MINUTES
I.
CALL MEETING TO ORDER
Mayor Stead called the Federal Way city Council regular
meeting to order at the hour of 7:03 p.m., in council
Chambers, City Hall, Federal Way, Washington.
Council Present: Mayor Robert Stead, Deputy Mayor Joel
Marks and Councilmembers Ray Tomlinson, Mary Gates, Ron
Gintz, Lynn Templeton and Mahlon Priest.
City Staff Present: City Manager J. Brent McFall, Acting
City Attorney Carolyn Lake, city Clerk Maureen Swaney and
Deputy City Clerk Chris Green.
II.
PLEDGE OF ALLEGIANCE
CUb Scout Pack 362 presented a brief explanation of the
"Pledge of Allegiance" followed by the flag salute. Pack
Leader Bruce Honda awarded a special badge to CUb Scout
Worthington.
III.
PROCLAMATION
Mayor Stead presented the "CUb Scout Pack 362 Blue & Gold
Day" proclamation to Pack Leader Bruce Honda, and thanked
the scouts for their attendance and participation.
IV.
CITIZEN COMMENT
James Murohv, 1031 SW 350th, Federal Way, representing
Meadowbrook Homeowners, spoke in opposition to the
proposed shopping center at 1st Ave So & 348th st.
Suzanne Reeder, 1217 SW 353rd st, Federal Way,
representing Madrona Woods Homeowners, spoke in
opposition to the same proposed shopping center.

Dennis Bill, 607 SW 331st st, Federal Way, representing
Ridge Homeowners, also spoke in opposition to the
proposed shopping center.
Michael conn, 34526-5th Pl SW, Federal Way, representing
Campus Estates, also opposes the proposed shopping
center.
Kathv stablain, 1107 SW 334th Pl, Federal Way, President
of Barkley Place Homeowners, spoke in opposition to the
proposed shopping center.
Alma Reaan, 34436-8th Pl SW, Federal Way, delivered
petition in opposition to the proposed shopping center;
she feels the City should purchase the property for a
future park.
Oliver Middlebrooks, 4265 SW 337th Pl, Federal Way, is
opposed to city Council censorship of library magazines.
Marge Nelson, 32904-4th Ave SW, Federal Way, opposes the
resolution to censor library magazines; she also called
for Council support of HB 2805 (elected officials
financial reporting).
Fred PeDDer, 2409 SW 331st, Federal Way, asked Mayor
Stead to read his statement endorsing the proposed
bigotry resolution; he feels citizens must learn to
communicate and celebrate differences.

STRENGTHENING OF HUMAN RELATIONS.

Councilmember Gintz asked for an explanation of multiple
annual dues beinq paid to various orqanizations for City
staff memberships, and inquired if it is possible to
share information and save duplication of dues. city
Manaqer McFall said multiple dues are important in
maintaininq hiqh quality staff, however, the status of
those membership dues will be reviewed as requested.
Councilmember Templeton said membership dues have already
been approved throuqh the budqet¡ he feels any inquiry
should be addressed durinq a study session.
Councilmember Tomlinson inquired about costs affiliated
with a snow and ice conference listed on the voucher.
Mr. McFall explained it was for emerqency traininq for
staff in the event of increment weather conditions.
Motion by Deputy Mayor Marks to approve Item (b) of

PUBLIC HEARINGS

Bellacarino Woods Preliminary Plat
Consideration of Hearinq Examiner Recommendation
Consideration of Challenge of Hearing Examiner
Recommendation
Mayor stead opened the public hearing on Bellacarino
Woods at the hour of 7:33 p.m., and read a prepared
statement for the application and challenge format.
Councilmembers reported no ex parte contact.
City staff Senior Planner Stephen Clifton and Senior
Development Enqineer Ron Garrow presented a summary of
the recommendation and challenge issues to the
Councilmembers.

James Thode, 354l4-6th Ave SW, Federal Way, presented a
summary of his challenge to the Hearing Examiner's
recommendation, reserving three (3) minutes for response.
Greg Newhall, on behalf of Applicant Newhall Jones Inc.,
12515 Bel-Red Road, Bellevue, responded to the challenge.
Mr. Thode chose to not respond.
Councilmember Tomlinson moved to approve the plat as
recommended by City Staff, which denies the challenge and
approves the Hearing Examiner's recommendation; second by
Deputy Mayor Marks.
Councilmember Templeton explained the plat was one
inherited from King County and read a statement conveying
his feelings. councilmember Gintz read his statement in
favor of approving the preliminary plat, and called for
the question.
There being no further comment, Mayor Stead closed the
public hearing at 8:09 p.m..
Motion to approve RESOLUTION NO. 12-17 "Bellacarino Woods
Preliminary Plat With Conditions", in accordance with
city Staff recommendation, passed as follows:

At 8:10 p.m., Mayor Stead called a 5-minute recess; he
reconvened the regular meeting at 8:15 p.m..
Weyerhaeuser Plat Vacation
b.
Mayor Stead opened the public hearing on Weyerhaeuser
Plat Vacation at 8:15 p.m..
Associate Planner Mike Thomas presented the staff report.
In response to Council questions regarding the amount of
compensation to be paid to the city, Mr. McFall explained
the price will be based on the MAl appraisal.
There being no further comment, Mayor Stead closed the
public hearing at the hour of 8:24 p.m..

proceed with plat vacation requirements and to later
propose an ordinance for Council approval; second by

VII.
CITY MANAGER REPORT
Mr. McFall called on Public Works Director Philip
Keightley, who distributed copies of the proposed policy
plan and presented an updated Growth Management Planning
Council report to Councilmembers.
city Manager McFall reported the Finance Department
recently received the GFOA "Certificate of Achievement"
for excellence in financial reporting for the city's
first accounting. A formal Mayoral acceptance will be
scheduled following receipt of the award.
He thanked Councilmembers and citizens for their efforts
in successfully defending a 30-day extension request for
airport's proposed third runway draft EIS.
He announced the Cedar Cove appeal has been withdrawn.
Mr. McFall reminded Councilmembers of the special study
session on Monday, February 24th, for review of the
interim community center and recreational programs. The
study session on Tuesday, February 25th will include
review of (1) long range fire plan, and (2) street
maintenance contract with King county.
Following a brief discussion of study session starting
times, Mayor Stead announced the February 24th meeting
would convene at 7:00 p.m..
city Manager McFall requested a 30-minute executive
session prior to adjournment of the meeting for purposes
of discussing litigation and property acquisition.

VIII.
CITY COUNCIL REPORTS
councilmember Gates reported on recent joint regional
planning sessions, which involves participants from
Snohomish, King and Pierce Counties.
Councilmembers Tomlinson and Templeton inquired about
status of the City's new recycling program. They feel
citizen awareness should be expanded.
Deputy Mayor Marks, Chair of the Council contracting
Committee, reported on their first meeting; the committee
also includes Mayor Stead and Councilmember Priest.
Committee members, City Manager McFall and Assistant City
Manager Anderson will be visiting several Southern
California cities next month to review their contracting
services.
Mayor stead expressed his preference
meetings at the hour of 7:00 p.m..
He feels current priorities include growth management
issues and wetland/zoning legislation. certain proposed
legislative bills provide for a cause of action against
cities and counties, in the event property values have
been reduced by rezoning within the past ten years. He
encouraged each Councilmember to individually contact
local representatives.

Councilmember Gintz reported on his attendance at the
Human Services Roundtable.
Mayor Stead and Deputy Mayor Marks both presented
testimony at last week's public hearing on the proposed
third runway.
IX.
EXECUTIVE SESSION
To discuss property acquisition pursuant to
RCW 42.30.ll0(b) & litigation pursuant to
RCW 42.30.ll0(i)
Mayor Stead recessed the regular meeting at 9:05 p.m.,
and announced the Council would convene for a 30-minute
executive session to discuss property acquisition and
litigation. He announced no business would be conducted
following adjournment of the executive session.

At 9:35 p.m., the executive session was extended for an
additional thirty minutes.
Mayor Stead announced the executive session adjourned at
10:05 p.m., with no action taken, and reconvened the
regular meeting.

ADJOURNMENT
There being no further business to come before the
Council, Mayor Stead adjourned the regular meeting of the
Federal Way City Council at the hour of 10:05 p.m..
