CALL MEETING TO ORDER
Mayor Stead opened the regular meeting of the Federal Way City Council at the hour of 7:05
p.m., in Council Chambers, City Hall, Federal Way, Washington.

CITIZEN COMMENT
Kevin Beck, 1414 So 324th St, Federal Way, representing Puget Power, spoke in favor of the
proposed landscape ordinance and the relationship to safety issues involved in power line
installation and maintenance.
Michelle Burris, 320l9-40th PI SW, Federal Way, asked Mayor Stead to read her comments
into the record with respect to preservation of natural habitats and open space.
Mal'l!8ret Nelson, 32904-4th Ave SW, Federal Way, spoke in opposition to proposed landscape
ordinance, and expressed concern about loss of trees and increased flooding from surface waters.

The following are proposed amendments to the Landscape Section of the Zoning Code:

Amendment #1
The proposed landscape ordinance provides for a great deal of flexibility in terms of landscape
design. I feel that with this new artistic freedom comes the potential of having marginal
landscape designs if a competent professional is not responsible for the design of the
landscaping. For that reason, I support the staff/TAC requirement of a Washington State
licensed landscape architect. To avoid future unnecessary amendments, I recommend that the
$75,000 be eliminated and replaced with Site Plan Review Process as the criteria.

Section 22-1563. Landscape Plan Approval.
b. Required landscape plans for all projects that are subject to the Site Plan Review
Process as set forth in Article V of this code shall be prepared by a Washington State
licensed landscape architect.

The third amendment encompassed a series of individual amendments:
Amendment #3
This next series of amendments addresses the landscape buffer widths required within specific
zoning districts. Being considered were the uses allowed in each zone, the potential impact from
these uses on surrounding property, and discussions with city staff regarding what would be
buffers appropriate to provide adequate separation between zoning districts and subsequently
uses. The primary purpose of these amendments is to ensure adequate buffers to protect existing
neighborhoods.

Mayor Stead indicated that when the landscaping code was originally developed, it was felt that
using circumference as opposed to diameter would provide an easier measurement to use. I am
also suggesting that we include some indication that the significant tree section actually gets at
tree retention in general rather than specifically significant trees.

Amendment #6
This amendment is to provide clarification in the Modification Section of the proposed code
which includes a criteria that requires a proposed landscape modification result in increased
retention of natural vegetation or significant trees. However, if these are not present (natural
vegetation or significant trees) it would preclude these sites from being considered under this
section. The second part of this amendment would include the planning commission
recommendation regarding allowing pedestrian facilities in required buffers but is rewritten to
provide clearer direction on this item.
Proposed Amendment:
Section 22-1570. Modification Options.
(b) Modifications to the landscape standards may be granted by the Director of
Community Development if:

If the proposed modification will not violate any City of Federal Way
Municipal codes or ordinances. In particular, a modification shall not be
a substitute for any zoning variance; and
4.
Where auulicable, the proposed modification would result in an increased
retention of significant trees and/or naturally occurring vegetation on the
site.
(i) Pedestrian facilities, transit stops, and handicapped access may be allowed in
required landscape areas without requiring additional buffer area, provided that the intent
of this article is met and that the function and safety of the pedestrian facility, transit stop
or handicapped facility is not compromised.

Amendment #7
There is widespread concern over developments such as Costco, where phased development
leaves large areas of the site not landscaped appropriately. This creates a visual blight on the
area. The current code provides staff with a number of methods to ensure that this does not
occur within future developments in Federal Way. The following amendment is a technical
amendment to the landscaping code to make it is absolutely clear that these remedies apply to
the landscaping area.
Proposed Amendment:
NEW SECTION - Sec. 22-1569. Performance and Maintenance Standards.
(c) Performance and Maintenance Bonds.
In addition to any other remedy provided herein, for any landscape requirements imposed
within this Code, the City may require the establishment of a performance or
maintenance bond as provided in Zoning Code Chapter 22, Division 6.

He reminded Councilmembers of the Volunteer Recognition Awards Ceremony scheduled for
April 22nd at 4:30 p.m., and the Youth Recognition Awards on April 29th at 7:00 p.m..

CITY COUNCIL REPORTS
Councilmember Gates reported the next meeting of the Regional Affairs/City Improvement
Committee will be April 27th at 5:00 p.m.; she advised the ad hoc committee is currently
reviewing Parks Commission applications.
Councilmember Templeton announced the Land Use Committee will hold its next regular
meeting on May 11th at 7:00 p.m..
Councilmember Gintz announced the Administration/Public Safety Committee will be meeting
within the next few weeks.
