CALL MEETING TO ORDER Mayor Gates opened the regular meeting of the Federal Way City Council at 7:00 p.m., in Council Chambers, City Hall, Federal Way, Washington. City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Councilmembers Jack Dovey, Hope Elder, Ron Gintz, Mike Park and Skip Priest. City Staff present: City Manager Ken Nyberg, City Attorney Londi Lindell, City Clerk Chris Green, Deputy City Clerk Bob Baker. ll. PLEDGE OF ALLEGIANCE Councilmember Ron Gintz led the flag salute. ill. PRESENTATIONS a. Ethics Boardmember & Alternate Introduction Reverend Jonathan Schmick received a Certificate of Appointment to the Ethics Board for another 3- year term. Although Bill Linehan was not present, his name was announced as Alternate Boardmember. b. Certified Municipal Clerk (added to Agenda) City Clerk Chris Green, received flowers and a certificate qualifying her as a Certified Municipal Clerk from City Manager Ken Nyberg. The certification process included a three-year course of instruction and "hands-on" experience as a Deputy Clerk and City Clerk. IV. CITIZEN COMMENT John Metcalf, on behalf of "Fusion" thanked the Council for the HUD grant for a newly acquired shelter and invited the Council to the 2nd Annual Jazz on the Sound Concert at the Visitation Retreat & Cultural Center on August 4, 1995, from 5:30 to 9:30 p.m. Barbara Gardner spoke in favor of reconsidering what fields and play areas would be included at Celebration Park. Rick Gardner announced KUDOS! were in order for the wonderful fireworks display on the 4th of July; expressed congratulations to Michael Park for his appointment to the Council; spoke in agreement with Barbara's comments; and announced he and his family were moving to Arizona. ORIGINAL FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES July 5, 1995 - Page 2 Peggy LaPorte of the Care Giving Unit reported they have purchased a one bedroom condominium unit to be used as a shelter for women and children; she also announced the upcoming jazz concert. Mayor Gates commented it was, "a delight" to see Ms. LaPorte had made the purchase; she thanked the Gardner's for their continued concerns for a balance between an active/passive usage of Celebration Park and bid them farewell. V. CONSENT AGENDA a. Motion by Councilmember Gintz to approve consent items (a), (b), (c), (d), (e) and (g); second by Deputy Mayor Watkins. Director of Public Works Cary Roe stated additional money may be available later. Councilmember Gintz requested "number crunching" for the difference between an overlay and total new construction. Councilmember Priest moved for the adoption of consent agenda item (h); second by Councilmember Gintz. INTRODUCTION ORDINANCE Council Bill #116/336th & Kitts Corner Condemnation Mayor Gates presented first reading of the proposed ordinance. Councilmember Priest made a motion to move the Council Bill #116 to enactment on the July 18 agenda; second by Councilmember Dovey. CITY MANAGER REPORT City Manager Nyberg announced the need for an executive session tonight with possible litigation being the topic. No action was expected. Mr. Nyberg mentioned a new form was being used tonight re: a fiscal report - new memorandum was being used as a reference document. Mr. Nyberg informed Council the City Shape Comprehensive Plan was completed; Volumes I and II were placed at the dais for their review. Mr. Nyberg informed Council as to the development of the new Police Department, which is under way with many meetings taking place between key people; and told them he would begin a series of reports keeping them apprised of the City's progress. Mr. Nyberg introduced former Councilmember Joel Marks. As President of the district's Board of Directors, Mr. Marks introduced Roger Brown, General Manager of Lakehaven. Mr. Brown addressed the issue of water supply to the Council. He stated there is plenty of water for the citizens of Federal Way. He informed Council 13 to 14 million gallons of water a day are used out of a possible 28 million gallons available. Lakehaven officials are working with other city officials to FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES July 5, 1995 - Page 4 achieve water "deals" ensuring our citizens will continually have an adequate supply of water. Mr. Brown spoke of the concern earlier this summer regarding the conservation of water. He further reported on the de-emphasized school program as behavior effects were not consistent with expectations; encouraged continued conservation efforts and informed Council the direction of focus will switch to indoor water use and conservation in the winter. VIII. CITY COUNCIL REPORTS Councilmember Jack Dovey announced a special ParkslRecreation Committee Meeting on July 10, 1995, at 8:00 a.m. Councilmember Hope Elder announced a Public Safety and Human Services Committee Meeting July 13, 1995, at 7:30 a.m. Deputy Mayor Watkins announced the new Director of the Airport Community Coalition Group is Ken Reed. He requested Greg Fewins to give a report on the Environmental Impact Study at the August I, 1995, study session. Councilmember Ron Gintz stated there were no upcoming Finance Committee meetings scheduled. He announced delegates from Hachinohe would be greeted at a reception at City Hall, on Friday, July 7, 1995, at 1:00 p.m.; they will host a booth for both days of Family Fest. Councilmember Skip Priest thanked the City staff for their hard work and time in completing the City Shape Comprehensive Plan. He announced the next Land Use Transportation Committee Meeting will be August 7, 1995, at 6:00 p.m. Further, Mr. Priest spoke of legislation re: Public- Private Partnership and stated there was a proposal for three Park & Ride Facilities where a fee would be charged for security. He explained there is a 30-day window for comment and staff analysis. The deadline for comment relative to the issue is July 16, 1995. Finally, he suggested that staff prepare a letter in regard to this issue. Deputy Mayor Watkins provided a brief insight to the Public-Private Partnership issue and how it began during the 1993 legislative session. Councilmember Park stated the Red, White and Blues Festival was a success. He announced Family Fest on July 8 and 9 and encouraged all to attend. Mayor Gates invited all Councilmembers to be present in Chambers at 1:00 p.m. on Friday, July 7, 1995, to greet the delegates from Hachinohe. She stated a dinner would take place on July 9, 1995, at 8:00 p.m. at an "undecided" place. She reminded Councilmembers about the parade on July 8, and that their families have been invited to ride in the parade vehicles. She announced she and Councilmember Priest attended the recent WAC Conference and would provide a summary of resolutions and conference documents to Councilmembers. IX. EXECUTIVE SESSION/Potential Litigation Pursuant to RCW At 8:20 p.m., Mayor Gates announced a IS-minute executive session. At 8:38 p.m., City Manager Nyberg announced a 6-minute continuance of the executive session.
