CALL MEETING TO ORDER Mayor Gates opened the regular meeting of the Federal Way City Council at 7:02 p.m., in the Council Chambers, City Hall, Federal Way, Washington. City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Councilmembers Jack Dovey, Hope Elder, Ron Gintz, Skip Priest and Mike Park. City Staff present: City Manager Ken Nyberg, City Attorney Landi Lindell, City Clerk Chris Green and Deputy City Clerk Bob Baker. II. PLEDGE OF ALLEGIANCE Councilmembers Dovey and Park shared in leading the flag salute. ID. PRESENTATION ProclamationlPT A Membership Month Mayor Gates read the proclamation declaring September as "PTA Membership Month" in the City of Federal Way and presented the original to Ms. Susan Honda. Ms. Honda thanked the Mayor and encouraged citizens to get involved with and become active participants in the PTA for the good of the children. IV. CITIZEN COMMENT Mary Standfill, Steel Lake Little League representative, spoke to the Council regarding the impacts of the impending loss of five little league fields and one big league field currently leased by the Little League through the end of December, 1995; creating a loss for the kids of Federal Way, Auburn and Kent. She reported two attempts to purchase pieces of the property have been made. One attempt was unsuccessful and there has been no response to the most recent offer. She requested any assistance possible from the City Council to "keep the children off the streets." Mayor Gates, previously aware of the situation, informed Ms. Standfill she had written a letter in August, on behalf of Council, in support of the fields for the kids' use. The motion carried as follows: Gates Park Gintz Priest yes yes yes yes Watkins Dovey Elder yes yes yes Item (a): Deputy Mayor Watkins requested an expanded version of Item IX - CITY MANAGER REPORT, last paragraph, September 05, 1995, Regular Meeting Minutes, to read: "Mr. Roe gave a report of the Federal Way Citizen Task Force on RTA." Further, he wanted the minutes to note his objection "to the appointment of a task force without the approval of the full council. " With those inclusions, Deputy Mayor Watkins moved for approval of the minutes; second by Councilmember Gintz. Mr. Nyberg confirmed the application had been pulled which was made several months ago subject to his trip to Washington D.C., and his meeting with COPS personnel next week. The matter would be returned to Council for action/disposition at a later date; second by Councilmember Gintz. PUBLIC HEARING CABLE TELEVISION RATE ORDER Staff Report Citizen Comment Council Deliberation Resolution/Viacom/Establish Cable Television Rates & Charges APPROVED RESOLUTION NO. 95-217 Resolution/TCI/Establish Cable Television Rates & Charges APPROVED RESOLUTION NO. 95-216 Mayor Gates opened the public hearing at 7:15 p.m. Ms. Lindell made a brief presentation to Council and announced Lon Hurd was present to answer questions of a technical nature. Mr. Bill Short spoke briefly during Citizen Comment stating the Council should negotiate with Viacom to put C-Span I & II back into basic service without having to pay additional monies for it. Attorney Lindell confirmed with Mr. Hurd the City is prohibited from controlling programming. The City is, on the other hand, able to control rate regulation and a few other aspects of operation. Council held a brief discussion of the topic and Councilmember Gintz moved to approve Resolution Numbers 95-216 & 95- 217; second by Councilmember Dovey. CITY COUNCIL BUSINESS Council Direction on Transportation Issues Councilmember Priest stated the Land Use Committee, as a whole, met earlier today and made recommendations on the RTA and METRO 6-Year Plan correspondence from the City Council to the appropriate governing bodies. Further he called on Philip Keightley to briefly summarize the points to be contained in same. Mr. Keightley announced letters would be sent to the RTA Board relative to their issues and to the King County Executive and King County Council regarding the METRO 6-Year Plan. Vill. CITY MANAGER REPORT Mr. Nyberg announced an earthquake occurred in California this evening with a rating of 5.4 on the Richter scale. The epi-center was in China Lake, California. Mr. Nyberg informed Council the Adult Entertainment Ordinance recently appealed by Deja Vu was upheld in the 9th Circuit Court of Appeals. Mr. Nyberg asked Council for a motion authorizing him to inform King County of changes in the agreement regarding Police Services for 1996. The following motion was made by Councilmember Elder and second by Councilmember Gintz: "A motion authorizing the City Manager to notify King County that the City of Federal Way expects to reduce the number of King County Police Officers during the 1996 fiscal year, for the purpose of phasing in, or adding, Federal Way Police Officers to accomplish the effective and efficient transfer of police responsibilities to the City.» The motion passed as follows: Gates Park Gintz Priest yes yes yes yes Watkins Dovey Elder yes yes yes Mr. Nyberg mentioned a delegation from Hachinohe will be visiting the City on September 26, 1995, at 10:30 am. Mr. Nyberg reminded Council an executive session was necessary this evening. Mr. Nyberg relayed he would be in Washington D.C. next week to visit with four federal agencies regarding possible Federal support and possible support of a model the City has developed for Police Services. CITY COUNCIL REPORTS Councilmember Dovey noted a Parks/Recreation Committee meeting took place last week and the next meeting is set for October 16, 1995, at 8:00 a.m. He also announced the BPA Trail Dedication is set for October 22, 1995 at 1:30 p.m. Councilmember Elder announced the next Public Safety and Human Services Committee Meeting is set on October 5, 1995, with a presentation from the Human Services Commission re: recommended Funding. Deputy Mayor Watkins reported the U. S. House of Representatives Government Reform and Oversight Committee will hold a field hearing at Thomas Jefferson High School, on Friday, October 6, 1995, from 10:30 a.m. to 3:30 p.m. There will be an open-microphone period twice during that time. The subject is down-sizing and reorganizing government for the 21st Century. All are welcome to attend. Councilmember Gintz announced the next Finance/Economic Development Committee Meeting is set on October 28, 1995, @ 7:30 a.m. He stated his pleasure with the successes of the City regarding the issues of Deja Vu and Xotictan. He commended the City Attorney for her work. Councilmember Priest announced the next Land Use/Transportation Committee is set for October 2, 1995, at 6:00 p.m. He thanked the Committee for the time spent this week in meetings and thanked Councilmember Elder for attending same. Councilmember Park had no report. Mayor Gates thanked the Council for taking time to deal with RTA issues while in the middle of comprehensive plan work. She announced she'd be at the Seattle Center from 4 - 9:00 p.m. tomorrow, hearing comments from individuals and citizen committees in the region who will be making recommendations to the RTA. She informed council there is a gold-colored, painted rock in the Council Office from the Twin Lakes Elementary Students in thanks to the Council and staff for the support the City has provided in the project that was spearheaded by Congressman Tate in getting the Marines to make a field and a good walking area for the children at Twin Lakes Elementary School. X. At 7:53, Philip Keightley announced 05 additional minutes were necessary. At 8:12, Philip Keightley announced 10 additional minutes were necessary. At 8:21, Philip Keightley announced 05 additional minutes were necessary. The executive session recessed at 8:25 p.m. and no action was taken. XI.
