Council MIN 03-24-1992 Special Study City Council Study Session March 24, 1992 1. CALL MEETING TO ORDER Mayor Robert Stead called a City Council Study Session to order at the hour of 7:27 p.m., on the 24th day of March, 1992, in Council Chambers, Federal Way City Hall, 33530 First Way South, Federal Way, Washington. Councilmembers present: Ray Tomlinson, Mary Gates, Deputy Mayor Joel Marks, Ron Gintz and Skip Priest. Councilmembers absent: Lynn Templeton (excused). Staffpresent: J. Brent McFall, City Manager; Carolyn Lake, Acting City Attorney, and Maureen Swaney, City Clerk. ll. CITY IMPROVEMENT PLAN (CAPITAL F ACIUTIES PLAN) Larry Springer, Planning Manager, introduced Greg McCormick, Senior Planner, who reviewed the interim capital facilities plan; the plan had been approved by the Planning Commission. The Council said they would appreciate up-to-date figures and refinement; the plan had been completed several months ago and was not current. The Council was reminded this plan is only preliminary. lli. TRANSCRIPT ZONING CODE REVISION Mr. McCormick reviewed the recommended change to the zoning code to require payment for transcripts in appeals of hearing examiner decisions. The Planning Commission recommended ordinance does not assign a cost to appellant; the staff recommended ordinance assigns the cost to appellant. The Council asked that the ordinance be amended to include the option for appellant to obtain tape recording and be responsible for their own transcript and associated costs, or, if appellant purchased transcript and prevailed in the appeal, a refund of costs be given to successor. Mr. McFall asked what constituted a successful appeal and Mayor Stead said the Council would make findings. IV. RIGHT-OF-WAY ACTIVITY PERMIT Philip Keightley, Public Works Director, summarized this proposed permit process. Carolyn Lake explained the legal needs. Maureen Swaney reviewed insurance options, block party definitions and programs in other area jurisdictions. Councilmember Tomlinson asked to have information on whether a citizen, without insurance, could pay a premium to the city and use the city's insurance. Police Lt. Brent Bedell reviewed police concerns and Fire Chief Rick Nedrow did the same for the Fire Department. The Council asked about past history of injuries occurring during an activity when no insurance was in effect for said activity. This item will be on the April 7, 1992 City Council agenda. ORIGINAL City Council Study Session March 224, 1992 - Page 2 v. PRIVATE STREETS Ms. Lake gave an overview of the definition of private streets. Messrs. Keightley, Beden and Nedrow reviewed concerns with municipal services on gated areas. VI. INmA TIVE AND REFERENDUM Ms. Lake reviewed the statutory requirements on initiative and referendum powers. In response to Council question, she will provide them information on how to repeal these powers once they are enacted. The Council asked that this issue be scheduled for a study session to review a proposed ordinance. Vll. MISCELLANEOUS Mr. Keight1ey told the Council that two city projects received high ratings for TIA funding; the most important is the widening of South 348th near 1-5. H. David Kaplan responded to the Council on a question asked earlier relating to Parks. Mayor Stead reminded the Council that there is no meeting scheduled until April 7, 1992. Vlli.
