CALL MEETING TO ORDER Mayor Gates opened the regular meeting of the Federal Way City Council at 7:00 p.m., in Council Chambers, City Hall, Federal Way, Washington. City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Councilmembers Jack Dovey, Hope Elder, Ron Gintz, Mike Park, Skip Priest. City Staff present: City Manager Ken Nyberg, City Attorney Londi Lindell, City Clerk Chris Green, Deputy City Clerk Bob Baker. ll. PLEDGE OF ALLEGIANCE Councilmember Skip Priest led the flag salute. ill. PRESENTATIONS a. CAFR Award Management Services Director Iwen Wang recognized her staff and presented them with two distinguished awards. One award was presented for the Best Comprehensive Annual Financial Report and the other was for the Best Yearly Budget Report. The CAFR Award is the highest single award a governmental entity can attain. b. Westway Community Crime Prevention Task Force Presentations Assistant City Manager Philip Keightley presented the Program of the Year Award (Non- Police) to those who contributed to Westway's success. Mayor Gates presented certificates, which were duplicated from the award to several persons present and thanked them for their tireless efforts and countless hours of work. c. P. T. S. A. Certificate of Appreciation (added to Agenda) Mayor Gates read a Certificate of Appreciation from the President of the Federal Way P. T. S. A. thanking the City Council for their efforts to help build a strong partnership between the City and school district to benefit children. CITIZEN COMMENT Dietrich Jones, President of the Historical Society, reported they are proceeding cautiously with the reconstruction of the historical cabins. He feels the community (citizens and businesses) should be concerned as government dollars will be limited for the project. Membership fees in the amount of $100.00 may be sought. Mayor Gates thanked Mr. Jones for his ideas. V. CONSENT AGENDA a. b. c. d. Motion by Councilmember Priest to approve consent items (a), (b), (e), and (f); second by Council member Jack Dovey. Motion passed as follows: Gates Park Gintz Priest yes yes yes yes Watkins Dovey Elder yes yes yes Item (c): Councilmember Elder discussed the item with Council, and Dr. Kleine came forward to introduce task force members Michael Park, Bill Linehan and Philip Keightley. He made a special note not to forget the late Milt Scheerer's contributions. Dr. Kleine discussed the task force's recommendations as provided in Council packets. Dr. Kleine answered questions from the Council relative to models of a family center--school curriculums, .costs of programs, agencies operating out of their businesses, re-prioritization of offers of service to the community; those who would take the lead for funding; the potential to obtain grants of various types to make the programs possible; a pilot program to ensure its workability; leadership; block watch programs; volunteers; the "fixing" of social problems; getting to know and work with neighbors; measuring impacts; and the potential cost of hiring a future family center manager. Dr. Kleine invited the City Council to the next task force meeting on July II, 1995. Motion by Councilmember Jack Dovey to move ahead with the task force's recommendations, with the caveat to review the funding issues at the end of the year; second by Councilmember Elder. She advised the City Code requires an ADA accessible parking lot in the historical cabins area. Council member Gintz addressed the amount of money necessary for the project and recommended the matter be referred back to committee for evaluation. Ms. Schroder noted there is no funding available for the project at this time, but future grants may be available. Another suggestion was to request a hearing examiner review regarding the paved parking lot requirements currently set by Code. Community Development Director Greg Moore will have staff review paving requirements. Mayor Gates requested that Council receive a legal briefing at a later time. Council member Gintz moved for the adoption of consent agent item (d); second by Jack Dovey. Motion passed as follows: Gates Park Gintz Priest yes yes yes yes Watkins Dovey Elder yes yes yes Item (g): Deputy Mayor Watkins explained the interview process for the Ethics Board vacancy and moved for reappointment of Reverend Jonathon Schmick for another 3-year term and for the appointment of Bill Linehan as an alternate, also for a three-year term; second by Councilmen Priest. Motion passed as follows: Gates Park Gintz Priest yes yes yes yes Watkins Dovey Elder yes yes yes At 8:30 p.m., Mayor Gates announced a 5-minute recess; she reconvened the regular meeting at 8:40 p.m.. VI. PUBLIC HEARING/Cable Franchise Mayor Gates read the opening statement for the public hearing process, and opened the public hearing at 8:44 p.m.. City Attorney Londi Lindell briefed Council on the cable franchise issue before them, and provided background history. She advised the Council is now requested to consider public FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES June 20, 1995 - Page 4 comment, and to provide any desired amendments to the proposed ordinance for adoption at their regular meeting on July 18, 1995. Mayor Gates then invited citizen comment. Harriett Neal spoke in support of the proposed franchise; she feels the extra twelve cents per month for cable is acceptable. Robert Neal spoke in support of the proposed franchise; as a cable technician, he feels cable franchises help to shape the "infrastructure" of the community. H. David Kaplan spoke in opposition to the proposed cable franchise and expressed concern about lack of flexibility with the lO-year franchise. Councilmembers asked a wide range of questions pertaining to franchises, e.g., does a franchise constitute a contract; what is the best possible value to the citizens; pay per view; capital to provide outreach to the community; cost per household for the franchise; late fees; pass-through costs to subscribers and the possibilities thereof. Mayor Gates requested Ms. Lindell investigate a "no cost pass through" clause for government access. Motion by Deputy Mayor Watkins to send item (d) back to the FinanceÆconomic Development Committee for further clarification and recommendation to full Council; second by Councilmember Priest for discussion purposes. Motion passed as follows: Gates Park Gintz Priest yes yes yes yes Watkins Dovey Elder yes yes yes There being no additional citizen comment, Mayor Gates closed the public hearing at the hour of 9:45 p.m.; she invited citizens to contact Councilmembers regarding future requests or concerns. Vll. INTRODUCTION ORDINANCE Council Bill #115/Solid Waste FranchiseÆxpansion of Operating Hours Mayor Gates presented the first reading of the proposed ordinance. Motion by Councilmember Priest to move enactment of Council Bill #115 to the July 5 regular meeting; second by Councilmember Elder. Solid Waste/Recycling Coordinator Rob Van Orsow responded to Council inquiries on the proposed extension of operating hours for commercial properties. Concern centered around the inconsistency between the map and the proposed franchise expansion. Public Works Director Cary Roe advised that staff could prepare a clarification and address Council concerns about commercial zones during the upcoming Finance/Economic Development Committee Meeting on June 22. That would allow the draft expansion ordinance to be brought back to full Council for final review and approval at their July 5 regular meeting. At 10:00 p.m., Deputy Mayor Watkins moved to suspend rules and extend meeting time beyond 10:00 p.m.; second by Council member Dovey. CITY MANAGER REPORT City Manager Ken Nyberg introduced James Murphy, who will serve as the City's new Interim Police Services Director during the transition phase of establishing the city's future police department. He reported the city's building inspections are currently continuing Monday through Saturday to increase service to the citizens of the community. Mr. Nyberg advised Council there would be no executive session. IX. CITY COUNCIL REPORTS Councilmember Park said his past two weeks have been hectic, but interesting. He said he now realizes both humor and patience are necessary for being a good Councilmember! Councilmember Priest advised the next Land Use/Transportation Committee meeting is set for July 3, 1995, at 3:00 p.m.. Councilmember Gintz reported the next FinanceÆconomic Development Committee meeting will be held on June 22, 1995, at 7:30 a.m.. Councilmember Dovey made known a special ParksIRecreation Committee meeting on June 27, 1995, at 8:00 a.m., regarding Celebration Park, and extended an invitation to full Council to attend. Councilmember Elder advised the Public Safety/Human Services Committee will meet on July 13, 1995. She thanked Council member Dovey for accompanying her on a recent walk through Celebration Park. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES June 20, 1995 - Page 6 Deputy Mayor Watkins thanked Philip Keightley for representing the city during a recent meeting held in opposition to the shipment of spent nuclear fuels through the Port of Tacoma. The cities of Tacoma, Fife, Milton, Seattle and Renton were also represented at the meeting. He reported the next Airport Committee Coalition Meeting is scheduled for June 21, 1995. Mayor Gates announced the next regular meeting of the Council will be held on July 5, 1995, due to the holiday. The next Suburban Cities Association (SCA) Board of Directors meeting is set for June 21, 1995, with a briefing on solid waste and the Metropolitan/King County 6-Year Plan. Further, she advised the next DART meeting is set for July 5, 1995, and suggested a briefing follow for Council's benefit. She announced the next South County Area Transportation Board (SCATBd) meeting is scheduled for July 18, 1995. Councilmember Gintz announced the next Regional Policy Planning Committee meeting is set for June 22, 1995, at 3:00 p.m.. Deputy Mayor Watkins asked if the 6-Year Plan and SCATBd items are informational or if action is required. Mayor Gates said they are informational, however, Council may take action if they deem it necessary. Finally, Councilmember Park announced the quarterly City/Korean Leadership Group Committee meeting is scheduled for June 27, 1995, at 6:30 p.m., in Council Chambers. x.
