Council MIN 03-24-1992 Special City Council Special Session March 24, 1992 7:00P.M. 1. CALL MEETING TO ORDER Mayor Robert Stead called a Special Session of the Federal Way City Council to order at the hour of 7:05 p.m., on the 24th day of March, 1992, in Council Chambers, Federal Way City Hall, 33530 First Way South, Federal Way, Washington. Councilmembers present: Ray Tomlinson, Mary Gates, Deputy Mayor Joel Marks, Ron Gintz and Skip Priest. Councilmembers absent: Lynn Templeton (excused absence). Staff present: J. Brent McFall, City Manager; Carolyn Lake, Acting City Attorney, and Maureen Swaney, City Clerk. ll. PLEDGE OF ALLEGIANCE Federal Way Boy Scout Troop 336 led the flag salute. lli. CITIZEN COMMENT Mark Freitas, 32032 2nd Avenue SW, Federal Way, Washington, told the Council that Federal Way does not need Matrixx and he urged the Council to give the staff the leeway and responsibility to handle and solve thi~ situation. Gay Palmgren, 33310 Pacific Highway S, Federal Way, Washington, had signed up to speak but was not present during this part of the agenda. Ronald Johnson, 312th and Pacific Highway, Federal Way, Washington, said the Pacific Northwest and Federal Way needs Matrixx. He alleged Federal Way was showing discrimination; incidents can happen anywhere. He urged the City Council and the police department to work with Matrixx. Jullianne Bruce, 33310 Pacific Highway S, Federal Way, Washington, introduced herself as the manager and owner of Matrixx. She told the Council that every Tuesday night is Christian Night at the club - only Christian music is played and it is proving popular for everyone in the northwest. She said her head security guard teaches self-defense classes to the Tacoma Police Department and is an ordained minister. She expressed concern that the police department directs a lot of police resources to the mall cruising situation, but they won't expend the same for Matrixx. Ms. Bruce said her security people work extremely well with the sworn officers; the officers gave compliments on the professionalism of each of her security guards relating to their actions after the Sunday morning situation. She continued by saying she was sick and tired of being blamed for creating a nuisance and she needs the City Council cooperation; she invited the Council to come and seethe club. Ms. Bruce urged the City Council to put their time and money into Matrixx because the club has national recognition; it is common and frequent for ORIGINAL City Council Special Session March 24, 1992 - Page 2 New York record companies to call her club trying to reach local music groups who play at the club. Milt C. Scheerer, 29300 11th Place S, Federal Way, Washington, reminded the Council that the proposed Alaska Airline maintenance facility, proposed at SeaTac, would bring in airplanes from their entire system and would create noise in Federal Way. Mayor Stead responded to previous audience comments that staff will be preparing an ordinance and/or recommendation on the dance club issue; this item will be on the April 7, 1992 City Council meeting agenda. He said the City Council will look at the recommendation very carefully so as to uphold the law and the constitutional rights of everyone. He said the Council will do what is reasonable under the circumstances at this time. He told Mr. Scheerer that the Council will take his Alaska Airlines comments into consideration. IV. APPOINTMENT OF HEARING EXAMINER Milt C. Scheerer, 29300 11th Place S, Federal Way, Washington, suggested that since six (6) applicants had applied for the position, with five (S) meeting the qualifications, that the Council continue the selection process and make a choice based on cost factors. Mr. McFall briefly reviewed the staff recommendation which had been presented to the Council, at the March 23, 1992 study session. Deputy Mayor Marks moved to accept the staff recommendation on the selection and appointment of the Hearing Examiner; Second by Councilmember Tomlinson. Mayor Stead said that the Hearing Examiner is a sensitive area and he would be very uncomfortable getting the cheapest person; it is important to select based on the established criteria without price consideration. Mayor Stead said he would want the best Hearing Examiner in the marketplace. Councilmember Gintz said that since five (S) applicants were qualified, that price could be a valid consideration. He said he hoped another selection method will be used in the future because this process made him uncomfortable; he urged more Council involvement in the selection process. Councilmember Tomlinson felt the recommendation had merit due to the price reduction offered because city staff would be used instead of staff employed by the Hearing Examiner.
