Mayor Mary Gates and Councilmembers Jim Handmacher, Lynn Templeton, Joel Marks and Bob Stead. Excused Absence: Jim Webster. Staff Present: city Manager J. Brent McFall, City Attorney Sandra Driscoll, City Clerk Maureen Swaney and Deputy city Clerk Chris Green. Mayor Ertel asked Councilmembers for disclosure of any exparte contact regarding this rezone request. Deputy Mayor Gates and Counci1members Handmacher and Templeton all reported they had received a letter from Joyce Carlson dated May 1,1991, but did not respond. Councilmember Handmacher also reported he had received a phone call last Friday from Wally Costello, Quadrant corporation Senior Vice President, inquiring about storm water. He advised Mr. costello he was unable to discuss the issue. Mayor Ertel and Councilmembers Marks and Stead reported no exparte contact. ORIGINAL FEDERAL WAY CITY COUNCIL SPECIAL SESSION MINUTES May 14, 1991 - Page 2 Senior Planner Greg Fewins presented the city Staff report and Surface Water Manager Cary Roe gave additional surface water overview reports related to Panther Lake and First Avenue drainage areas, and explained how they related to the 14-acre rezone area. City Manager McFall requested a 30-minute executive session, citing pending litigation (RCW 42.30.110(i). Motion by Counci1member Templeton to call an executive session; second by Deputy Mayor Gates. Motion passed as follows: Handmacher Gates Stead Webster yes Templeton yes Ertel yes Marks excused absence yes yes yes Mayor Ertel recessed the special session at 7:28 p.m., and announced the City Council would convene for a 30-minute executive session commencing at 7:30 p.m.. At 8: 00 p.m., Assistant City Manager Ken Nyberg announced the Council was extending its executive session for an additional fifteen minutes. Mayor Ertel announced the executive session adjourned at 8: 15 p.m.. She reconvened the special session at the hour of 8:17 p.m., and called for additional questions or discussion from Counci1members. There being no response, Mayor Ertel requested a 2-minute recess for a brief Council discussion at 8:19 p.m.. At 8:21 p.m., Mayor Ertel reconvened the special session. Motion by Councilmember Stead to adopt each staff recommendation contained in the report to reflect approval of the rezone as recommended by City Staff, and instruct the city Attorney to prepare the necessary ordinance, together with the following additional conditions: 1. On site mitigation sufficient to mitigate all impacts of the development; Off site storm drainage mitigation measures at the maximum level anticipated within the terms of the concomitant agreement; and 2. 3. All other development conditions, and/or obligations, and/or terms as contained in the concomitant agreement attached to the ordinance as Exhibit "A". Second to the motion by Counci1member Marks.
