CALL MEETING TO ORDER Mayor Stead called the Federal Way City Council special session to order at the hour of 7:03 p.m., in Council Chambers, City Hall, Federal Way, Washington. Council Present: Mayor Bob Stead, Deputy Mayor Joel Marks and Councilmembers Ron Gintz, Lynn Templeton, Skip Priest. Excused Absence: Councilmembers Mary Gates, Ray Tomlinson. City Staff Present: City Manager J. Brent McFall, Assistant City Attorney Londi Lindell, City Clerk Maureen Swaney, Deputy City Clerk Chris Green. II. Council Bill #21 - Restricting Fireworks Discharge AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, AMENDING ORDINANCE NO. 90-54 OF THE CITY OF FEDERAL WAY, TO REDUCE THE DATES AND TIMES THAT COMMON FIREWORKS MAYBE DISCHARGED WITHIN THE CITY UMITS (AMENDS ORDINANCE NOS. 90-54, 90-60 AND 92-138) City Manager McFall explained this ordinance restricts fireworks discharge to specific hours on July 4th only. Mayor Stead read Councilmember Tomlinson's statement supporting the fireworks ban. Councilmember Gintz moved to amend the ordinance to extend discharge of fireworks to midnight on the 4th; second by Councilmember Templeton for purposes of discussion. Councilmember Gintz said he prefers extending discharge time to midnight due to late sunset not allowing adequate time for families to enjoy fireworks. Motion to amend proposed ordinance to extend discharge hours failed as follows: Stead Gintz Priest Tomlinson no yes no excused absence Marks Templeton Gates no yes excused absence Motion by Councilmember Priest to approve the proposed ordinance restricting fireworks discharge to specific date and time; second by Deputy Mayor Marks. Mayor Stead proposed a friendly amendment to limit the restriction to "the year 1992 only"; Councilmember Priest and Deputy Mayor Marks concurred with the Mayor's friendly amendment. FEDERAL WAY CITY COUNCIL SPECIAL SESSION MINUTES June 23, 1992 - Page 3 Motion to approve Ordiaance No. 92-146 "Restricting Fireworks Discharge for Year 1992" passed as follows: Stead Gintz Priest Tomlinson b. yes yes yes excused absence Marks Templeton Gates yes yes excused absence Council Bill #22 - Banning Fireworks Effective 6/28/93 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DECLARING THE SALE, HANDUNG, DISCHARGE AND DISPLAY OF FIREWORKS TO BE UNLAWFUL WITHIN THE CITY UMITS, WITH CERTAIN EXCEPTIONS, EFFECTIVE JUNE 26, 1993 (AMENDS ORDINANCE NOS. 90-54, 90-60 AND 92-138). Mr. McFall explained this proposed ordinance bans the sale and discharge of fll'eworks effective June 26, 1993. In order to comply with State requirements, ordinance adoption is required one year in advance. Councilmember Priest moved to suspend rules and place ordinance for a vote at this time; second by Deputy Mayor Marks. Motion passed as follows: S tead Gintz Priest Tomlinson yes yes yes excused absence Marks Templeton Gates yes yes excused absence Motion by Councilmember Priest to adopt proposed ordinance for 1993 fireworks ban; second by Deputy Mayor Marks. . Deputy Mayor Marks said he would like to see future City-sponsored fireworks displays; he feels a ban is crucial to public health and safety. Councilmember Templeton said he has worked with youth groups for the past 23 years and one of their past fund raisers included the sale of fireworks, however, in recent years the group has foregone such sales because of the safety issue; he fully supports the ban. Councilmember Priest reported he has spoken to approximately 200 citizens who fully support banning fireworks; he feels a ban is in the City's best interest, but agrees a public display is important, Le., celebrating Fourth of July and Family Fest simultaneously. Councilmember Gintz feels citizens should have FEDERAL WAY CITY COUNCIL SPECIAL SESSION MINUTES June 23, 1992 - Page 4 the right to choose; he feels the police and fire departments should provide safety control, with violators being punished. Mayor Stead said if people acted in a responsible fashion there wouldn't be a need for control; he supports a complete ban. CITY/SCHOOL DISTRICT PARK INTERLOCAL a. Financing/Funding Finance Director Deborah Larson presented staff recommendations, and responded to earlier Council requests. Campus Drive Park/Junior High School Site No.6 b. Parks Director Joe Stevens gave a brief slide presentation of the proposed site, and answered Councilmember questions. He also called on School District Assistant Superintendent Donn Fountain to furnish additional information. Concerns included the prioritizing of other park projects and financial commitments. The majority of Councilmembers feel it is beneficial for the City to enter into joint ventures with the School District, and agree there is a definite need for additional City parks. Financially, it would be desirable to locate parks and schools on adjoining City/District properties. Mr. Fountain suggested informational joint meetings between the City Council and School Board, so questions and concerns can be thoroughly addressed. Motion by Councilmember Templeton to authorize the City Manager to sign the park interlocal agreement between City and School District; second by Councilmember Priest. Councilmember Templeton requested a report from Parks Department Staff regarding the impact on parks recreational programs following the School District's decision to establish year-round usage of school facilities.
