MINUTES
I.
CALL MEETING TO ORDER
Mayor Gates opened the regular meeting of the Federal Way City Council at 7:00 p.m., in
Council Chambers, City Hall, Federal Way, Washington.
City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Councilmembers Jack
Dovey, Hope Elder, Ron Gintz, Skip Priest, Ray Tomlinson.
City Staff present: City Manager Ken Nyberg, City Attorney Londi Lindell, City Clerk Chris
Green.
II.
PLEDGE OF ALLEGIANCE
Deputy Mayor Watkins led the flag salute.
III.
PRESENTATIONS
a.
Monetary gift ($3,025) from Swedish Women's Education Fund for the Federal
Way Community Caregiving Network/Shelter Project for Women With Children;
A.K. Anderson, SWEA President, presented the check to John Metcalf of the
Caregiving Network.
b.
Monetary gift ($10,000) from Lois and Larry Masengale, as a memorial to their
husband and father, John Masengale, who died in the line of duty as a special
agent; the funds will be shared by the City of Federal Way and the FW Boys/Girls
Club in rebuilding a ball field in Federal Way.
IV.
CITIZEN COMMENT
Dave Kaplan - thanked city staff for their timely response to his earlier request to analyze illegal
left turns at the intersection of 336th Avenue South and Pacific Highway South; Gerald Norton -
expressed his gratitude to the Council and city staff for superior service to the citizens of Federal
Way, and said he fully supported the Council's decision to conduct their recent retreat away
from the city; Lori Bielinski, representing the American Massage Therapy Association - thanked
the Council for their support of the proposed massage ordinance and said their organization will
be using it as a model for other cities.

Consent item (d): Pam Otteson - spoke on behalf of the property owners wanting to be excluded
from the proposed annexation area because of their concern about future increased property
taxes;. she also expressed concern about the usage of their neighborhood roadways by a locally
based gravel trucking operation.
COPP Director Larry Springer further outlined the annexation process time frame and responded
to Council inquiries.
Motion by Councilmember Priest to accept the proposed 10% annexation petition from the
Enchanted Village area, consent item (d); second by Council member Elder. Motion passed as

Motion by Council member Tomlinson to appoint Dave Kaplan, Jim Baker and Laird Chambers
as Parks/Recreation Commissioners for three year terms, with Jerry Bollen appointed as
alternate; second by Councilmember Elder. Motion passed as follows:

VII.
CITY MANAGER REPORT
Mr. Nyberg reported on his recent trip to the National League of Cities conference in
Washington, D.C.; Councilmember Tomlinson also attended. They met with congressional
delegates and representatives of the U.S. Justice Department to discuss the COPPS program.
They were also present for the "State of the Nation" message given by the Speaker of the House.
He reminded the Council of the upcoming legislative "Town Meeting" to be held on March 25,
from 11:00 a.m.-12:30 p.m., in Council Chambers.
Mr. Nyberg announced that Assistant City Manager Philip Keightley is the recent recipient of
the prestigious "Government Leadership Neighborhood Safety Award" from the Washington
State Traffic Safety Commission. Mayor Gates congratulated Mr. Keightley and his staff for
their outstanding work.
City Manager Nyberg reminded Councilmembers of the need for a 30-minute executive session
on the following three items: (1) potential litigation, (2) property acquisition and (3) public
employee performance, with action anticipated.

CITY COUNCIL REPORTS
Councilmember Tomlinson reported on his recent trip to the National League of Cities
conference; he was encouraged by the concern of other cities regarding current truancy laws.
Additionally, as a follow-up to Council discussion during the retreat, he would like to clarify
the recommendation that the Visitation property will fall under the auspices of the Arts
Commission. Councilmember Gintz, Finance/Economic Development Committee Chair, said
he is comfortable with having the commission report to his committee.
Motion by Councilmember Gintz to direct the Arts Commission to report to the Finance/
Economic Development Committee on matters involving the Visitation property; second by
Councilmember Elder. Motion passed as follows:

Councilmember Priest thanked Mayor Gates and city staff for their perseverance and success in
having the bulk mail facility improve its landscape appearance. He reported the Planning
Commission anticipates it will conclude the sign code revision process tomorrow night. The
Land Use/Transportation Committee plans to invite the full Council to attend its April 3
meeting, for purposes of reviewing the commission's proposed sign code amendments.
Councilmember Gintz thanked Mayor Gates for arranging the details for the upcoming visit of
the delegation from our Sister City of Hachinohe. The City of Tacoma and Port of Tacoma will
join us in hosting the dignitaries from Japan. Activities will be held at the World Trade Center
and the Visitation Retreat Center. He reported the Finance/Economic Development Committee's
next meeting is scheduled for March 23, at 7:30 a.m..
Council member Elder reported the South King County Human Services Network has previously
allowed only one representative from the Federal Way area, which doesn't serve our community
effectively. Currently, there is a bill (HB 2084) before legislature, which would eliminate the
Community Public Health and Safety Network Board and the Family Policy Committee.
Motion by Councilmember Elder to immediately send a letter to State Legislators in support of
HB 2084, which bill recommends the South King County Human Services Network Board be
disbanded; second by Councilmember Gintz. Motion passed as follows:

Councilmember Elder also reported on her attendance at today's SCATBd meeting; discussion
focused on continued funding for RTA following last week's election failure.
Mayor Gates said R'TA members will be meeting on March 24, and have scheduled a future
workshop to review alternative possibilities; she has received numerous letters from citizens
supporting the project. At last week's PSRC meeting, Pierce County Executive Doug Sutherland
was elected Chair, with King County Executive Gary Locke named as Vice-Chair. She
reminded Councilmembers of the upcoming safety forum being held at Federal Way High School
on March 30.

Mayor Gates recessed the regular meeting at 8:08 p.m., and announced a 30-minute executive
session to discuss property acquisition, potential litigation and public employee performance
review, with the possibility of action being taken at the conclusion of the session.
At 8:35 p.m., Mr. Nyberg announced a continuation of the executive session for an additional
fifteen minutes; at 8:50 p.m., Mr. Keightley announced another lO-minute extension; and at
9:00 p.m., Mr. Keightley announced the Council requested an additional ten minutes. Mayor
Gates adjourned the executive session at 9:07 p.m., and reconvened the regular meeting.
Motion by Deputy Mayor Watkins to direct the City Attorney to prepare a second amendment
to the employment contract entered into between the City of Federal Way and Kenneth Nyberg,
City Manager, extending his employment beyond December 31, 1995, providing for no increase
in his annual salary other than any subsequent cost of living adjustment approved by the City
Council and providing additional vacation time for the City Manager; second by Councilmember
Elder. Motion passed as follows:
