MINUTES
CALL MEETING TO ORDER
Mayor Stead called the Federal Way City Council regular meeting to order at the
hour of 7:02 p.m., in the Theater Room of Mark Twain Elementary School,
Federal Way, Washington.
Council Present: Mayor Robert Stead, Deputy Mayor Joel Marks and
Councilmembers Ray Tomlinson, Mary Gates, Ron Gintz, Lynn Templeton, Skip
Priest.
City Staff Present: City Manager J. Brent McFall, Acting City Attorney Carolyn
Lake, City Clerk Maureen Swaney, Deputy City Clerk Chris Green.

Councilmember Gintz asked item (c) "computer purchase" be tabled for one week
and until Council can review additional information recently circulated.

Counci1member Gintz expressed concern about proposed fees for block parties
and other like activities, as listed under item (d). He doesn't feel the ordinance
is in the best interest of the City, and prefers notification to proper authorities
prior to such events.
Motion by Counci1member Gates to approve item (d) Council Bill #9/Right-of-
Way Activity Ordinance; second by Councilmember Templeton.
Following Council discussion, Councilmember Tomlinson moved to amend pages
4 and 5, section 3, paragraph 4, to reduce general liability insurance to $5,000
for all occurrences, and to strike last sentence regarding waiver or reduction;
second by Deputy Mayor Marks. Amendment passed as follows:

Council Bill #6 - Tenant Improvement/Non-Conformance Zoning Code Revisions
(Remand)
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, AMENDING ORDINANCES NO. 90-43 AND 91-113
BY AMENDING FEDERAL WAY ZONING CODE SECTIONS 165.35.3 AND
165.35.7 TO DELETE TENANT IMPROVEMENT COSTS IN THE
CALCULATIONS FOR DETERMINING CERTAIN NON-CONFORMANCE
THRESHOLDS.
CITIZEN COMMENTS ON ITEM:
Dan Casev, 1OOl-4th Ave Plaza, Suite 3200, Seattle, spoke in opposition to the
proposed ordinance due to excessive costs and economic hardship on landlords
and tenants of buildings.
David Stinebaul!b, 600 University St, Suite 2910, Seattle, also spoke in
opposition to the proposed ordinance.
~, 700-5th Ave, Suite 2700, Seattle, followed with opposition to proposed
ordinance as currently written.
Dou~ Fowler, 32303-8th Ave SW, Federal Way, as a business owner, is opposed
to ordinance as proposed.
Senior Planner Greg McCormick presented staff report on the proposed code
revision and answered questions by Councilmembers. Mayor Stead asked about
length of time necessary to have the Planning Commission further review specific
issues. Planning Manager Larry Springer said it would take approximately one
month. Councilmember Gates prefers the Technical Advisory Committee also be
consulted. As expressed, the Council is interested in creating a more equitable
process regarding signs and buffering.
Councilmember Priest moved to approve the current proposed ordinance, with the
understanding this will be reviewed shortly as part of the overall process, and that
tenant improvements be taken out of the non-conformance sign and buffering
portions; second by Council member Gintz. Motion failed as follows:

recommendations back to Council.

IX.
COUNCIL BUSINESS
a.
Selection A WC Voting Delegates
Councilmember Templeton recommended selection of Mayor Stead, Deputy
Mayor Marks and Councilmember Gates. Councilmember Gates withdrew as she
will be out of town and unable to attend the conference. Councilmember
Templeton was asked to fill the third position, for which he accepted. Voting
delegates will be made up of Mayor Stead, Deputy Mayor Marks and
Councilmember Templeton.
b.
Community Involvement Program
Motion by Councilmember Gintz to approve program; second by Deputy Mayor
Marks.
CITIZEN COMMENT ON ITEM:
H. David Kanlan, 30240-27th Ave So, Federal Way, stressed the importance in
selecting an outstanding person to fill the coordinator position.
Following Council discussion, Councilmember Templeton commended members
of the Council Committee, comprised of Deputy Mayor Marks and
Councilmembers Gintz and Tomlinson, for their positive work on the project.
Councilmember Gintz also thanked Management Assistant Sheryl Trent for her
outstanding assistance on the committee.

Mayor Stead noted the presence of several citizens who have asked to comment
on passage of the recent Dance Hall Ordinance, and invited them to come
forward at this time.

CITIZEN COMMENT ON ITEM:
Ron Johnson, 33310 Pacific Highway South, Federal Way, spoke in opposition
to the ordinance stating it is vague; he also discussed possible police harassment
at the Matrixx Club.
Julianne Bruce, 33310 Pacific Highway South, Federal Way, spoke in
opposition to the ordinance; she expressed concern about police presence causing
loss of business income at club.
Connie Rudd m:. no address given, feels the club is being harassed.
Albert Gore, 1110 So 56th St SW, Tacoma, distributed printed material to
Council and expressed displeasure at police tactics.
Mayor Stead reported City officials will be meeting with Ms. Bruce to help work
out problems currently being addressed.
x.
CITY MANAGER REPORT
a.
Status of City Council Goals
City Manager McFall announced a special study session for Monday, April 27th.
He also reported on status of the following goals set by Council during their
recent retreat: (I) high capacity transit community education; (2) ring road use
and synchronizing of lights on 99 and 32Oth; (3) Evergreen Park development;
(4) City Improvement Plan; (5) construction of sports fields and development of
ten acres at Jr High site; (6) develop neighborhood safety programs; (7) creation
of youth council; (8) City Center scope of work.
An Economic Development Planning Board will be created in the near future, and
the Chamber's Executive Board has recommended the City Council select two of
their members, in addition to Mayor Stead. He urged Councilmembers to let
Mayor Stead know as soon as possible, if they are interested in filling one of the
positions.
Other areas of current activity include (1) volunteer program; (2) diversity
commission; (3) public outreach; (4) improved little league field access on
Campus Drive; (5) striping on 335th.

XI.
CITY COUNCIL REPORTS
Councilmember Gintz expressed concern about the dance hall ordinance and feels
both agencies need to work out current problems.
Mayor Stead reported next Monday's special study session agenda will be growth
management; he stressed the importance of speeding up the process. He also
expressed concern about Matrixx Club problems.
Council member Gates reported Dial-A-Ride started last Saturday in Federal Way;
she will be putting together a briefing for Councilmembers. She further reported
the Joint Regional Policy Committee is taking a broader look at alternatives and
will be issuing an analysis soon.
Mayor Stead reported he will attend the Kiwanis Arbor Day celebration this
Saturday at Steel Lake Park, and will present the proclamation at that time.
Councilmembers were reminded about the Rotary auction being held Saturday
evening.
XII.
ADJOURNMENT
There being no further business to come before the Council, Mayor Stead
adjourned the regular meeting of the Federal Way City Council at the hour of
10:15 p.m..
