MINUTES
I.
CALL MEETING TO ORDER
Mayor Gates opened the regular meeting of the Federal Way City Council at 7:02 p.m., in
Council Chambers, City Hall, Federal Way, Washington.
City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Councilmembers Jack
Dovey, Hope Elder, Ron Gintz, Skip Priest, Ray Tomlinson.
City Staff present: City Manager Ken Nyberg, City Attorney Londi Lindell, City Clerk Chris
Green.
II.
PLEDGE OF ALLEGIANCE
Councilmember Dovey led the flag salute.
III.
PRESENTATIONS
a.
1994 Claims Free Year/Awarded by St. Paul Fire & Marine
City Manager Ken Nyberg introduced representatives from St. Paul Fire & Marine, Regional
Loss Control Manager David Barnett and Loss Control Services Representative Eric Wright, and
the city's representative from Raleigh, Schwarz and Powell, Senior Vice President Daniel
DeLorenzo. Mr. Barnett presented a plaque to Risk Manager Bonny Kraske, on behalf of the
City and in recognition of a "claims free" year in 1994, and reported on the loss control efforts
which were instrumental in the city receiving this award. This is an outstanding accomplishment
for a city of our size. Mrs. Kraske thanked the Council, City Manager Nyberg and Management
Services Director Iwen Wang for the support she has received as Risk Manager, and said this
claims free effort would not have been possible without all the assistance she has received in
safety and loss control efforts. City Manager Nyberg recognized Bonny for her outstanding
contribution in the area of risk management, and said the city will miss her. (Clerk's note:
Bonny recently submitted her resignation, as her family is moving to the State of Arizona)
b.
Arts Commissioner Introduction
Mayor Gates introduced and presented newly appointed Arts Commissioner Donna Welsh with
a certificate of appointment. Mrs. Welsh thanked the Council and said she feels honored to have
been selected to serve on the commission.

IV.
CITIZEN COMMENT
Mary Ehlis - thanked Recreation Manager Mary Faber, Risk Manager Bonny Kraske and the
Public Works Department for their invaluable assistance with Family Fest planning, which is
now a Seafair sanctioned event. Mark Miloscia, Chair of the Federal Way Community
Caregiving Network - would like assistance in locating a temporary office location for their
organization. Grace Townsend - thanked the Council for considering her letters and calls during
the police services study, and thanked Major Evans and local police officers for their continued
assistance. Mayor Gates responded to citizen comments.

Item (b): Councilmember Priest asked for clarification from Public Works Director Cary Roe
concerning the Vadis Northwest contract. Mr. Roe advised that Vadis will remove the "snipe"
signs on the utility poles, within employee reach, at no additional charge.
Motion by Councilmember Priest to recommend that the Public Works Department extend the
Vadis Northwest contract, with the inclusion of "snipe" sign removal within their employees'
reach; second by Councilmember Elder. Mayor Gates proposed a friendly amendment to include
"without cost to the city" for said sign removal; maker and second of main motion concurred.

Council Bill/#11111994 Uniform Building Code
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, AMENDING CHAPTER FIVE OF THE FEDERAL
WAY CITY CODE, TO ADOPT THE 1994 UNIFORM BUILDING CODES.
(AMENDING ORDINANCE NOS. 90-33 AND 92-143)
Mayor Gates presented introduction reading of Council Bill #111.
Motion by Councilmember Gintz to move ordinance enactment to the June 6 regular meeting;

Council Bill/#112/Sign Code
Dick Senn, one of twelve owners of Forest Village Apartments, a 172 unit complex - expressed
concern regarding the sign code and asked that council consider changes for signs that advertise
properties that aren't in plain view. Sharon Bowman, Resident Manager at Forest Village
Apartments - feels that signs are important to locate their apartments. Greg Anderson,
represents owners of a 236 unit apartment building - indicated that approximately 22 % of rentals
were attributed to drive-by signs; he requested that Council allow a variance for those properties
that face similar location situations. Eugene Barth, All Occasion Balloons - thanked Council and
staff for taking the time and effort to review the sign code policy with citizens.
Mayor Gates presented introduction reading of Council Bill #112.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, AMENDING ARTICLE IV OF THE FEDERAL WAY
CITY CODE, RELATING TO NONCONFORMING SIGNS AND AMENDING
ARTICLE XVIII OF THE FEDERAL WAY CITY CODE RELATING TO THE
REGULATION OF SIGNS.

Motion by Councilmember Priest to amend the proposed ordinance to include Section 22.1605
of the current Federal Way Zoning Code, which allows comprehensive planning by two
contiguous owners, with the understanding that in these situations the multi-tenant sign
regulations govern these situations in terms of sign height and area; second by Councilmember
Gintz. Following further discussion, Councilmember Priest indicated he would like staff to
consider amendments to the proposed ordinance and report back to Council.
Motion by Deputy Mayor Watkins to table the item to the next regular meeting failed for lack
of a second.
Mayor Gates clarified Councilmember Priest's amendment to the proposed ordinance--that the
Council consider looking at the possibility of placing within the sign code ordinance, the
potential for advertising for properties that are contiguous, but not on arterials. Motion to
amend the proposed ordinance passed as follows:

Deputy Mayor Watkins requested that a new draft document be presented to Council at the next
regular meeting, rather than verbiage being added to the current document.
Mayor Gates expressed concern regarding testimony received from the Chamber of Commerce
with respect to sign area.
Motion by Mayor Gates to direct the City Attorney to amend the Sign Code to increase the
maximum sign area allowed on all sign faces for low profile and medium profile freestanding
signs from sixty-four (64) square feet to eighty (80) square feet; this will require revisions to
Sections 22-1601A(2)(d) and 22-16O1A(3)(d) to read as follows: "Sign area shall not exceed a
maximum sign area of eighty (80) square feet for the total of all sign faces on each permitted
sign with no one sign face exceeding forty (40) square feet"; second by Councilmember Gintz.
The goal is to give more sign area to those properties qualifying for low and medium profile
signs, especially in consideration of the speeds at which people do travel. Following further
Council discussion, motion to amend the proposed ordinance passed as follows:

Councilmember Elder moved a third amendment to the proposed ordinance to revisit the section
for signs with a two (2) foot architectural embellishment--if the Council is going to increase the
size of other signs, she feels it is only fair adjust that section of the code as well; second by

VII.
CITY COUNCIL BUSINESS
a.
Future Police Services
Councilmember Elder moved to direct the City Manager to notify King County that the city is
terminating that certain interlocal agreement providing for Police Services entered into between
the City of Federal Way and King County, and, further, to direct the City Manager to take all
necessary actions, including the expenditure of all necessary funds, in order to form a City of
Federal Way Police Department on or about November 15, 1996; second by Councilmember
Priest.
Motion by Councilmember Tomlinson to include the hiring of current police officers failed for
lack of a second.

AWC Voting Delegates
Councilmember Tomlinson moved to appoint Councilmembers Gintz, Elder and Priest, as the
three voting delegates to represent the city at the 1995 A WC Annual Business Meeting on June
30. Councilmember Elder advised she is unable to attend. Councilmember Gintz recommended
that Mayor Gates be named as the third voting delegate; second by Councilmember Elder.

VIII.
CITY MANAGER REPORT
City Manager Ken Nyberg introduced and welcomed Bob Baker, who will serve as the city's
Deputy City Clerk beginning June 5.
Mr. Nyberg introduced Parks Superintendent David Wilbrecht, who briefed Council on the
Federal Way High School improvements. Mr. Wilbrecht indicated a memo was distributed to
Council providing additional background information. CPAC has previously received approval
for funding in the amount of $32,000 for 1995 improvements by both the Parks/Recreation
Commission and the Parks/Recreation Council Committee. It is hoped that the request for final
approval of this project will be presented to full Council in June.
Assistant City Manager Keightley briefed Council regarding the proposed agreement between
the City of Federal Way and the Airport Communities Coalition (the "ACC"). The City Council
previously approved $50,000 for the ACC's work relative to noise levels, health and economic
impact on the city. Cutler and Stanfield, the subcontractor, has indicated the work can be
accomplished for $27,000 rather than $50,000. The contractor needs to complete the work by
June 23, with the city completing their review by July 7.
Motion by Councilmember Priest to authorize the City Manager to execute the ACC agreement;
second by Councilmember Dovey.
Councilmember Priest stressed the importance of this third runway analysis, as a quality of life
issue within our community. He indicated that additional funding may be necessary, in the event
both staff and experts feel we should spend more money on the economic issue. Councilmember
Priest also commented that city staff, especially Senior Planner Greg Fewins, has done an
excellent job in this first phase of protecting our citizen's interest on this issue.

City Manager Nyberg advised we have received notification for the public hearing on the
expansion of the master plan update at the Seattle-Tacoma Airport. There will be two hearings:
the first to be held on June 1, at the Sea-Tac Red Lion, with the second hearing on June 14, at
Calvary Lutheran Church, in Federal Way. A copy of the environmental impact statement is
available for Council's consideration.
Mr. Nyberg distributed a copy of the draft agenda for the Council's 1996 Budget Retreat
scheduled for Friday, May 19, in Council Chambers. He reviewed agenda items and advised
that department staff will also be in attendance to answer questions. Councilmember Gintz
requested that presentations be shortened and any additional information be provided in writing.
Council feels that staff preparation and presentations should be sufficient to address their
questions, to enable the retreat to conclude by 6:00-6:30 p.m.
IX.
CITY COUNCIL REPORTS
Councilmember Dovey reported the next Parks and Recreation Committee meeting will be held
on June 12, at 8:00 a.m..
Councilmember Elder announced the next public Safety/Human Services Committee meeting is
scheduled for June I, at 7:30 a.m.. As a reminder, she reported the applications for the CDBG
block grants are now available.
Mayor Gates thanked Deputy Mayor Watkins, the liaison to the ACC, for his work on the
airport issue.
Councilmember Gintz reported the Finance/Economic Development Committee meeting is
scheduled for May 25, at 7:30 a.m..
Councilmember Priest reported the Land/Use Transportation Committee will meet on June 5,
at 6:00 p.m.. It will be a public hearing on the proposed bond issue street list, as well as a
discussion on the street/traffic TIP and street improvement policies.

Mayor Gates announced the general assembly for Puget Sound Regional Council is open to all
Councilmembers. The agenda is basically the Metropolitan Transportation Plan, which plan
must be filed by September I to be considered for ISTEA funding. Assistant City Manager
Keightley has a copy of the plan.
