CALL MEETING TO ORDER Mayor Stead opened the regular meeting of the Federal Way City Council at 7:04 p.m., in Council Chambers, City Hall, Federal Way, Washington. Councilmembers Present: Mayor Bob Stead, Deputy Mayor Joel Marks, Councilmembers Ray Tomlinson, Mary Gates, Ron Gintz, Lynn Templeton, Skip Priest. City Staff Present: City Manager J. Brent McFall, City Attorney Carolyn Lake, Deputy City Clerk Chris Green. II. PLEDGE OF ALLEGIANCE Councilmember Gates led the flag salute. III. PRESENTATION AND PROCLAMATION a. b. SPIRIT Award National Disability Employment Awareness Month Proclamation City Manager McFall presented this month's SPIRIT award to Recreation Manager Mary Faber for her successful coordination of the City's first Red/White/Blue 4th of July celebration. Mayor Stead read and presented the proclamation to Jane Yambe, Chair of the Diversity Commission. IV. CITIZEN COMMENT Jo Brown - proposed annexation areas of City; Lisa Grimes - Family Funland support; Warren Hoffman - Janssen Estates pre-plat subdivision; Clarice Scholze, Wendy Howe, Richard Taylor, Jack Dovey - youth sports fields. Deputy Mayor Marks pulled item (d); Councilmember Gintz pulled item (c); Councilmember Tomlinson pulled item (a). Motion by Councilmember Templeton to approve consent agenda items (b) and (e); second by Councilmember Gintz. The minutes of September 21, 1993, and RESOLUTION NO. 93-153 "Setting Public Hearing for 6-Year TIP" were approved as follows: Stead Tomlinson Gintz Priest yes yes yes yes Marks Gates Templeton yes yes yes Following clarification on several voucher items, Councilmember Templeton moved to approve consent agenda item (a); second by Councilmember Priest. The October 5, 1993, voucher was approved as follows: Stead Tomlinson Gintz Priest yes no yes yes Marks Gates Templeton yes yes yes Councilmember Gintz reflected his personal observations of the retail sales and temporary staff reports in the August financial report. Motion by Councilmember Templeton to approve consent agenda item (c); second by Deputy Mayor Marks. The August 1993 financial report was approved as follows: Stead Tomlinson Gintz Priest yes yes yes yes Marks Gates Templeton yes yes yes FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES October 5, 1993 - Page 3 Associate Planner Bill Kingman presented the staff report on the Janssen Estates preliminary plat application and addressed the questions of Councilmembers; he also responded to the concerns of Mr. Hoffman, a property owner in the area of the proposed plat. Following additional Council discussion, Councilmember Gates moved to remand the application back to the City's Land Use Hearing Examiner for additional review of noise levels in the area; second by Deputy Mayor Marks. Councilmember Templeton reported the Land Use Committee thoroughly reviewed the Hearing Examiner's earlier fmdings, found them acceptable and recommended approval of the proposed preliminary plat. Councilmember Tomlinson invited additional response from citizens in attendance. Jeff Mann of Pac-Tech Engineering, representing the developer, addressed traffic, drainage, landscaping and noise concerns. Mayor Stead called for the question. The motion to remand the Janssen preliminary plat application back to the Land Use Hearing Examiner failed as follows: Stead Tomlinson Gintz Priest no no no yes Marks Gates Templeton yes yes no Motion by Councilmember Templeton to accept the Hearing Examiner's recommendation, including conditions; second by Councilmember Tomlinson. Motion to approve consent agenda item (d), RESOLUTION NO. 93-154 "Janssen Estates Preliminary Plat Approval" passed as follows: Stead Tomlinson Gintz Priest yes yes yes yes Marks Gates Templeton yes yes yes Mayor Stead called a brief recess at the hour of 8:25 p.m., and reconvened the regular meeting at 8:35 p.m.. VI. COUNCIL BUSINESS Federal Way Potential Annexation Area (1) (2) Approval of the Negotiated PAA Boundaries Authorize City Manager to Enter into Interlocal Agreements FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES October 5, 1993 - Page 4 Planning Manager Larry Springer presented an overview of the four representative maps of potential annexation areas with common boundaries to the cities of Des Moines, Kent, Auburn, Algona, Pacific and Milton. Following a question and answer period, Councilmember Gintz moved for adoption of Map #3 of the preferred annexation areas for discussion purposes; second by Councilmember Templeton. Both the maker and second of the motion disagree with the Citizen Advisory Committee (CAe), and feel the boundary should extend to 26Oth. Councilmember Priest proposed a clarification and suggested acceptance of Map #4, with disagreement in areas of Auburn Heights and Woodmont; Councilmember Gintz concurred, but prefers a modified Map #3 with Auburn Heights added. Deputy Mayor Marks said he wants to extend to 260th as shown on Map #3. Councilmember Templeton said he is concerned about confusion in the language of the main motion. As a clarification, Councilmember Gintz said his motion now recommends Map #4, plus two areas of disagreement (Auburn Heights and Woodmont), and asked if Councilmember Templeton accepts his friendly amendment. Councilmember Gintz then announced that he would withdraw his motion if Councilmember Templeton is in agreement, and would propose a new main motion; Templeton concurred. Councilmember Tomlinson suggested the addition of the Trout Lake area on Map #4 for inclusion within the proposed Federal Way annexation boundary. Motion by Mayor Stead to refer the annexation issue back to the Land Use Committee for additional review, with return to full Council at a later time; second by Councilmember Gintz for discussion purposes. Councilmember Templeton reported the Land Use Committee previously voted and passed by unanimous 3-0 vote to approve Map #3, with a recommendation to agree to disagree with Des Moines. The committee further voted to agree with Auburn, Kent, Pacific, Algona and Milton. Mayor Stead called for the question on his motion to send the annexation issue back to the Land Use Committee for additional review and recommendation to full Council. Motion failed as follows: Stead Tomlinson Gintz Priest yes no no no Marks Gates Templeton no yes no Motion by Councilmember Tomlinson to disagree with Pacific, Auburn and Des Moines and to accept the negotiated potential annexation area as shown on Map #4, with an additional recommendation to include the areas of Auburn Heights and Trout Lake; second by Councilmember Templeton. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES October 5, 1993 - Page 5 Councilmember Gintz and City Manager McFall both asked for a clarification of Councilmember Tomlinson's recommendation. Councilmember Templeton said his understanding of the motion is to recommend the selection of Map #4, as amended at the Trout Lake border. Councilmember Tomlinson concurred with CouncilmemberTempleton's clarification of the main motion. Councilmember Priest asked if the instructions include a directive for staff to take issues back to the neighboring cities and King County. Mayor Stead reiterated the motion currently on the floor is to recommend approval of Map 114, as amended. Councilmember Gintz concurred with Councilmember Tomlinson's motion to approve Map #4, with the southern line being drawn straight at Trout Lake, and to include the Auburn Heights and Woodmont areas--he feels there is a concern if Map #3 is approved. Pursuant to Councilmember Tomlinson's earlier request, Mayor Stead opened an informal public comment period at the hour of 9: 30 p. m.. The following persons addressed the Council: Tom Perrigo, Trout Lake resident - supports annexation to Federal Way as shown on Map #1 and referred to a 3OO-person petition (Clerk's Note: Did not have petition in his possession, so unable to submit to City at this time); Brent Olson and Jo Brown, Auburn Heights residents - both support annexation to City of Federal Way; Lt. Brent Beden of the Federal Way Police Department, Auburn Heights property owner - supports annexation of that area to the City of Federal Way, especially for routine and emergency fire/medical services. Following citizen comments, Deputy Mayor Marks said he understands that Councilmember Tomlinson is recommending Map #3 (Note to record: Map #4 actually recommended by maker of main motion), pursuant to the CAC recommendation, with the boundary line extended to include Trout Lake and 260th. He is also in favor of including the Trout Lake area as requested by Mr. Perrigo. Deputy Mayor Marks proposed a friendly amendment to recommend the boundary of Map #1 for the Trout Lake area and continue to the border. The maker and second of the main motion accepted the friendly amendment by Deputy Mayor Marks. . Mayor Stead called for the question. CITY MANAGER REPORT Presentation of Proposed 1994 City Budget Mr. McFall reported Parks and Recreation Director Joe Stevens will be working with parents concerned about the lack of play fields in the City. He also reported that staff are currently working with the Administration/Public Safety Committee on the PhotoCop project. Mayor Stead requested a staff presentation on the project at the next regular meeting. Mr. McFall presented an overview of the proposed 1994 budget and explained it is an extremely valuable tool for taking a comprehensive look at the City with respect to services, tax base, etc.. He reported the cut-back document was prepared in accordance with the Council's recommendations as identified at their recent retreats. He reviewed the revenue side of the budget, and explained the balanced budget has been prepared pursuant to the Council's instructions for meeting the needs of the community. Mr. McFall announced the dates set aside for budget study sessions and the required public hearing. Councilmember Priest requested an additional public hearing be held on the proposed budget at the next regular meeting on October 19th. At the hour of 10:05 p.m. Councilmember Gates moved to suspend rules and continue the meeting beyond 10:00 p.m.; second by Deputy Mayor Marks. CITY COUNCIL REPORTS Mayor Stead reminded the Councilmembers of the executive session prior to adjournment. The Mayor introduced and welcomed guests Mayor Arun Jhaveri of the City of Burien and City of Des Moines Assistant City Manager Bob Olander. Councilmember Gintz reported the Administration/Public Safety Committee will meet October 7th at 7:30 a.m.; Councilmember Templeton reported the Land Use Committee will be meeting October 12th at 5:30 p.m.. EXECUTIVE SESSION Litigation Pursuant to RCW 42.30. 110(i) Mayor Stead recessed the regular meeting at 10:20 p.m., and announced a 30-minute executive session to discuss litigation pursuant to RCW 42.30.110(i), with no action anticipated at the conclusion. Mayor Stead adjourned the executive session at 10:55 p. m., and reconvened the regular meeting. x.
