CALL MEETING TO ORDER Mayor Stead called the Federal Way city Council regular meeting to order at the hour of 7:02 p.m., on the 21st day of January, 1992, in council Chambers, City Hall, Federal Way, Washington. ll. PLEDGE OF ALLEGIANCE Councilmember Priest led the flag salute. lli. COUNCIL ROLL CALL Council Present: Mayor Robert Stead and Councilmembers Ray Tomlinson, Mary Gates, Ron Gintz, Lynn Templeton and Mahlon Priest. Excused Absence: Deputy Mayor Joel Marks. City Staff Present: city Manager J. Brent McFall, Assistant city Attorney Carolyn Lake, city Clerk Maureen Swaney and Deputy City Clerk Chris Green. IV. CITIZEN COMMENT william Wittenbera, 3l4l3-4lst Ave SW, opposes 3rd runway and 4th post plan. Federal Way, Heidi Gailev, 853 So 327th, Federal Way, opposes the possibility of a new proposed adult entertainment club in Federal Way. David Cole, 30939-36th Ave SW, Federal Way, opposes increased air traffic due to 3rd runway. Milt Scheerer, 29300-llth Pl So, Federal Way, opposes 3rd runway and mandatory recycling program; he feels city center study should be done in-house by city Staff instead of consultants. David KaÐlan, 30240-27th Ave So, Federal Way, feels the cost of the senior center should be shared equally between the County and the city; he also feels our local legislators need to be fully informed on local issues, Le., Metro. Riok Gardner, 309 SW 32lst, Federal Way, as newly elected Community Council liaison to city, announced council's newly elected officers for 1992, and extended an invitation to attend their 25th anniversary celebration to be held in late March. He also spoke in opposition to the 3rd runway. David Smith, l4508-25th SW, Seattle, representing citizens Alternative for Airport Noise, spoke in opposition to 3rd runway and encouraged citizens to contribute money to help support the group's efforts. Frank osbun, 1122 SW Normandy Terrace, Seattle, also spoke on behalf of citizens Alternative, and gave a brief overhead viewer presentation on air traffic statistics. Peter Townsend, 29508-l2th Ave SW, Federal Way, opposes 3rd runway, recommended the City donate funds to the opposition drive and encouraged citizens to do the same. John Weaver. Jr., 727 So 294th PI, Federal Way, opposes 3rd runway due to additional noise; he feels property values will be decreased with additional air traffic. v. CONSENT AGENDA a. b. c. d. RESOLUTION a. Parkwood Campus Preliminary Plat A RESOLUTION OF THB CITY COUNCIL OF THB CITY OF FBDERAL WAY, WASHINGTON, APPROVING WITH CONDITIONS THB PRELIMINARY PLAT OF PARKWOOD CAMPUS, KING COUNTY BUILDING AND LAND DEVELOPMENT FILB NO. 1289-2. (FEDERAL WAY FILB NO. ILA-90-0002-SUB). senior Planner stephen Clifton presented the Hearing Examiner recommendation to Council. Councilmember Gates requested a change on page 17, No.3 Drainage, third paragraph, line two, to strike words "it is recommended". Senior Engineer Ron Garrow addressed engineering concerns of several Councilmembers. Council concerns included: (1) limited site distance at 2nd and 8th intersection; (2) fee in lieu of open space and monies collected from King County; (3) downstream analysis; (4) through street connection; and (5) see through fencing. Motion by councilmember Gintz to approve the proposed preliminary plat; second by Councilmember Priest. Following additional discussion on Council concerns, Mayor Stead requested City Staff review and address those specific issues at the next regular meeting. Councilmember Templeton then called for the question. INTRODUCTION ORDINANCES a. Establishing Energy Code Program Grant Fund AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, AUTHORIZING AND DIRECTING EXECUTION OF AN AGREEMENT TO ACCEPT WASHINGTON STATE ENERGY OFFICE GRANT FUNDS FOR ESTABLISHING A PROJECT WITHIN THE GRANT PUND; AMENDING THE BUDGET FOR THIS GRANT PUND BY APPROPRIATING UNANTICIPATED AND FUTURE REVENUES TO THAT PUND; AND AUTHORIZING EXPENDITURES OP SAID GRANT PUNDS. Brent McFall) Motion by Councilmember Templeton to confirm the formation of a Council Committee comprised of Deputy Mayor Marks (Chair), Mayor Stead and Councilmember priest, for purpose of reviewing the feasibility of contracting for city services; second by councilmember Gates. Councilmember Gintz suggested citizen comment slips include a preference for citizens to register their opinions in writing, instead of a verbal explanation. Councilmember Templeton inquired about correspondence received by individual Councilmembers. As provided in 9.7 of the Rules, the city Clerk copies all material to each Councilmember unless the envelope is marked "personal or confidential". All Councilmembers concurred with this provision. CITY MANAGER REPORT a. Report on Airport Noise Mr. McFall submitted a memorandum to Council with respect to airport noise and related issues, recommending City staff resources be devoted in lieu of monetary contribution at this time and naming Assistant City Attorney Carolyn Lake and Senior Planner Greg Fewins to serve as lead Staff to review Ers. They would keep the Council informed of all progress. Councilmember Gates recommended Staff document all time expended; she feels city of Federal Way Staff are some of the finest in the State, making the City's commitment of expertise and time a valuable contribution. Councilmember Tomlinson supports an invitation for the Des Moines city Manager to present information at an upcoming study session. Following additional council discussion, Mr. McFall offered to have city Staff prepare more complete information for the February 4th regular meeting. Motion by councilmember Tomlinson to invite the Des Moines city Manager to speak on the noise issue at January 28th study session; second by Councilmember Gintz. councilmember Priest requested the presentation be limited to thirty minutes; Councilmembers Tomlinson and Gintz concurred. Motion passed as follows: Tomlinson Stead Templeton Marks yes Gates yes Gintz yes Priest excused absence yes yes yes FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES January 21, 1992 - Page 8 Mr. McFall responded to earlier concern by citizen regarding adult entertainment clubs, stating the city's ordinance conforms with that of the united states Supreme Court; Federal Way cannot deny such facility if it complies with the Code. The City has a zoning map related to such facilities available to interested citizens. He reported the Parks Department and Water/Sewer District are training for snow and ice sanding equipment usage. City Manager McFall reminded Councilmembers of next week's 6:00 p.m. study session call to order. He also reminded them of an executive session prior to adjournment. x. CITY COUNCIL REPORTS Councilmember Gates reported she will furnish all Councilmembers with a summary of Metro meeting business, as well as information regarding high capacity transit issues from Snohomish, King and pierce Counties. A report will also be coming from the National League of cities Association. Mayor Stead reported he is unable to attend the next meeting of the Growth Management Committee, which group includes six members from Suburban cities Association, six from King County council and six from Seattle City Council. Discussion of proposed third runway is scheduled for SCA's upcoming meeting in Bellevue on February 12th. He feels it is extremely important for the City to be well represented at all meetings. Mayor Stead suggested a proclamation be issued to oppose the airport's proposed third runway; all Councilmembers concurred. The city Council has a workshop scheduled for Monday, February Jrd, to provide an opportunity for all councilmembers to review the long range proposals set out last year. Mayor Stead urged the Council to submit suggestions for other possible workshop agenda items to City Staff as soon as possible. CITIZEN COMMENT Brian Bernecker, 406 SW 3l6th, Federal Way, requested Councilmembers cease from talking amongst themselves during citizen comments. Milt scheerer, 29300-llth Pl So, Federal Way, expressed additional concern about costs involved with the solid waste/recycling ordinance. Lisa Grimes, 2120 So 279th Pl, Federal Way, said she has mixed feelings about airport noise concern--she feels the airport location is now centralized and opposes a relocation. Bob Dahl, 3612 SW 325th st, Federal Way, volunteered to assist in petitioning citizens to oppose third runway. XII. EXECUTIVE SESSION a. To discuss litigation or potential litigation pursuant to RCW 42.30.110(i) Mayor Stead recessed the regular meeting at 10:29 p.m., and announced the Council would convene for a 20-minute executive session to discuss litigation. He stated there would be no business conducted following adjournment of the executive session. At 10:30 p.m., an additional 10- minute period was requested. Mayor Stead adj ourned the executive session at 11: 00 p.m., with no action taken, and reconvened the regular meeting. XllI.
