CALL MEETING TO ORDER
Mayor Robert Stead called a Federal Way City Council Special Session meeting to order, at the
hour of 6:03 p.m., in Council Chambers, Federal Way City Hall, 33530 First Way South,
Federal Way, Washington. Councilmembers present: Deputy Mayor Joel Marks, Ray
Tomlinson, Mary Gates, Ron Gintz, Lynn Templeton and Skip Priest. Staff present: J. Brent
McFall, City Manager; Carolyn Lake, Acting City Attorney, and Maureen Swaney, City Clerk.

The Council led the audience in the flag salute.

DANCE HALL ORDINANCE
Ms. Lake gave a brief overview of the proposed ordinance and referred to an ordinance draft,
dated this date, which had been circulated to Councilmembers. Discussion continued on
insurance requirements, noise, security and land use issues.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, PROVIDING FOR THE LICENSING AND
REGULATIONS OF PUBLIC DANCES AND DANCE HALLS,
ESTABLISHING LICENSING REQUIREMENTS, PENALTIES,
ESTABLISHING GROUNDS FOR REVOCATION OF LICENSES AND
ESTABLISHING AN EFFECTIVE DATE.
Councilmember Templeton moved to adopt the ordinance, dated April 14, 1992, as presented
by the Acting City Attorney with the removal of the runaway minor finding on page 1; Second
by Councilmember Tomlinson.
Deputy Mayor Marks moved to amend the proposed ordinance by striking the insurance
requirement on page 5; Second by Mayor Stead. Mayor Stead he concurred with Deputy Mayor
Marks that the insurance provision is a policy issue; to require this insurance provision allows
government to interject itself into private enterprise, however, it is foolish for businesses not to
have liability coverage.
Councilmember Tomlinson said he has not seen proof of the coverage which Ms. Bruce indicates
she has obtained; even if the policy is in force, it can lapse; the City of Federal Way needs to
protect its youth; requiring insurance is prudent for both the business and the City Council.
Councilmember Templeton asked Ms. Lake to inform the Councilmembers on the pros and cons

of this insurance requirement.
Councilmember Priest said he supported, with reservations, Councilmember Tomlinson's
position because this subject is a public safety issue and the requirement contains a sense of
reasonableness and will protect the youth of the community.
Deputy Mayor Marks said he believes that Ms. Bruce does, in fact, have adequate insurance
coverage and if the City of Federal Way requires said coverage then it should extend that
requirement to other businesses.
Councilmember Gates said she would support the amendment, but did encourage the business
to maintain the insurance.

Councilmember Templeton moved to amend the Litter Control section of the proposed April 14,
1992 draft ordinance, by changing the one (1) block language to 25-feet; Second by
Councilmember Gates. Motion passed as follows:

Mayor Stead moved to amend the Applicability section of the proposed April 14, 1992 draft
ordinance, to allow existing businesses to complete the application process within a 3o-day
period instead of 15 days; Second by Council member Templeton. Motion passed as follows:

Councilmember Gintz expressed concern that 17 pages of legislation were being enacted when
other laws, already in effect, might be used to regulate.

Councilmember Tomlinson asked Ms. Bruce, Matrixx Club owner, to confirm she had a $1
million liability insurance policy in effect at this time. She answered, from the audience, in the
affirmative.
Councilmember Templeton said he did not agree with Councilmember Gintz' statements; this
ordinance is broad-based and will serve the community. It is good for Matrixx and any future
dance clubs.

Mayor Stead confmned that the ordinance contained an emergency passage provision and is
effective upon date of passage.

WASHINGTON, RELATING TO THE ESTABUSHMENT OF FEES FOR
PUBUC DANCES AND DANCE HALLS; AMENDING RESOLUTION NO.
90-18.
Motion to approve by Deputy Mayor Marks; Second by Councilmembers Templeton and Gates.

IV. RECESS TO EXECUTIVE SESSION
Mayor Stead announced the Council will recess into Executive Session, pursuant to RCW
42.30.110(b); the Special Session will reconvene at the hour of 7:25 p.m.

Mr. McFall explained that the City of Federal Way had the opportunity to purchase the building,
currently being used as City Hall. He said the lease payments from the City and those from the
other occupant would be used to retire the debt; the building would become City property. He
said he needed authorization from the City Council to enter into negotiations for a purchase and
sale agreement, at a net figure of $2.268 million. Deputy Mayor Marks moved to approve the
City Manager's recommendation; Second by Councilmembers Templeton and Gates.
Councilmember Templeton said this was an excellent opportunity to gain an asset; Mayor Stead
said this opportunity doesn't come along too often. Motion passed as follows:
