CALL MEETING TO ORDER Mayor Gates opened the regular meeting of the Federal Way City Council at 7: 12 p.m., in Council Chambers, City Hall, Federal Way, Washington. City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Councilmembers Jack Dovey, Hope Elder, Skip Priest, Ray Tomlinson. Excused absence: Councilmember Ron Gintz. City Staff present: City Manager Ken Nyberg, City Attorney Londi Lindell, Acting City Clerk Chris Green. II. PLEDGE OF ALLEGIANCE Councilmember Elder led the flag salute. III. PROCLAMATION Mayor Gates presented the Black History Month proclamation to Diversity Commissioner Adrian Johnson, who, in turn, said a few words and thanked the Mayor and Council for the recognition. IV. PRESENTATION Mayor Gat~s, assisted by Deputy Mayor Watkins, introduced and presented certificates to the newly appointed Arts, Diversity and Human Services Commissioners in attendance. V. CITIZEN COMMENT Joan Tabrum, Arts Commission Chair - attended a recent concert featuring local vocalist Rob McPherson and suggested the Council acknowledge the contribution and recognition he brings to the community; Robert Rollins and Doris Elsten, Redondo Crest residents - expressed concern about the high crime rate in their local area, including mail thefts and vehicle vandalism, and expressed support for implementation of teen curfews in the city; Simon Josowitz, Dumas Bay resident - concerned about impact on wildlife and public use of beach area at the Visitation Retreat Center; Kate Cadoo, Director of the Community Health Center - updated Council on staffing and outreach programs available through their facility; Linda Ellingson, member of the Coalition for Dumas Bay Habitat - read a letter from Citizens for a Healthy Bay and urged ORIGINAL FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES February 21, 1995 - Page 2 approval of the MDNS for the Visitation Retreat property; Peggy McKasy, Dumas Bay area resident - concerned about the impact of the beach area if public access is allowed at the retreat center; Estelle Yamaki - wants the delicate ecosystems protected at Dumas Bay, and expressed concern about increased vandalism to private properties in the bay area; Pamela Martin - concerned about destruction of the unique sand dollar area at Dumas Bay and urged the city to follow MDNS recommendations; Gloria Elliott, member of Coalition for Dumas Bay Habitat - concurred with earlier statements and wants beach access limited and monitored for passive use only; Robert Spaulding, Dumas Bay resident - also asked city to move cautiously in developing the Visitation Retreat property and expressed concern for the wildlife in the beach area; Mike McKasy, Dumas Bay resident - said the MDNS outlined some the potential problems and wants all development carefully monitored; Cynthia Hsu, Redondo Crest resident - concerned about crime in her area and supports establishing a teen curfew law; John Metcalf - requested Council remain within city boundaries for their upcoming retreat; Jane Yambe - thanked the Council for the Black History Month proclamation, as she feels it is opportunity to create community spirit; Terry Watson, Redondo Crest resident - concerned about crime in her area, and would like the Council to consider setting teen curfew laws; Gloria Skinner - concerned about the impact on Dumas Bay wildlife if public access is allowed at the retreat center. Mayor Gates responded to the citizen concerns. VI. CONSENT AGENDA d. e. The Council asked Parks/Recreation Director Jenny Schroder to provide them with a map identifying projects within the city that would qualify for CDBG funding, in lieu of the Truman joint project. Motion by Councilmember Tomlinson to approve the 1995 CDBG funding allocation as presented by staff; second by Councilmember Dovey. INTRODUCTION ORDINANCE Watkins Dovey Elder yes yes yes Council Bill #106/Business Registration Code Amendment AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, AMENDING THE FEDERAL WAY CITY CODE, CHAPTER 9, COVERING BUSINESS REGISTRATIONS TO INCLUDE REGISTRATION REVOCATION PROCEDURES (AMENDS ORD NO 91-86). Mayor Gates presented introduction reading the Council Bill #106. Motion by Councilmember Elder to forward the proposed ordinance to the Finance/Economic Development Committee for additional review, with the committee's recommendation to full Council on March 7, 1995; second by Councilmember Dovey. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES February 21, 1995 - Page 4 Vill. CITY COUNCIL BUSINESS a. Local Government Services Agreements/SSB5038 COPP Director Larry Springer presented an update on SSB5038 and reminded Councilmembers there will be a meeting of all elected officials at the SeaTac Red Lion on March 1, from 6:00- 9:00 p.m.. The Regional Policy Committee, of which Councilmember Gintz is an active member, will also review the bill. Following the committee's review, the final research request and procedure goes before the County Council for fmal approval. Mayor Gates and Councilmembers Priest and Elder plan to attend the elected officials meeting at the City of SeaTac. Councilmember Priest expressed concern that other entities, such as water/sewer districts and fire, have been excluded in the process. b. A Regional Coalition for Housing (ARCH) Nancy McEleney, citizen - spoke in favor of the ARCH program and encouraged the Council to establish a vision that will carry it into the future in the areas of transportation, housing and housing options, recreation, economic development, open space and quality of life. Mr. Springer presented information to Council obtained during recent South King County Housing Forum meetings, and pointed out the advantages of organizing and working cooperatively on housing issues between neighboring communities. He suggested the possibility of using the eastside cities' interlocal as a model for the southend area. This program provides low and moderate income housing to citizens. After presenting the information to the Public Safety/Human Services Committee, Mr. Springer said the committee felt the project had merit and requested he extend an invitation to Alice Schobe to address the Council at this time. Ms. Schobe, former member of ARCH staff briefed Council on some of the reasons behind the establishment of the ARCH concept. Some of the initial reasons included: (1) small cities are unable to establish and provide their own programs; (2) requirements of local funding; and (3) housing needs cross boundaries. She feels it would be a tremendous opportunity for several neighboring cities, and wonders if Federal Way might be interested in assuming a leadership role in the formation of a southend organization. ARCH purposely established guidelines based on a long term project, rather than a short term task force. The premise of a coop is to provide an expert staff with fewer people, whose expertise can be used to identify building projects, locate available land and contractors and research grant availability. Contributions are based on the size of cities and/or their ability to furnish staffing. Council expressed concerns about the possibility of duplication of services by the county or other agencies. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES February 21, 1995 - Page 5 During the Council's upcoming retreat, Mayor Gates suggested they discuss the possibilities of establishing a cooperative organization for housing projects in the southend area. c. 1995 Long Range Planning Work Program Mr. Springer reported the Land Use/Transportation Committee previously spent approximately four hours identifying all work program projects and now recommends approval by full Council. Motion by Deputy Mayor Watkins to approve the proposed 1995 Long Range Planning Work Program; second by Councilmember Priest. CITY MANAGER REPORT City Manager Kenneth Nyberg reminded Councilmembers of their upcoming two-day retreat at Port Ludlow. He asked Public Works Director Cary Roe to brief Council on surface water concerns during the recent heavy rains. Mr. Roe reported that due to the superior advance work of city crews all possible problems were diverted prior to becoming a crisis. He said he received only four weather related calls, three of which were from King County Police officers; most problems were due to the collection of debris in catch basins. Mayor Gates commended Mr. Roe and his staff for their excellent work. Mr. Nyberg also extended his appreciation to the Public Works Department, and thanked Assistant City Manager Keightley for his management in preventing a potential problem. Mr. Nyberg reminded Councilmembers of the need for a 20-minute executive session to discuss potential litigation, with no action anticipated. x. CITY COUNCIL REPORTS In Councilmember Gintz' absence, Councilmember Priest reported the Finance/Economic Development Committee will meet February 23 at 7:30 a.m.; he further announced the next meeting of the Land Use/Transportation Committee is scheduled for March 6. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES February 21, 1995 - Page 6 As informational, Councilmember Elder reported the City of Kent will be taking its proposed curfew law to a vote of its citizens, and reported the City of SeaTac recently passed a curfew ordinance. She and Management Assistant Dena Laurent will be attending a meeting to discuss funding for an additional police officer for management of community policing programs under the COPS Ahead grant program. She is also working on senior housing issues. Mayor Gates mentioned that she, Councilmember Dovey and Ms. Laurent will be attending the upcoming A WC legislative conference in Olympia tomorrow. XI. EXECUTIVE SESSION Potential Litigation/Pursuant to RCW 42.30. 110(i) Mayor Gates recessed the regular meeting at 9:30 p.m., and announced a 20-minute executive session to discuss potential litigation, with no action anticipated. At 9:50 p.m., Mr. Keightley announced a continuation of the executive session for an additional ten minutes. At 10:00 p.m., Council returned to chambers and Deputy Mayor Watkins moved to suspend Council rules to continue the regular meeting beyond 10:00 p.m.; second by Councilmember Dovey.
