CALL MEETING TO ORDER Mayor Gates opened the regular meeting of the Federal Way City Council at 7:02 p.m., in Council Chambers, City Hall, Federal Way, Washington. City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Councilmembers Ray Tomlinson, Ron Gintz, Skip Priest, Bob Stead, Hope Elder. City Staff present: City Manager Kenneth Nyberg, Acting City Attorney Londi Lindell, City Clerk Maureen Swaney, Deputy City Clerk Chris Green. II. PLEDGE OF ALLEGIANCE Councilmember Priest led the flag salute. ill. CITIZEN COMMENT Ray Dimick, Roger Simmons, Mashelle Kloppel - addressed potential conffict of interest with City Council member being a Boardmember of Homestart and an owner of a residential dwelling being leased to Homestart; David Wallis - opposed to locating "transient hotels" in neighborhoods; Mark Freeland - opposed to increase in property land use appeal fees from $75 to $750; John Metcalf - thanked the Council and staff for the city's recent Martin Luther King celebration, and said he favors the 312th sports courts being left open to the public. EXECUTIVE SESSION Potential Litigation/Pursuant to RCW 42.30.110(i) Mayor Gates recessed the regular meeting at 7:22 p.m., and announced a 15-minute executive session to discuss potential litigation pursuant to RCW 42.30. 110(i). Mayor Gates adjourned the executive session at 7:40 p.m., and reconvened the regular meeting. No action was taken following the session. VI. COUNCIL BUSINESS a. 312th Sports Courts Parks Director Joe Stevens presented Council with a brief report and illustration recommending acceptance of alternative #3, which provides for installation of a to-foot chain link fence and gate to allow the city to regulate usage of the sports court facilities. Councilmember Gintz FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES January 18, 1994 - Page 3 suggested an additional wood fence be installed at the back property line, with the possibility of cost and labor being donated by local scout troops. Since it is unusual to provide rest room facilities in neighborhood parks, Mayor Gates mentioned the possibility of installing signs to direct individuals to the facilities at Lakota. Councilmember Tomlinson recommended restricting vehicle parking across from the courts due to traffic congestion in the area. Public Works Director Philip Keightley will provide parking restriction information for the Council at the February 1 regular meeting. Motion by Councilmember Gintz to adopt alternative #3, to provide for the construction of a ten foot chain link fence and gate surrounding the courts; second by Councilmember Priest. Proposed Change to Employee Health Benefit Plan Mr. Nyberg reviewed the committee's recommendation for the benefit package and proposed an additional three year phase in program. Council member Gintz said he appreciates the City Manager's recommendation, but prefers the immediate budgetary savings with the committee's recommendation. For discussion purposes, Councilmember Gintz moved to approve the committee's recommendation for implementation of the proposed benefit plan; second by Councilmember Priest. Councilmember Tomlinson moved for amendment to the main motion to place the full monetary savings into a fund to provide additional employee benefits, with a process established for a benefit review by a committee of the City Council Finance Committee, the City Manager and three employees; second by Councilmember Stead. Graffiti Removal Program 1) Staff Report 2) Proposed Ordinance Councll Bill #85/lntroduction Ordinance/Prohibiting Graffiti AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY W ASIDNGTON, AMENDING FEDERAL WAY CITY CODE CHAPTER SIX, CRIMINAL CODE, TO ADD A NEW SECTION 6-215 PROIDBITING GRAFFITI WITIDN THE CITY OF FEDERAL WAY AND ESTABLISIDNG A MANDATORY MINIMUM SENTENCE FOR THE OFFENSE (AMENDS ORDINANCE 91-89). Management Assistant Dena Laurent gave a brief overview of the Youth Commission's recommendation to Council. Mayor Gates presented introduction reading of the ordinance, with enactment scheduled for February 1. d. Federal Way Water/Sewer Assumption Ordinance Repeal 1) Staff Report 2) Proposed Ordinance Council Bill #86/Introduction Ordinance/Repeal FW Water/Sewer Assumption AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASIDNGTON, REPEALING PRIOR ORDINANCE NO. 91-152 AND RESOLUTION 93-159, REPEALING THE CITY'S ACTION TO ASSUME THE FEDERAL WAY WATER AND SEWER DISTRICT. Acting City Attorney Londi Lindell responded to Councilmember Tomlinson's inquiries regarding the 9O-day time frame for the U.S. District Court and Boundary Review Board findings. Mayor Gates presented introduction reading of the proposed ordinance. Councilmember Tomlinson moved to table the proposed ordinance until April 19, 1994; second by Councilmember Priest. CITY MANAGER REPORT Mr. Nyberg updated the Council on the city's recent emergency program meetings, which included two members from Fire District #39. He reported on possible dates for the Council's planned mini retreat--January 31 was selected as the preferred date. Vill. CITY COUNCIL REPORTS Council member Stead reported on the upcoming growth management policy meeting, at which time the chair and vice-chairs will be selected. Councilmember Priest reported on recent 4-post plan meetings--with the task force's work now finished, its recommendations will be forwarded to the FAA. Mayor Gates thanked the citizens attending on the homeless shelter issue for their courtesy in remaining throughout the entire business meeting. Councilmember Tomlinson requested the Land Use Committee take a look at homeless concerns. Councilmember Elder reported on her recent attendance at the "Welcome to City Hall" session in Tacoma. Deputy Mayor Watkins requested the Planning Commission review the issue of homeless facilities and what constitutes a "family" in a single family residence as a merit decision. Mayor Gates reminded Councilmembers of the staffs homeless review update scheduled for February.
