CALL MEETING TO ORDER Mayor Stead opened the regular meeting of the Federal Way City Council at the hour of 7:05 p.m., in Council Chambers, City Hall, Federal Way, Washington. Council members Present: Mayor Bob Stead, Deputy Mayor Joel Marks, Councilmembers Ray Tomlinson, Mary Gates, Ron Gintz, Lynn Templeton, Skip Priest. City Staff Present: City Manager J. Brent McFall, Deputy City Attorney Londi Lindell, City Clerk Maureen Swaney, Deputy City Clerk Chris Green. II. PLEDGE OF ALLEGIANCE A member of Boy Scout Troop #355 led the flag salute. ill. CITIZEN COMMENT Assistant City Manager Ken Nyberg introduced and welcomed the newly appointed Fire District Administrator James Hamilton. Mr. Hamilton said he looks forward to working with city officials and hopes to make a positive contribution to the district and community. Godfrey Youn2, 33llQ-2lst Ave So, Federal Way, spoke in favor of continuing the operation of the Federal Way Community Center, and stressed the need for a homeless shelter in the area. Kenn Marshall, 33llQ-21st Ave So, Federal Way, representing military veterans and the Samoan community, said he would like to see both groups become an integral part of the community. Carol Otto, 4232 SW 33lst Pi, Federal Way, feels it is extremely important for the Council and staff to address the immediate needs of all citizens, as well as establishing long range planning goals. Fredrick Peoper, 2409 SW 33lst, Federal Way, speaking on behalf of the Federal Way Community Center, pleaded with the Council and staff to work with the center's directors to reopen the facilities as soon as possible, due to the large number of people and programs dependent on its operation. David Wooden, 2032 So 327th Lane #BB20l, Federal Way, expressed concern about the untimely closure of the community center; he had previously rented the facility for a concert and was forced to cancel the performance one day prior to the scheduled date causing financial difficulties for him. Milton Audett, 4244 So 29Oth, Auburn, newly elected President of the Federal Way Community Center's Board of Directors, addressed their concerns and problems arising from the closure of the center; he assured the Council that the center would no longer be used as a homeless facility. Mayor Stead thanked those speaking on behalf of the Federal Way Community Center, and said city officials will work with the Center's Board of Directors in an attempt to reopen the facilities once public safety and code requirements have been met. He asked that city staff research homeless programs and report pertinent information to Council. IV. CONSENT AGENDA a. b. c. d. Motion by Council member Gates to approve items (a)(b)(d)(e), with item (c) pulled; second by Deputy Mayor Marks. Motion to approve items (a)(b)(d)(e) of the consent agenda passed as follows: Stead Tomlinson Gintz Priest yes no yes yes Marks Gates Templeton yes yes yes Councilmember Gates explained her concern with Council Bill #37 from judicial, insurance, schools, police and fire perspectives. She would also like to have the Diversity and Youth Commissions review the proposed code amendment prior to adoption; Deputy Mayor Marks concurred. Council member Gintz reported the Administration/Public Safety Council Committee FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES January 19, 1993 - Page 3 spent several months thoroughly researching the draft ordinance, as well as talking with police and a local judge. Councilmember Priest said he is extremely supportive of the amendment, as a tool to enforce neighborhood traffic programs. Mayor Stead is also concerned the amendment will inteñere with the judiciary. Councilmember Priest moved to approve item (c) of the consent agenda; second by Councilmember Gintz. ENACTMENT ORDINANCE Council Bill #40/Commute Trip Reduction (2 Proposed Ordinances) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, ESTABUSHING A NEW CHAPTER lS.30 OF THE FEDERAL WAY CITY CODE, ESTABUSHING DEFINITIONS, APPUCAB1LITY REQUIREMENTS, A COMMUTE TRIP REDUCTION (CTR) PLAN TO COMPLY WITH RCW 70.94.527, CTR GOALS, EXEMPTIONS, APPEALS, ENFORCEMENT, PENALTIES AND ESTABUSHING AN EFFECTIVE DATE. Public Works Director Philip Keightley presented a brief staff report to Council, and reported the Administration/Public Safety Council Committee has reviewed both documents and recommends approval of the alternative ordinance. Motion by Councilmember Templeton to approve the proposed alternative Commute Trip Reduction Ordinance; second by CouncilmemberGates. COUNCIL BUSINESS a. Campus Park/Federal Way Junior High #6 Application Approval Councilmember Templeton moved to approve the application for Campus Park/Federal Way Junior High #6 per the Hearing Examiner's recommendation; second by Councilmember Priest. Litowitz Application Approval Council member Priest moved to approve the application of David Litowitz per the Hearing Examiner's recommendation, including the stated conditions; second by Council member Gintz. Establish Task Force for 348th Street Area Mayor Stead reviewed the issues to be addressed by a future task force, encompassing a variety of projects, including that of locating additional freeway accesses to 1-5. Mr. Keightley explained the upcoming transportation comprehensive plan will help identify specific areas and should be available in approximately two months. Councilmember Priest requested future studies and recommendations include both north and south locations of the city. Councilmember Gintz would also like to see economic development of the 348th Street area, in order to provide tax revenue opportunities for the city. Councilmember Gates said she would like to wait and see what projects will be identified through the transportation comprehensive plan, including those areas of 288th Street and old City Hall; she feels it could be ten years before the completion. Councilmember Gintz feels the City should be making immediate lobbying efforts. Councilmember Templeton agrees with Councilmember Gates and feels the narrowing of recommendations to specific areas might create problems; he thinks the State would FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES January 19, 1993 - Page 5 be more receptive to broader suggestions, in light of recent revisions at 32Oth and 1-5. Mayor Stead feels a more realistic time frame for future access 1-5 projects might be three to five years; he would like to see freeway access locations constructed to circumvent heavily populated areas. Councilmembers Tomlinson, Gintz and Priest offered to serve as task force members. Mayor Stead would like a staff recommendation to name members of the special task force ready for presentation at the next regular meeting. Councilmember Priest said he would like to see three to four city officials, as well as other interested citizens named to complete the group. Mayor Stead introduced and welcomed special guests, State Legislator Tracey Bide and Federal Way School Board President Mary Weis. VII. CITY MANAGER REPORT Mr. McFall introduced Liberty Walther, one of the students recently appointed to the city's newly formed Youth Commission. He reported city staff is currently working with the fire district to identify and address safety issues at the community center, and assured Council the city's only motive for closing the center was to ensure conformance of public safety and code requirements. He reminded the Mayor and Council of the necessity for calling an executive session to discuss possible litigation prior to adjournment, and said Council action is anticipated at the conclusion. Vill. CITY COUNCIL REPORTS Councilmember Gates reported the Regional Affairs/City Improvement Council Committee will meet February 2nd at 5:00 p.m., with a special airport video presentation scheduled from 4:30- 4:55 p.m. that evening. Mayor Stead reminded Councilmembers of the CityShape workshop on Thursday at 7:00 p.m.; he also reported on recent County-Metro merger meetings. Deputy Mayor Marks expressed concern over recent newspaper articles regarding correspondence between two Councilmembers and said he hopes the press will start to "report" news instead of "writing" news. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES January 19, 1993 - Page 6 IX. EXECUTIVE SESSION - Litigation - Pursuant to RCW 42.30.110(i) Mayor Stead recessed the regular meeting at 8:30 p.m., and announced a 3D-minute executive session to discuss possible litigation pursuant to RCW 4i1.30.110(i), with action anticipated prior to adjournment of the meeting. At 9:00 p.m., Ken Nyberg announced a IS-minute continuation of the executive session; at 9: 15 p.m., an additional IS-minute extension was reported by Mr. Nyberg. Mayor Stead adjourned the executive session at 9:30 p.m., and reconvened the regular meeting. x. REGULAR MEETING CONTINUATION Motion by Councilmember Templeton to authorize the City Manager to enter into a professional services agreement with an independent financial analyst, in an amount not to exceed $37,000.00, to determine the financial condition of the Federal Way Water/Sewer District; second by Councilmember Gates. Amendment by Councilmember Tomlinson to ask the Water/Sewer District to pay one-half of the cost to participate in the study; second by Councilmember Gintz. Council member Priest recommended the District be given a lo-day deadline for approval of its participation, to allow the city to meet the Boundary Review Board time frame; Councilmember Priest's friendly amendment for the addition of a 1D-day deadline was accepted by Councilmembers Tomlinson and Gintz. Councilmember Templeton expressed concern about the Water/Sewer District objecting to the selection of a contractor, thereby causing a possible delay in Boundary Review Board requirements. In an additional amendment to the main motion, Councilmember Priest moved to name the contractor as being the Peat Marwick Management Group; second by Council member Gintz. There being no additional discussion, Mayor Stead called for a vote on Councilmember Priest's second amendment.
