MINUTES
I.
CALL MEETING TO ORDER
Mayor Gates opened the regular meeting of the Federal Way City Council at 7:08 p.m., in Council
Chambers, City Hall, Federal Way, Washington.
City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Councilmembers Jack
Dovey, Hope Elder, Ron Gintz, Mike Park and Skip Priest.
City Staff present: City Manager Ken Nyberg, City Attorney Londi Lindell, City Clerk Chris
Green, Deputy City Clerk Bob Baker.
II.
PLEDGE OF ALLEGIANCE
Councilmember Park led the flag salute.
III.
PRESENTATIONS
a.
SPIRIT Award
City Manager Ken Nyberg and City Attorney Londi Lindell presented Paul Wohl & Carol
Stripling with the SPIRIT Award for the month of August for saving the City over $200,000.00
by initiating a twice-daily transport of defendants from the King County Jail and for constantly
looking for ways to improve not only their department, but the City as a whole.
b. Diversity Commissioner Introduction
Deputy Mayor Phil Watkins presented Ms. Pamela English a Certificate of Appointment to the
Diversity Commission while Mayor Gates thanked Ms. English for her continued efforts with the
City.
IV.
CITIZEN COMMENT
Cheri Harris-Smith spoke in favor of Celebration Park and getting the item to the voters as the
"park achieves so much for so many" citizens of Federal Way. Sandy Sternod also spoke in favor
of Celebration Park as well as increasing the number of Softball fields for softball

tournaments and bringing additional monies into the City. Her husband, Jim Sternod reiterated
and agreed with his wife's remarks. Jim Baker stated he is a "strong, fiscal conservative" but
would readily vote in favor of the tax cost associated with Celebration Park. Softball Coach
Bobby Roach spoke in favor of new ball fields and agreed with the Sternod's when they said it
would bring additional funds into Federal Way via tournaments and special games. John Metcalf
addressed the issue ofInitiative 164 once again and stated he was sorry for sounding like a broke
record; but suggested the Council to study the effects and impacts to the Citizens should it pass.
John Piquette gave a brief summary on the Arts Commission and it's happenings at this time; i.e.,
sale of T-Shirts and sweatshirts as well as updated flyers and a newsletter being in progress for
release in September and March of each year. Finally, the Commission has developed a mission
statement.

Item (h): Deputy Mayor Watkins suggested letters be addressed to both U. S. Senators
Murry & Gorton and Housemembers Tate and Dunn. The City Manager agreed. Deputy Mayor
moved to adopt item (h); second by Councilmember Dovey. Motion carried as follows:

Mr. Peter Jouflas requested the Council for a continuance of this agenda item to August IS, 1995.

ELECTION TO BE HELD ON NOVEMBER 7,1995, OF PROPOSITIONS AUTHORIZING mE CITY
TO LEVY A UTil.ITY TAX FOR mE PURPOSE OF PROVIDING FUNDS FOR TRAFFIC, STREET AND
PARK IMPROVEMENTS.
Mayor Gates conducted the first reading of Council Bill # 117. Councilmember Priest moved to
conduct enactment reading on August 15, 1995; second by Councilmember Dovey.
Council directed the City Attorney to make an amendment to Council Bill #117 to include the
appointment of an Oversight Committee, with a "no pre-existing relationship with government"
clause to be used in the appointment process.
Deputy Mayor Watkins made a motion to move the matter to enactment to August 15. The
motion, with the additional directive to appoint an advisory committee; second by Councilmember
Dovey. The motion carried as follows:

Council Bill # 118/ Adult Entertainment Amendment
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,
AMENDING THE ADULT ENTERTAINMENT CODE TO PROVIDE FOR A DEFINITION OF ADULT
ENTERTAINMENT, FINDINGS OF FACT, PROCEDURES FOR THE CLERK TO SUSPEND OR
REVOKE A LICENSE, INFORMATION REQUIRED IN ADULT ENTERTAINMENT LICENSES, AND
STANDARDS OF CONDUCT INCLUDING A MINIMUM FOUR FOOT SEPARATION
BETWEEN AN ENTERTAINER AND A PATRON (AMENDING ORDINANCE NO. 90-55 AND 92-129).
Mayor Gates conducted the first reading of Council Bill #118. Deputy Mayor Watkins moved to
conduct enactment reading on August 15, 1995; second by Councilmember Priest.
City Attorney Lindell briefed the Council on how the Ordinance came to be and explained
enforcement problems are largely a reason for the ordinance amendment. She stated it was the
least obtrusive means to ensure laws are enforced.
Detective James P. Covey addressed the Council regarding various problems at Deja Vu and
stated they are only getting worse. This amendment would allow uniformed officers to make
inspections.

VIII. CITY COUNCIL BUSINESS
a.
Celebration Park Estimate
Mr. Dees ofDees & Associates responded to Council inquiries.
Councilmember Priest stated he would like the matter continued to a date specific for additional
time to review materials and information.
Councilmember Gintz moved to approve the project cost estimate for Celebration Park as
recommended and to bid the full program upon voter approval (completion of the full program
will be limited to funds available), and to strike the portion to authorize of the City Manager to
immediately reallocate 1995 park CIP project savings to fund a negotiated contract for
construction drawings of Celebration Park; second by Deputy Mayor Watkins.

Councilmember Priest then proposed a substitute motion to defer the matter until August 15 for a
decision; second by Councilmember Dovey. The motion carried as follows:

Councilmember Gintz clarified and restated his motion to immediately approve the project cost

South King County Housing Forum
Councilmember introduced the Housing Chairman, Dave Daniels. Mr. Daniels invited the City
Council to I) entertain a motion to support and/or co-sponsor the event and 2) be present at the
Forum schedule for August 23, 1995 ITom 5:00 to 8:00 p.m.
Councilmember Elder made a motion for the City to co-sponsor the Forum and waive one half of
the $120 fee necessary to rent the Visitation Retreat and Cultural Center. Second by
Councilmember Gintz; discussion ensued.
Councilmember Priest moved to amend the main motion to authorize stafIto take $120 ITom an
appropriate fund and co-sponsor the event; second by Councilmember Gintz. The motion carried

Councilmember Priest moved for the approval to award the bid for the elevator project to the
lowest bidder, Baltic Design, Inc., in the amount of$ 77,699.00; second by Councilmember

IX.
CITY MANAGER REPORT
City Manager Nyberg announced Council was being furnished with the first of many reports re:
progress in the Police Services Department set-up updates and stated the report would come
monthly.
Mr. Nyberg stated a letter had been sent to all City Council candidates inviting them for briefings
if requested.
Finally, he made known an executive session was necessary and action may be taken.
X.
CITY COUNCIL REPORTS
Councilmember Park stated a city near Seoul, Korea is looking in our area for a sister-city.
Councilmember Priest announced future Land UselTransportation Committee Meetings are
scheduled for August 7 and August 21.
Councilmember Gintz reported Hachinohe groups come into town about once a month. City
Manager Nyberg announced there are several youth groups from Hachinohe visiting Federal Way
this month.

Councilmember Dovey announced the next regularly scheduled Parks and Recreation Committee
Meeting is set for August 14, 1995.
Councilmember Elder relayed the next Public Safety and Human Services Committee Meeting is
set for August 23, 1995.
Deputy Mayor Watkins spoke ofRCAA.
Mayor Gates requested the City Clerk notify all Councilmembers each time the City has visitors
from Hachinohe, and informed everyone today's date marked the second anniversary of our being
a Sister-City.
Mayor Gates made known appointments were necessary on two committees - AWC Employee
Benefits Advisory Committee and the Court Security Standards Task Force.
Councilmember Gintz moved to appoint Councilmember Priest to the Court Security Standards
Task Force; second by Councilmember Park. The motion carried as follows:

EXECUTIVE SESSION
Property AcquisitionIPursuant to RCW 42.30.110(b)
Mayor Gates reconvened the meeting at 9:15 p.m.
Deputy Mayor Watkins made a motion to enter into agreements for permanent easement and
supporting easement documents with Far East Investors and Robert L. Wright, providing a
purchase price of$132,358.62 for the Far East Parcel and $453,589.68 for the Wright Parcel
located in the vicinity of S. 336th Street and State Route 99 for the purpose of constructing a
regional storm water runoff control facility known as the Kitts Corner/So 336th Street Regional
Storage Facility. Second by Councilmember Elder. The motion carried as follows:
