CALL MEETING TO ORDER
Mayor Gates opened the regular meeting of the Federal Way City Council at 7:02 p.m., in
Council Chambers, City Hall, Federal Way, Washington.
City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Councilmembers Jack
Dovey, Hope Elder, Ron Gintz, Mike Park and Skip Priest.
City Staff present: City Manager Ken Nyberg, City Attorney Londi Lindell, City Clerk Chris
Green, Deputy City Clerk Bob Baker.

Deputy Mayor Watkins led the flag salute.

CITIZEN COMMENT
H. David Kaplan announced a Book-Sale at the Federal Way Regional Library on October 21,
1995, from 10:00 a.m. to 5:00 p.m.; and October 22, 1995, from 1:00 p.m. to 5:00 p.m. He
also announced the annual work day for the Steel Lake Funland would be October 21, 1995,
unless rain occurs; in which case it would be rescheduled for one week. Finally, he informed
all present of the dedication of BPA Trail - Phase I - for Sunday, October 22, 1995, at 2:00
p.m. Ed Wilhelme, Sr. spoke regarding safety in the Brigadoon area in which he lives. He
would like to see lighting, sidewalks and some clean-up in that location. Jody Kirchberg
spoke of safety in the Dash Point Highland area. His daughter was struck, by car, three
weeks ago. He wants to see cross walks and school zones marked in appropriate areas and he
spoke in favor of forming the City of Federal Way Police Department. David Harrison spoke
of the increase in traffic in his area near 35th St. SW and voiced concerns for his school-aged
children. He supports the King County Police and stated it was now up to the City to do
something about these areas of concern for traffic safety. Mayor Gates responded to all who
spoke. She informed them Council was in agreement the area of 35th is "clearly high
priority" and noted they were aware of the other issues raised and stated they would not go
unnoticed.

Councilmember Dovey asked Jennifer Schroder to address item (b): Ms. Schroder brought a
memo before the Council outlining two additional amendment requests --ADA and hazardous
waste additions.

PRELIMINARY PUBLIC HEARING
Proposed 1996 City Budget/Citizen Comment
Mayor Gates declared the public hearing open for citizen comment at 7:23 p.m. Hearing no
comment from the public, she invited all to call or send comments regarding the budget and
declared the public hearing closed at 7:24 p.m.

CITY COUNCIL BUSINESS
a.
Proposed Human Services Funding Allocations
Councilmember Elder asked the Human Services Manager, Bonnie Olsen, to make a brief
presentation regarding the allocations. Ms. Olsen highlighted a few items contained in
Councils packets this evening regarding volunteer hours and 1996 contracts. Ms. Olsen
introduced Donna Manier to review overheads related specifically to Policy Statements.
Councilmember Elder moved to approve adoption of the proposed and forward
recommendation to the final budget process; second by Councilmember Gintz. The motion

Video Rentals/Failure to Return Leased Property
Mayor Gates read comments into the record of Ms. Lorie Peters.
Mr. David Aune, Owner, Videos & More, stated changes in law and/or procedure would
affect more than video rental stores. He cited statistics relevant to his operation regarding
cases being turned over to the prosecutor, denied rental applications; prices of movies and
monies spent/lost on a monthly basis.
Mayor Gates asked Londi Lindell to include rebuttal to Mr. Aune's statements in her briefing
to the Council. Ms. Lindell informed Council the Prosecutor's Office handles (approximately)
1200 cases per month; stated the filing fee is $60 per case and public safety is number one in
the area of importance. Ms. Lindell assured Council there are other ways for store owners to
recoup monies. She explained to Council they could take any of three actions this evening.
They could I) Take no action; 2) Repeal the Federal Way City Code Sec. 6-161(3) or 3)
Adopt a Charging Policy.

Discussion was held and Deputy Mayor Watkins moved to repeal Federal Way City Code
Section 6-161(3); second by Councilmember Elder.

VII.
CITY MANAGER REPORT
Mr. Nyberg informed Council he had completed the Civil Service Commission interviews and
a press release would be done by Friday, October 20, 1995, informing the public of his
decision.
He also notified Council the Mayor of Hachinohe will be in Federal Way on November 27
and 28, 1995, signing an agreement between the Ports of Tacoma and Hachinohe. The City
of Federal Way was complimented on their assistance in this endeavor.
Finally, he reminded Council a 12-minute executive session was necessary.
VIII. CITY COUNCIL REPORTS
Councilmember Dovey announced a ParkslRecreation Committee Meeting is set for 10/23/95
at 8:00 a.m. and the BPA Trail - Phase I - Dedication is set for 10/22/95 at 2:00 p.m.
Councilmember Elder announced a Public Safety/Human Services Committee Meeting is set
for 11/2/95 at 7:30 a.m. She also announced Mayor Gates is a finalist for the Stars of the
Commercial Real Estate Industry under the Public Officials category. She attended a
SKATEBRD meeting this morning and had two pieces of information. First, a bus route
from Federal Way to the Super Mall, in Auburn, will run on its way to Green River
Community College and second, the Pedestrian Movement at SeaTac Airport is moving ahead.
Deputy Mayor Watkins will represent the City at the next ACC Meeting on 10/18/95.
Councilmember Gintz announced the next Finance Committee Meeting is set for 10/26/95 at
7:30 a.m. and the Seattle Mariners lost this evening 0-4.
Councilmember Priest announced the next Land Use Committee Meeting is set for 11/6/95 at
6:00 p.m.
Councilmember Park announced the Celebration of Korean Independence event will take place
on 10/21/95 at the University of Washington at 7:00 p.m. Music and performances by
Chinese, Japanese & Korean community groups will be enjoyed and tickets are $12.00

Mayor Gates informed everyone the City of Federal Way received a Certificate of
Appreciation from the Chairman of the Emergency Feeding Program based on an earlier
proclamation signed by Mayors from around the Puget Sound region. She presented
Councilmember Priest with a list of hearing opportunities for public involvement regarding
PublicIPrivate Initiatives.
Councilmember Elder recalled one final item. She will accompany Saeid Daniari to receive
an award from AAA for traffic safety on October 20, 1995.
Finally, Mayor Gates announced a 12-minute executive session and recessed the Regular
Meeting at 8:27 p.m.

ADJOURNMENT
Mayor Gates closed the executive session at 8:36 p.m.
There being no further business to come before the Council, Mayor Gates adjourned the
regular meeting of the Federal Way City Council at the hour of 8:37 p.m.
