I.
CALL MEETING TO ORDER
Mayor Robert Stead called the meeting to order at the hour of 7:00 p.m., in Council Chambers,
Federal Way City Hall, 33530 First Way South, Federal Way, Washington, on the 4th day of
August, 1992. Council members present: Deputy Mayor Joel Marks and Councilmembers Ray
Tomlinson, Mary Gates, Ron Gintz, Lynn Templeton and Skip Priest. Staff present: J. Brent
McFall, City Manager, Carolyn Lake, Acting City Attorney, and Maureen Swaney, City Clerk.
II.
PLEDGE OF ALLEGIANCE
The Council led the audience in the flag salute.
III.
PRESENTATION
The SPIRIT Award for Month of August was presented to Martin Nordby, Code Compliance
Officer.
IV.
CITIZEN COMMENT
John Kar135620 Pacific Highway South, Federal Way, said he saw a King County/Federal Way
police car in Puyallup and expressed concern because he had been mailed tlITee (3) EIS
statements in three (3) separate envelopes.
Barbara Gardner, 309 S.W. 321st Street, Federal Way, commented for her husband, Rick
Gardner, on traffic improvements, sign ordinance and Community Council events.
Gerald Norton, 408 S.W. 327th Place, Federal Way, commented on traffic studies and
associated costs.
Norman Ingersol, 3515 South 312th Place, Auburn, formally introduced the Military Road
Safety Committee.

Council Bill #23 - Enactment Ordinance
AN ORDINANCE OF THE CITY OF FEDERAL WAY, WASHINGTON,
AUTIlORlZING VEHlCLE REPAIR AND VEHlCLE PAINTING RETAIN
FACILITIES WITHIN COMMUNITY BUSINESS (Be) ZONES AND
MANUFACTURING PARK (MP) ZONES BY ADDING NEW FEDERAL WAY
ZONING CODE SECTIONS 45.100 AND 65.60
Greg McCormick reviewed this ordinance and the substitute ordinance submitted by the Land
Use Committee. The Land Use Committee version required Process II for both MP and BC
whereas the Planning Commission recommendation was Process I for MP and Process II for BC.
Councilmember Templeton moved to approve the substitute ordinance; Second by Skip Priest.
Councilmember Templeton urged approval in order to allow additional notice provisions to
adjacent property owners. Councilmember Priest said he would be opposed to the substitute
ordinance and supported the Planning Commission recommendation; he said the only primary
difference is notice but the cost factor between Process I and Process II could adversely affect
a small business.
There was discussion on permit fee costs and whether or not the City recovered their costs.
Councilmember Tomlinson thanked Mr. McCormick for submitting a good staff report.
Councilmember Templeton said, in defense of Process II in MP Zones, that notification is very
important as is the experience of the hearings examiner.

Mayor Stead said he was not concerned if MP Zones were Process I or II, but since the hearings
examiner is from out of town, the Council needs to have the opportunity to make a finding in
order to overturn the hearings examiner's decision on BC Zones, since the Council knows the
needs of the community; BC Zones west of Highway 99 are of concern, and a Process ill might
be appropriate.
Councilmember Gates said she would agree to MP Zones being Process II and BC Zones as
Process ill.
Mayor Stead said he wouldn't object to MP Zones being Process I; Councilmember Gates said
she would have concerns with that recommendation.

PUBLIC HEARING
Councilmember Templeton excused himself from the meeting.
TRANSPORTATION IMPROVEMENT PLAN

Staff Presentation
Tim Miller, Trafflc Engineer, reviewed the staff report that had been a part of the Council
packet. Philip Keightley informed the Council on street resurfacing timing and options.
The Council recessed at 8:17 p.m. until 8:27 p.m. Councilmember Templeton returned to the
meeting.

Citizen Comment
Prior to hearing citizen comments on the Transportation Improvement Plan, Janella Hooper,
28617 26th Avenue S, Federal Way, told the Council it was time to help the handicapped
citizens live a better life in this community.
Ed Lyons, 2671 SW 334th Place, Federal Way, commented on I-5 interchanges.
Jeff Horne, 3513 S 312th Place, Auburn, representing the Military Road Safety Committee, said
he would support the comments to be made by Mr. Ingersol.
Marianne Leslie, 104 S 296th Place, Federal Way, expressed concern over the speed limit on
1st Avenue, from S 30lst to S 296th; she opposed the opening of the Redondo Road access
because it creates additional traffic in her area.
Norman Ingersol, 3515 S 312th Place, Auburn, representing Military Road Safety Committee,
asked the Council to recognize that Military Road is a serious safety issue.
Bob Roper, 525 SW 312th Street, Federal Way, asked that a project on 312th between 1st
Avenue and Dash Point Road be considered as high as it was by King County prior to
incorporation; he urged it be added to the list.

Resolution/City Council Deliberation
Motion to approve the TIP Resolution by Councilmember Templeton; Second by Councilmember
Gintz. Councilmember Templeton said he would like to see the SW 312th project back on the
list, and would like to see mention of another 1-5 exit ramp between 288th and 320th, and to add
4th Avenue S between 312th and 316th to list as well as the "Jack in the Box" intersection at
312th and Highway 99. Council member Tomlinson agreed with this recommendation. Deputy
Mayor Marks and Councilmember Gates agreed with the 312th1Dash Point Road project
recommendation from Mr. Roper. Mr. Keightley said that this improvement was on the list but
in separate sections.
Motion to amend the TIP Resolution by Councilmember Templeton, that 4th Avenue S, between
312th and 316th, be added to the TIP list, in the project sum of $100,000, and scheduled for no
later than 1994; Second by Deputy Mayor Marks. Councilmember Priest said he would support
this amendment because the amount was reasonable and it gave staff ample time to review.
Councilmember Gintz said that government should do transportation projects and that funding
should be appropriated as this is a good expenditure of public funds; he said he would like to
review this list again and consider the placement of Military Road. Mayor Stead said he was
supportive and said that a Comprehensive Traffic Plan may reshuffle priorities. The amendment

Councilmember Tomlinson reminded the Military Road Safety Committee people of the
opportunity to attend the Public Safety Committee meetings. Mr. Keightley told Deputy Mayor
Marks that the costs on the TIP list did not include any potential undergrounding options.

INTRODUCTION ORDINANCE
Council Bill #24 - PBX/Emergency Communications System
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, REQUlRING PRIVATE BRANCH EXCHANGE (pBX)
TELEPHONE SYSTEMS TO INTERFACE WITH AND PROVIDE
ACCURATE INFORMATION TO THE ENHANCED 911 EMERGENCY
COMMUNICATIONS SYSTEM, AND REQUlRING NEW CONSTRUCTION
TO BE IN COMPUANCE AS OF JAN 1, 1993, AND REQUlRING EXISTING
FACILITIES TO COMPLY BY JAN 1, 1997.
This item was referred to the Public Safety Committee to consider King County amendments.
Councilmember Templeton said he was opposed to referring this item because he was satisfied
with the current proposal.

WAY, WASHINGTON, PROVIDING FOR THE ACQUlSITION OF THE
FINANCIAL CENTER BUILDING FOR USE AS CITY OFFICE SPACE BY
MEANS OF A LEASE WITH OPTION TO PURCHASE; AUTHORlZ1NG
EXECUTION OF SUCH LEASE AND RELATED DOCUMENTS, AND
APPROVING THE FINANCIAL PLAN FOR SUCH TRANSACTION.

Deborah Larson, Finance Director, reviewed the bond sale materials. She said the Moody's
rating was still an A, but an upgrade might be considered with the next issue. Councilmember
Gintz said he was hesitant to spend the $20,000 when GO Bonds would be cheaper even though
it may reduce the debt capacity. Ms. Larson introduced Bond Consultants Susan Musselman and
David Thompson. Discussion continued on the feasibility of just borrowing the money from a
local bank to purchase the building.
Motion to suspend the rules and pass the ordinance at one reading by Councilmember
Templeton; Second by Councilmember Gates.
Prior to voting, Councilmember Priest said that the City needed to go ahead with the purchase
as recommended.

Council Representation at National League of Cities Conference
Mayor Stead asked that this item be deferred and discussed at the upcoming City Council retreat.
c.
Bid Award - 1992 Asphalt Overlay Project
Ken Miller, Street Systems Manager, reviewed the bids received and recommended the Council
approve the low bid from Woodworth Company. Mayor Stead asked that the overlay bids be
done earlier next year. Councilmember Gates said maybe by going to bid later in the season
would give the City lower bids.
Motion by Councilmember Gates to approve the bid result and recommendation to award
contract to Woodworth Company; Second by Councilmember Marks. Councilmember
Templeton said he would abstain because he had a professional relationship with Jeff Woodworth
who was on his board of directors. Motion passed as follows:

CITY MANAGER REPORT
Mr. McFall reviewed the Preliminary agenda, the upcoming council retreat and need for a 15-
minute executive session.

CITY COUNCIL REPORTS
Councilmember Templeton reported on the Land Use Committee.
Councilmember Gintz announced the date and time of the fIrst Public Safety Committee meeting.
Deputy Mayor Marks said he had attended an Economic Development Council for Seattle/King
County.
Councilmember Tomlinson announced the upcoming Administration Committee meeting.
Mayor Stead informed the Council about a recent Summit group meeting he had attended; it is
hoped there will be a ballot measure in November regarding the King County/Metro merger.
The Mayor invited everyone to the Pioneer Blueberry Festival, on August 22, 1992, from noon
to 5:00 p.m., at Brooklake.

Councilmember Gintz said he attended the Regional Justice Center meeting last night and there
is a need for a local chairperson to make the voters aware of the need and requested someone
volunteer to serve in this capacity.
The meeting recessed at 10:01 p.m. to executive session.
