City Council Chambers - City Hall CALL MEETING TO ORDER Mayor Ertel called the Federal Way City Council regular meeting to order at the hour of 7:05 p.m., on the 4th day of June, 1991, in Council Chambers, city Hall, Federal Way, washington. PLEDGE OF ALLEGIANCE Councilmember Marks led the flag salute. COUNCIL ROLL CALL Council Present: Mayor Debra Ertel, Deputy Mayor Mary Gates and Councilmembers Jim Handmacher, Lynn Templeton, Joel Marks, Bob Stead and Jim Webster. City Staff Present: city Manager J. Brent McFall, City Attorney Sandra Driscoll, city Clerk Maureen Swaney and Deputy city Clerk Chris Green. AUDIENCE COMMENT Initiative & Referendum other subjects Rick Sturaeon, 4700 So 295th Pl, Auburn, spoke in favor of the Camelot Park acquisition; he feels it is an extremely valuable parcel of land for park development. H. David KaDlan, 30440-27th Ave So, Federal Way, spoke in favor of the Camelot Park acquisition; he was a member of the citizen Advisory Committee for the 1989 bond issue. Jullianne Bruce, 33316 Pacific Highway So, Federal Way, owner of Matrixx Dance Club, encouraged parents to attend club functions with their teens in order to observe the club's strict security measures and rules. ORIGINAL FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES June 4, 1991 - Page 2 Bob Wojnicz, 941 SW 296th, Federal Way, spoke in opposition to the hardship dwelling issue; he feels the proposed ordinance is a good idea, but feels it allows for abuse of the zoning code. He suggested the City require neighborhood approval for such requests. Marv Hubbard, 1660 So 333rd, Federal Way, resident of nearby mobile home park, spoke in opposition to Matrixx Dance Club stating teens in attendance are noisy, inconsiderate, loiter and cause traffic problems in area. Mayor Ertel called for specific audience response to the Initiative & Referendum issue. H. David Kanlan, 30240-27th Ave So, Federal Way, indicated he might have reviewed the issue if he had received prior information. Councilmember Marks commented that he doesn't see the issue as being a public outcry, but does feel it is important to be in place when needed. v. CONSENT AGENDA A. B. Approval of Minutes - May 21, 1991 Approval of Voucher Councilmember Templeton made one minor correction to the minutes of May 21, 1991, at page 13, paragraph 4, line 11, by changing "Off-Campus School" to "continuation High School"; correction made. Motion by Councilmember stead to approve Consent Agenda with correction to minutes; second by Councilmember Handmacher. Communications Purchasing Agreement A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, AUTHORIZING AND DIRECTING EXECUTION OF A COOPERATIVE PURCHASING AGREEMENT WITH THE CITY OF FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES June 4, 1991 - Page 3 SEATTLE FOR COMMUNICATIONS EQUIPMENT AND RELATED SERVICES. (City Staff Contact: Sandra Driscoll) Assistant city Manager Ken Nyberg presented the City Staff report on the issue; he stated the emergency structure includes the Fire and Police Departments along with the city and its Public Works Department; he further explained the importance of approving the 800 Mhz trunked radio system since cellular phones are not dependable in emergency situations. Deputy Mayor Gates reported the agreement has been reviewed and recommended for approval by the Administration & Public Safety Committee. Councilmember Webster recommended the Public Works Director's name be deleted and referred to by title only on page 1, item 2, of the agreement. Motion by Councilmember Webster to approve Resolution No. 91-62 "Communications Cooperative Purchasing Agreement" with the recommended deletion; second by Councilmember Marks. Repeal of Underground Facilities Ordinance No. 91-90 (City Staff Contact: Sandra Driscoll) Councilmember Marks explained he did not request a full repeal, but only a portion of the previously adopted ordinance. He withdrew the proposed appeal ordinance from consideration and requested the subsequently drafted proposed amendment to the ordinance be considered at the next regular meeting. VITI. Discussion: Councilmember Handmacher explained this only pertains to the issue of medical hardship, not economical; economical hardships will be considered at a later date. In response to Council questions, Long Range Planning Manager Larry Springer explained the zoning code clearly allows for only one residential structure per lot, and any request for medical hardship will require written documentation from a physician. He further explained there is an appeal process available to citizens. Designated Vehicle Route AN ORDINANCE OF THE CITY OF FEDERAL WAY, WASHINGTON, WHICH RESTRICTS ALL VEHICLES RATED IN EXCESS OF 30,000 POUNDS GROSS WEIGHT TO DESIGNATED VEHICLE ROUTES EXCEPT FOR LOCAL DELIVERIES AND PROVIDES AUTHORITY TO THE PUBLIC WORKS DIRECTOR TO RESTRICT VEHICLES MAKING LOCAL DELIVERIES NUMBERING TEN OR MORE TRIPS PER DAY UNDER CERTAIN CIRCUMSTANCES TO DESIGNATED ROUTES. Amendment to Gambling Tax AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY RELATING TO GAMBLING TAX AMENDING THE DUE DATE AND THE PENALTY SCHEDULE OF THE TAX. (AMENDS ORDINANCE 90-15) (City Staff Contact: Dick scott/Carolyn Lake) Motion by Deputy Mayor Gates to approve Ordinance No. 91- 101 "Amendment to Gambling Tax"; second by Councilmember Templeton. Open Space Acquisition Project: Camelot Park Addition (City Staff Contact: Jennifer Schroder) City Manager McFall explained there is no significant cost or burden to the City at this time nor is there significant travel time required for maintenance of the area. Parks Superintendent Jenny Schroder answered Council questions and explained that city Staff recommends approval of the acquisition. Councilmember Webster explained the city is able to trade the property for other open space, but cannot sell it. Mr. McFall reported property usage is limited to passive activity only, i.e., trails, parking. Motion by Councilmember Webster to authorize the City Manager to approve the option agreement; second by Councilmember Stead. Discussion: Councilmember Handmacher doesn't feel there are any disadvantages to assuming responsibility for the property. Deputy Mayor Gates views the acquisition as an important controlled area through mutual agreement by the County and the city. Approval of Community Development Block Grant Application (Presentation by Helen Middlebrooks, Human Services commission Chair) Human Services Commission Chairperson Helen Middlebrooks presented the project applications. councilmember Webster inquired about availability of King County funding for the Multi-service Center; Management Assistant sheryl Trent explained the center will receive some funds for specific projects from both King County and the City of Auburn. Deputy Mayor Gates asked about availability of transitional housing; Ms. Middlebrooks reported existing motels in the area would be utilized rather than new housing being constructed. Councilmember Handmacher and Mayor Ertel thanked the Commission for their many hours of review and decision making. Councilmember Templeton also thanked city Manager McFall and Finance Director Moir for administering the projects with no direct costs reflected to applicants, especially since King County charges approximately 18% for administration. Ms. Middlebrooks thanked City Staffmembers for making the Commission's job much easier, especially Steve Anderson, Cheri McCabe and Sheryl Trent. Deputy Mayor Gates said the Commission and Police Department have become pro-active and are fulf illing the city's dreams of public and human services by working together. Motion by Councilmember Marks to approve all CDBG applications as recommended by the Human Services Commission; second by Councilmember Handmacher. Councilmember Stead requested the records reflect his vote abstention on the issue, as his wife serves on the Board of Directors for Federal way Youth Services. CITY MANAGER REPORT City Manager McFall thanked the Human Services commission for its dedication and hard work. He reported the City is continuing to work on establishing an early 1991 recycling program. Recently he met with officials of surrounding cities to review concerns and locations for the proposed King county Justice Center. He also gave an updated report on the Post Office Center construction progress. Postal officials are continuing to work with the city to effectively resolve problems with storm water detention systems, building and fire codes, and are expected to work out landscaping and traffic flow issues. Mr. McFall introduced and welcomed the City's new Parks Director Joe stevens. Mr. stevens thanked the City Management Staff for giving him the opportunity to work for the City of Federal Way. XI. COUNCIL REPORTS Deputy Mayor Gates reported the Administration & Public Safety Committee met this morning and made some progress on city Manager evaluation process, but are still working on Council Rules and Procedure; the next meeting is June 28th at 7:00 a.m., to continue work on the same issues. Councilmember Webster announced the Parks, Recreation & Human Services Committee will meet tomorrow at 7:30 a.m., and will be discussing open space, comprehensive plan and street tree ordinance. Councilmember Handmacher reported the Planning, Public Works & Transportation Committee will meet next Monday, June loth at 7:00 p.m.. Discussion at the last meeting included the 6-year transportation and capital improvement programs. Councilmember Templeton sent kudos to the city's Parks Department Staff for construction of the new city sign at old City Hall, and also for their hard work in establishing and operating the department. Mayor Ertel reported on the recent transportation conference she attended in Orlando, Florida and has informational materials available for anyone interested in reviewing it. She felt the conference sessions were extremely interesting and informative. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES June 4, 1991 - Page 9 XII. AUDIENCE COMMENT H. David KaDlan, 30240-27th Ave So, Federal Way, as a representative of the Federal Way Community Council, invited everyone to attend the June 6th meeting at the ESC Conference Room; discussion topics include water shortages, merger and sewer extension on Wests ide. He also invited the city Council and Staff to attend the Council's annual picnic on August 1st. Jack Ross, is opposed to truck traffic being allowed from 348th-356th; he feels they should use I-5 and Pacific Highway for all travel except local deliveries. Councilmember Handmacher explained the proposed ordinance covers those areas and also includes weight restrictions. XllI. EXECUTIVE SESSION To Discuss Negotiations for Pursuant to RCW 42.30.ll0(b) Property Acquisition Mayor Ertel recessed the regular meeting at 8:40 p.m., and announced the Council would convene for a 30-minute executive session to discuss property acquisition. At 9:05 p.m., Assistant City Manager Ken Nyberg announced the Council had requested an additional fifteen minutes. Mayor Ertel announced the executive session adjourned at 9: 16 p.m., with no action taken, and reconvened the regular meeting. XIV. ADJOURNMENT There being no further business to come before the City Council, Mayor Ertel adjourned the regular meeting of the Federal Way City Council at the hour of 9:16 p.m.. Ì1~~ N.
