SPECIAL SESSION MINUTES

CALL MEETING TO ORDER
Mayor Stead called the Federal Way city council special
session to order at the hour of 6:04 p.m., on the 11th
day of February, 1992, in council Chambers, city Hall,
Federal Way, Washington.
Mayor Stead requested the records reflect Councilmembers
Tomlinson, Gates, Marks, Gintz, Templeton and Priest were
all in attendance. city Staff present were city Manager
J. Brent McFall, Acting City Attorney Carolyn Lake and
Deputy city Clerk Chris Green.

Councilmember Gintz led the flag salute.

LIBRARY MAGAZINE ISSUE
Citizen Comment
Tammy Tavares, 34409-30th Ave SW, Federal Way, submitted
citizen petition to maintain "Playboy" magazine copies
behind library counter and thanked the Council for
scheduling special session to address the issue.
Brian Bernecker, 406 SW 3l6th st, Federal Way, concurred
with Tammy Tavares in requesting the magazine be kept
behind library counter and away from children access.
John Metoal~, 3l908-3rd Lane SW, #M-203, Federal Way,
opposes resolution as he feels it is no longer an issue.
ADn Bernecker, 406 SW 3l6th st, Federal Way, spoke in
favor of the proposed resolution and feels it reflects
the City Council cares about Federal Way citizens.
Rachael Elkinaton, 2416 SW 330th st, Federal Way,
representing young children, spoke in favor of the
resolution and feels the magazine should be placed behind
the library counter.

Resolution/Council Discussion
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, URGING THE KING COUNTY LIBRARY BOARD TO
ADOPT A POLICY ON THE PLACEMENT OF PLAYBOY MAGAZINES
WHICH BALANCES THE ABILITY OF LIBRARY USERS TO ENJOY FREE
ACCESSIBILITY TO DIVERSE TYPES OF MATERIALS WITH
CONSIDERATION FOR THE SPECIAL SENSITIVITIES OF YOUNG
LIBRARY USERS.
At 6:15 p.m., Councilmember Gates excused herself from
Council Chambers, as her husband is Library Board
Chairman. She announced she will return to Chambers
following discussion and vote on the resolution, and
prior to the study session being convened.
Mayor Stead read the proposed resolution.
Motion by councilmember Gintz to approve
resolution; second by councilmember Priest.

Deputy Mayor Marks moved to amend last paragraph of the
resolution to delete "bej aßà the E'eaeh at ) atilt!) ehilàE'C!ß"
and insert "behind the counter"; second by Councilmember
Gintz. .
Deputy Mayor Marks said the resolution is non-binding,
but feels it sends a message to the King County Library
Board that the city is responsive to its citizens'
concerns.
councilmember Gintz also urged passage of the resolution,
especially in light of the petition signed by some 2,000
citizens. He also feels the City Council needs to be
sensitive to community requests and concerns.
Councilmember Templeton feels the magazine belongs behind
the counter at the library, but doesn't want to send a
directive to another authority. He read his statement to
council asking them to reconsider adoption of the
resolution and not step outside their roles as City
Councilmembers. He supports the resolution content, but
will abstain from voting on the issue.
Councilmember Tomlinson said the Council has taken
earlier positions on various County issues, so doesn't
feel there is a problem now.

Councilmember Priest said he has no reservations in
approving the resolution, but opposes the proposed
amendment.
Mayor stead announced he will abstain from voting on the
resolution, as he feels it is inappropriate to interfere
with or criticize other organizations and their policies.
