CALL MEETING TO ORDER Mayor Stead opened the regular meeting of the Federal Way City Council at the hour of 7:03 p.m., in Council Chambers, City Hall, Federal Way, Washington. Council members Present: Mayor Bob Stead, Deputy Mayor Joel Marks, Councilmembers Ray Tomlinson, Mary Gates, Ron Gintz, Lynn Templeton, Skip Priest. City Staff Present: City Manager J. Brent McFall, City Attorney Carolyn Lake, Deputy City Clerk Chris Green. II. PLEDGE OF ALLEGIANCE Councilmember Gates led the flag salute. ill. PRESENTATIONS a. b. January SPIRIT Award Dr. Martin Luther King, Jr. Memorial Proclamation City Manager McFall presented January's SPIRIT award to Rachae1 Schade, Administrative Assistant to Assistant City Manager Steve Anderson and City Hearing Examiner, for excellence in assisting both departments, and exemplifying the City's SPIRIT qualities. Mayor Stead read and presented the proclamation to Diversity Commissioner David Froyalde, who, in turn, thanked the Council for establishing the new commission. IV. cmZEN COMMENT John Metcalf, 3l908-3rd Lane SW IM-203, Federal Way, asked Council to reconsider their planned trip to Japan because of travel expenses; he suggested they select a Western British Columbia city as a cost savings alternative. Harrv Mills, 906 SW 298th, Federal Way, representing the WINGS parent group, thanked the City for its part in sponsoring a special population Christmas party. He thanked Mr. Mills for expressing his appreciation to Council. v. CONSENT AGENDA a. b. c. d. Minutes - December 15, 1992 Voucher - January 5, 1993 AcceptlFile Financial Statement for November 1992 Council Bill #361Enactment Ordinance/Accept Federal Funding for Public Works Project - APPROVED ORDINANCE NO. 93-159 Motion by Councilmember Templeton to approve the consent agenda; second by Councilmember Priest. Mayor Stead announced Councilmember Tomlinson asked that item (b) be pulled from the consent agenda, and called for approval of remaining items (a), (c) and (d). Council Bill #35/Enactment/Codification of City Ordinances FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES January 5, 1993 - Page 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, ADOPTING AND ENACTING A CITY CODE FOR THE CITY OF FEDERAL WAY; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN; PROVIDING A PENALTY FOR THE VIOLATION THEREOF; PROVIDING FOR THE MANNER OF AMENDING SUCH CODE; AND PROVIDING WHEN SUCH CODE AND THIS ORDINANCE SHALL BECOME EFFECTIVE. City Attorney Carolyn Lake provided a brief explanation of the proposed City Code as published by Municipal Code Corporation of Tallahassee, Florida. Mayor Stead opened the public hearing at 7:25 p.m., and called for citizen comment. There being no response, Mayor Stead closed the public hearing at 7:26 p.m.. Motion by Councilmember Gates to approve the City Code; second by Councilmember Templeton. INTRODUCTION ORDINANCES a. Council Bill #37/Traffic Code Amendment AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, AMENDING THE CITY'S TRAFFIC CODE TO PROVIDE FOR MANDATORY MINiMUM MONETARY PENALTIES FOR TRAFFIC INFRACTIONS COMMITTED WITHIN NEIGHBORHOOD TRAFFIC SAFETY ZONES, AS DESIGNATED BY FEDERAL WAY. (AMENDS ORDINANCE 91-91) Mayor Stead presented introduction reading of the Traffic Code Amendment, and announced enactment is scheduled for the next regular meeting. b. Council Bills #38 & #391Two (2) Cable Franchise Agreements #38 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, RELATING TO CABLE COMMUNICATION FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES January 5, 1993 - Page 4 FRANCIllSES, AMENDING ORDINANCE NO. 91-104, EXTENDING THE NON-EXCLUSIVE FRANCIllSE WITH VIACOM. AND #39 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, RELATING TO CABLE COMMUNICATION FRANCHISES, GRANTING CONTINUATION OF NON-EXCLUSIVE FRANCIllSES FOR CABLE COMMUNICATION SYSTEMS AND SERVICES UPON THE PUBliC STREETS, WAYS, AND ALLEYS WITHIN THE CITY OF FEDERAL WAY AND EXTENDING THE NON-EXCLUSIVE FRANCHISE WITH TCI. Mayor Stead presented introduction readings for the two proposed ordinances. Following Council discussion, Mayor Stead directed the newly formed Administration/Public Safety Council Committee to review both documents for recommendations to full Council at the next regular meeting. c. Council Bill #40/Commute Trip Reduction AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, ESTABliSHING A NEW CHAPTER 18.30 OF THE FEDERAL WAY CITY CODE, ESTABliSHING DEFINITIONS, APPliCAB1LITY REQUIREMENTS, A COMMUTE TRIP REDUCTION (CTR) PLAN TO COMPLY WITH RCW 70.94.527, CTR GOALS, EXEMPTIONS, APPEALS, ENFORCEMENT, PENALTIES AND ESTABliSHING AN EFFECTIVE DATE. Mayor Stead introduced Mr. Bjorklund, who indicated he would like to address the Council with respect to CTR planning. Lee Biorklund, 7349 West Greenlake Drive North, Seattle, the newly appointed Transportation Coordinator for Weyerhaeuser Company's Corporate Headquarters Region, spoke and presented written documentation to Council with respect to Weyerhaeuser requirements to meet the State Commute Trip Reduction Law. Mayor Stead presented introduction reading of the proposed ordinance. Following Council discussion, Mayor Stead directed the newly formed Administration/Public Safety Council Committee to review the draft ordinance for a recommendation to full Council at the next regular meeting. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES January 5, 1993 - Page 5 Vill. COUNCIL BUSINESS a. Olive Garden Process ill Sign Code VarianceIResoIutlOD No. 93-127 Code Compliance Officer Martin Nordby briefed Council on their three available options for action under Process ill guidelines, and reviewed the denial recommendation of City staff. Motion by Councilmember Templeton to follow staff recommendation to uphold the Hearing Examiner's decision to deny the sign code variance request; second by Deputy Mayor Marks. Legislative Priorities Mr. McFall reported the Regional Affairs/City Improvement Council Committee has established and recommended a list of the City's legislative priorities for presentation during the 1993 session. Motion by Councilmember Gates to approve the listed 1993 priorities; second by Mayor Stead. Deputy Mayor Marks offered a friendly amendment to delete PBX services under police services; maker and second of main motion concurred. CityShape Update Long Range Planning Manager Larry Springer briefed Council on upcoming CityShape programs and presented four planning alternatives. An open house covering economics and infrastructure is scheduled for March; long range plan, transportation and land use alternatives for presentation this Fall; and public hearing tentatively scheduled for January 1994. Public Works Director Philip Keightley also presented two transportation maps detailing future traffic routes and explained the City's anticipated ability to proceed with detail modeling by early March. CITY MANAGER REPORT Mr. McFall reported the city is making significant progress in the area of long range planning, with hopes of completing the process by the end of 1993. He announced the following staff have been assigned to assist Councilmembers with their newly formed committees: Ken Nyberg/Land Use; Steve Anderson/Administration & Public Safety; J. Brent McFall/Regional Affairs & City Improvement. He reminded Council of their upcoming planning session on Thursday from 1:00-6:00 p.m., in Council Chambers. The City Manager reported that since no one from the City was able to attend tonight's joint meeting on airport issues, he and Councilmember Priest will meet with representatives of Normandy Park, Des Moines and Sea Tac tomorrow morning for a briefing; other City staff planning to attend are Greg Fewins and Carolyn Lake. He further reminded Councilmembers of the scheduled executive session to discuss property acquisition, and advised action is anticipated prior to adjournment. x. CITY COUNCIL REPORTS Mayor Stead said he would like to see the oversight committee meet as soon as possible. Councilmember Templeton announced the Land Use Council Committee will meet January 12th from 7:00-9:00 p.m.; he thanked Ken Nyberg, Larry Springer and Greg Moore for their assistance in developing an extremely aggressive agenda for their first meeting. Councilmember Gintz discussed a convenient time to schedule regular meetings of the Administration/Public Safety Council Committee; the decision was made to schedule meeting times at 7:30 a.m., with a regular date to be established as soon as possible. Councilmember Gates announced the Regional Affairs/City Improvement Council Committee has cancelled its January 26th meeting and will be rescheduling to a later date, at which time discussion will center around the flight plan issue. She reminded those present of the City's request for reconsideration of the final EIS public hearing scheduled for January 13th in Council Chambers, with continuation to January 15th at port facilities. Mayor Stead announced the Council will be meeting with district legislators to discuss the City's legislative priorities. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES January 5, 1993 - Page 7 XI. EXECUTIVE SESSION Mayor Stead recessed the regular meeting at 8:30 p.m., and announced a 3O-minute executive session to discuss property acquisition, pursuant to RCW 4a.3O.110(b), with action anticipated prior to adjournment of the regular meeting. At 9:00 p.m., Mr. Anderson announced a continuation of the executive session for an additional fifteen minutes; at 9:15 p.m., Mr. Anderson announced a IS-minute continuation; at 9:30 p.m., an additional ten minutes was announced by Mr. Anderson. Mayor Stead adjourned the executive session at 9:40 p.m., announced a 5-minute recess and reconvened the regular meeting at 9:45 p.m.. Motion by Councilmember Templeton to authorize the City Manager to enter into a lease purchase agreement with 3D-day contingencies, which preserves options for the City to immediately purchase or to lease purchase property known as 33901-9th Avenue South, for use as a Senior/Community Center; second by Deputy Mayor Marks.
