CALL MEETING TO ORDER Mayor Stead opened the regular meeting of the Federal Way City Council at 7:05 p.m., in Council Chambers, City Hall, Federal Way, Washington. Councilmembers present: Mayor Bob Stead, Deputy Mayor Joel Marks, Councilmembers Ray Tomlinson, Mary Gates, Ron Gintz, Lynn Templeton, Skip Priest. City Staff present: Acting City Manager Kenneth Nyberg, City Attorney Carolyn Lake, City Clerk Maureen Swaney, Deputy City Clerk Chris Green. II. PLEDGE OF ALLEGIANCE Deputy Mayor Marks led the flag salute. III. PROCLAMATION Mayor Stead presented the "Constitution Week" proclamation to Dorothy Iverson of the Lakota Chapter of the Daughters of the American Revolution. IV. CITIZEN COMMENT Wayne DeCann thanked the Council for funding the Homestart program; John Longthorne and Ray Dimick oppose a residential location for Homestart housing; Helen Middlebrooks, Human Services Commission Chair, expressed her feelings about recent events and read her letter of resignation as a Commissioner; John Metcalf thanked the Parks/Recreation Department for their exceptional work on the Monastery property acquisition; Joseph Cadero, current program director for Homestart, thanked the Council for their support; Leonard Banks spoke in favor of the Homestart program; Richard Keeton and Glenn Eddy, Jay, Robert Mitchell, Dennis Clough and Marie Thomas thanked the Council for supporting the Homestart program; Kathy Brischle opposes placement of the Homestart facilities in a residential neighborhood; Patty Fitzpatrick supports the City's purchase of a minibus. Enactment Ordinance/Council Bill #65/Sidewalk Regulations AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, ESTABLISHING A NEW CHAPTER 17.20 REGARDING MAINTENANCE, REPAIR, RECONSTRUCTION AND CONSTRUCTION OF SIDEWALKS, DEFINING TERMS, ESTABLISHING DUTIES OF ABUTTING PROPERTY OWNERS AND OCCUPANTS, ESTABLISHING NOTICE REQUIREMENTS, PERMIT REQUIREMENTS, EXEMPTIONS, PENALTIES, AND ESTABLISHING AN EFFECTIVE DATE. APPROVED ORDINANCE NO. 93-188 f. Approve Minibus Bid Award Council member Tomlinson pulled item "a" and "b"; Councilmember Gintz pulled item "c'; Council member Priest pulled items "d" and "e"; and Mayor Stead pulled item "c" for approval purposes since it was the sole remaining item on the consent agenda. Following clarification on several voucher items, Council member Templeton moved to approve consent agenda item "a"; second by Council member Gintz. Motion by Council member Templeton to make the requested clarification and approve consent agenda item "b"; second by Councilmember Gintz. Motion to approve the minutes, as clarified, passed as follows: Stead Tomlinson Gintz Priest yes yes yes yes Marks Gates Templeton yes yes yes Motion by Council member Gates to approve the WSDOT interlocal amendment for right-of-way permitting under item "c" of the consent agenda; second by Councilmember Gintz. Motion passed as follows: Stead Tomlinson Gintz Priest yes yes yes yes Marks Gates Templeton yes yes yes Public Works Director Philip KeightJey presented a brief overview on the proposed right-of-way vegetation and the sidewalk ordinances. Senior Planner Stephen Clifton then presented additional vegetation right-of-way information and explained the difference between the three proposed ordinances. Motion by Council member GÌ11tz to approve the Mayor's alternative ordinance as proposed; second by Council member Templeton. Following discussion, Mayor Stead suggested a friendly amendment to include "willow trees" under Sec. 13-224(a); both the maker and second of the main motion concurred. Motion to approve consent agenda item "d", ORDINANCE NO. 93- 187 "Right-of-Way Vegetation" passed as follows: Stead Tomlinson Gintz Priest yes yes yes yes Marks Gates Templeton yes yes yes Mr. KeightJey provided additional information with respect to the two proposed ordinances for sidewalk regulations and answered questions of Councilmembers. Following an extended Council discussion and explanation by Parks/Recreation Director Joe Stevens, Mayor Stead called for the vote. COUNCIL BUSINESS 26th Ave SW Speed Hump Proposal Traffic Engineer Tim Miller presented information on a recent ballot circulated to all residents in the proposed area of the speed hump; he explained there was only a 45 % return of the ballots, with 30% in favor and 13% opposed to such construction. Following Council discussion on a variety of concerns and the possibility of resubmitting another ballot to citizens, it was a consensus of Councilmembers to cancel the project at this time. Motion by Council member Templeton to not move forward with the speed hump project at this time; second by Councilmember Tomlinson. CITY MANAGER REPORT Mr. Nyberg reminded Councilmembers of the executive session prior to adjournment. Mr. KeightJey announced the City just acquired an additional grant funding of 1.2 million dollars for construction on 348th Street South, which eliminates the necessity to use any City funding for the project. VIII. CITY COUNCIL REPORTS Councilmember Templeton announced the Land Use Committee will meet October 12th at 5:30 p.m.. Councilmember Gates reported the next meeting of the Regional Affairs/City Improvement Committee is scheduled for September 28th at 5:30 p.m.; she also reported the first meeting of the RTA will be held this Friday, and announced she has been elected to the Caucus. IX. EXECUTIVE SESSION Litigation/Pursuant to RCW 42.30. 11O(i) Mayor Stead recessed the regular meeting at 8:50 p.m., and announced a 6Q-minute executive session to discuss litigation pursuant to RCW 42.30.110(i), with no action anticipated at the conclusion. Mayor Stead adjourned the executive session at 10:00 p.m., and reconvened the regular meeting. x.
