CALL MEETING TO ORDER Mayor Gates opened the regular meeting of the Federal Way City Council at 7:14 p.m., in Council Chambers, City Hall, Federal Way, Washington. City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Councilmembers Jack Dovey, Hope Elder, Ron Gintz, Skip Priest, Ray Tomlinson. City Staff present: City Manager Ken Nyberg, City Attorney Londi Lindell, City Clerk Chris Green. II. PLEDGE OF ALLEGIANCE Councilmember Priest led the flag salute. III. PROCLAMATIONS & ANNOUNCEMENTS Mayor Gates read and presented the Youth Recognition Week proclamation to Youth Commissioner Naila McKenzie, who, in turn, said a few words and thanked the City Council for recognizing youth in academics, sports and the arts. The Earth Day proclamation was read and presented by Mayor Gates to Special Events Coordinator Sara Owens, who, in turn, invited all citizens to attend the Earth Day celebration on Saturday, April 22, at Alderbrook Park. Mayor Gates read and presented the Oil Reclamation Week proclamation to Gene Thompson from Q Lube. Mr. Thompson thanked the Mayor and City Council for their support of their recent grand opening. Q Lube provides free oil recycling to the community. City Manager Ken Nyberg announced that the city will host a Special Recycling Collection Day on Saturday, April 29, 1995, from 9:00 a.m. to 3:00 p.m., at the south Federal Way Park and Ride. The city's Solid Waste/Recycling Coordinator Rob Van Orsow is coordinating this event. ORIGINAL FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES April 18, 1995 - Page 2 Mayor Gates brought attention to a missing chair where Milt Scheerer always sat. Mr. Scheerer was a regular attendee of Council meetings and recently passed away. He was always concerned about the health and welfare of city government. Additionally, Mayor Gates noted the passing of Dr. Bertold Bruell, one of the city's founding physicians, who looked after the health of our citizens for many years. He also provided medical care to the Sisters at the Visitation facility, and was instrumental in establishing the St. Francis Hospital within our community. IV. CITIZEN COMMENT Gregory Keeton - expressed concern for the safety of our police officers if they are not provided with adequate communication equipment. Rich Lanfear, representing the Federal Way Lions - distributed a copy of the Lions Club's resolution supporting the request for a proposed bingo project and asked for favorable approval by the city. Glenn Whitham - opposes the funding mechanisms for the proposed bond issues. Mayor Gates read a letter from Debbie Fuller - opposes school truancy laws, as she feels it affects homeschoolers' rights. Motion passed as follows: Gates Tomlinson Gintz Priest yes yes yes yes Watkins Dovey Elder yes yes yes Item (d): Councilmember Gintz asked for clarification on the proposed fee resolution amendment for electrical inspection fees. Building Official Dick Mumma advised that the rates are the same as those charged by the State. Councilmember Gintz moved to approve consent item (d); seconded by Councilmember Priest. Motion passed as follows: Gates Tomlinson Gintz Priest yes yes yes yes Watkins Dovey Elder yes yes yes Item (e): Deputy Mayor Watkins asked that Ms. Fuller's concerns about truancy laws be addressed. Additional information was provided by Councilmembers Tomlinson and Elder, as well as Ray Jenne, Director of Federal Way School District Security. Mr. Jenne noted there is a data base available to officers, so they can call and verify if a student is exempt from the truancy laws. Homeschoolers and private schools are also registered with the state for data base verification. Councilmember Tomlinson stressed the purpose is to work together with the school district in lowering crime and giving police a method of enforcement. Deputy Mayor Watkins moved to approve consent item (e); seconded by Councilmember Dovey. Motion passed as follows: Gates Tomlinson Gintz Priest yes yes yes yes Watkins Dovey Elder yes yes yes Item (h): Councilmember Gintz expressed concern regarding sidewalk replacement and tree removal at two sites, costing $41,489.30. He also commented that future trees planted by the city should have a root system that won't damage streets. CITY MANAGER REPORT City Manager Nyberg reminded Councilmembers of the need for a 15-minute executive session to discuss property acquisition, with no action anticipated. Mr. Nyberg announced that the city's 1995 certified population count is 74,413; an increase of approximately 900 over last year. He congratulated the Geographical Information Systems Division for being the recipient of an award during the recent 8th Annual Geo/SQL International Conference. The city's GIS Department submitted a mapping project they had previously produced, for which they received the second place award out of hundreds of submittals by other cities and towns in the United States. Council member Gintz also extended his thanks and appreciation to the GIS staff for their recent assistance during the sign code hearings. City Manager Nyberg presented a brief summary of the 130 page report on police services to Councilmembers. Mr. Nyberg thanked Management Services Director Iwen Wang for her countless hours of assistance on this project during the past year. Much of the time was spent in joint working meetings between the city and county. He recommended that the Council consider scheduling a series of meetings to discuss the police services models as presented. Mr. Nyberg also asked for the Council's approval to extend the current Memorandum of Understanding with King County. Motion by Councilmember Elder to authorize the City Manager to sign the extension to the Memorandum of Understanding between the City of Federal Way and King County relating to law enforcement services, extending said services from April 15, 1995, to May 15, 1995; and to extend the 18-month Notification of Intent to Terminate Services from October to November 1996; seconded by Deputy Mayor Watkins. City Manager Nyberg suggested that Councilmembers read the text and focus on the non-financial aspects of policing rather than the detailed costs. VII. CITY COUNCIL REPORTS Councilmember Dovey reported that progress has recently been made with the architect's review of Celebration Park improvements. Councilmember Elder reminded Councilmembers of the Public Safety/Human Services Committee meeting to discuss police services on May 4, at 5:30 p.m., rather than the regular time of 7:30 a.m., to give more people the opportunity to attend the meeting. Councilmember Gintz announced that the Finance/Economic Development Committee meeting has been rescheduled to Wednesday, April 26, at 7:30 a.m.. Councilmember Priest discussed public access television. He stated we need to look beyond the costs, as it is a good method to publicize issues affecting the city. Deputy Mayor Watkins thanked Councilmember Priest for bringing this issue before Council, as he feels public notification is an important issue; and, he feels more people tend to watch television rather than read newspapers. Councilmember Gintz asked that this item be referred back to the Finance/Economic Development Committee for additional discussion at their April 26 meeting. Councilmember Tomlinson reported that the Saghalie Park Dedication is on Sunday, April 23, at 1:00 p.m. He reported there will be a Parks/Recreation Committee special meeting on Monday, May 8, at 7:30 a.m., to discuss Steel Lake Park Phase I bids. Mayor Gates reminded Councilmembers that nominations for positions on the A WC Board of Directors, Nominations Committee and Resolutions Committee are due by May I. Additionally, she asked that Councilmembers submit the names of citizens who are willing to actively serve on a "citizens committee" for the city's proposed bond issue. VIII. EXECUTIVE SESSION Property Acquisition/Pursuant to RCW 42.30.110(b) Mayor Gates recessed the regular meeting at 9:02 p.m., and announced a 15-minute executive session to discuss property acquisition, with no action anticipated. Mayor Gates adjourned the executive session at 9:35 p.m., reconvened the regular meeting, and reported there was no action to be taken. IX.
