MINUTES
I.
CALL MEETING TO ORDER
Mayor Gates opened the regular meeting of the Federal Way City Council at 7:00 p.m., in
Council Chambers, City Hall, Federal Way, Washington.
City Council present: Mayor Mary Gates, Deputy Mayor Phil Watkins, Councilmembers Jack
Dovey, Hope Elder, Ron Gintz, Mike Park and Skip Priest.
City Staff present: City Manager Ken Nyberg, City Attorney Londi Lindell, City Clerk Chris
Green, Deputy City Clerk Bob Baker.

Members of Boy Scouting Troop No. 361 led the flag salute.

PRESENTATIONS
a.
ProclamationlKey Club Week
Mayor Gates read and presented an original proclamation to Matt Longhurst, Decator High;
Angela Chung Federal Way High; and Julie Nguyen, Thomas Jefferson High School.
proclaiming the week of November 5 - 11 "Key Club Week." Bob Munroe thanked the
Council for the recognition on behalf of the Kiwanis Club.
b.
Proclamation/Scouting for Food
Mayor Gates read and presented an original proclamation to a Boy Scout Master declaring
Scouting For Food Week to be November 11 - 18. The representative thanked the audience
and encouraged participation.

AAA Pedestrian Safety Citation
Council member Elder and Saeid Daniari shared the AAA Safety Award with Council and the
audience. Mr. Daniari shared with Council some of the projects which led to receiving the
award. He thanked Council and Mr. Nyberg for continued support.
d.
Introduction & Presentation/Civil Service Commissioners
City Manager Nyberg announced another history-making event. The City of Federal Way has
its first Civil Service Commission. The following persons were introduced and presented with
Certificates of Appointment: Lorraine Lee, Deborah McCormick, Forrest Niccum and Glen
Whitham. An alternate was also introduced: Karl Grosch. Pam English, Commissioner and
Dave Froyalde, Alternate, were not present.
IV.
CITIZEN COMMENT
Student, Jeremy Fredenberg, is concerned with safety issues around Thomas Jefferson High
School. He would like to see a cross-walk, stop lights and/or speed limit signs in that area.
Mayor Gates informed all present she would forward the comments to the King County
Council as it is outside the City limits.
School Board Member, Gail Pierson, thanked the Council for considering the School Impact
Fee Ordinance and urged them to adopt the same.
Carol Whitney blamed the Council for the re-zoning issues being considered for la-acre
parcel located at the western end of SW 320th at 47th/Hoyt Road. She has a signed petition
speaking out against the rezoning of this piece of land from professional office to multi-
family use. The Mayor asked the Clerk to provide copies of the petition to her after the
meeting.
Andrew Larpenteur, Tom Johnson, Selena Hughes, Samuel Salame, David Coffee, Pat
Westerkamp, Carolyn Lake, Bruce Creager, Len Schaadt and Kelly & Roger Johall all spoke
against re-zoning the area.
Dan Dennis, Larry Brader and John Gibson spoke against Accessory Dwelling Units and the
Ordinance related thereto.
Jim Knannlein, Kent Faber and Rick & Delores Schwartz spoke in favor of Accessory
Dwelling Units.
H. David Kaplan presented written notes in his absence regarding Section 2.12 of the City's
Comprehensive Plan. The deputy clerk was instructed to provide copies to Council.

Dietrick Jones, Shirley Charnell and Jeanne Burbidge all spoke regarding the Comprehensive
Plan. He spoke on behalf of the Historical Society. The society believes there is no
statement of implementation for the comprehensive plan and their issues. A statement of
Implementation, in their opinion, is necessary to enforce policies which are set forth in the
plan and suggests Council come up with an implementation clause to decrease vacillation in
some of the policies.

Councilmember Priest pulled this item and moved to approve the appointment of the
following persons to the Planning Commission: Luana Joslin, Todd Suchan and Tim Carr.
Brian Johnson, proposed alternate, will also be named a commissioner as Duane Denny
submitted his written resignation to the Mayor today. Further, he moved the commissioners
begin after a task-certain as opposed to a date-certain. In this case, the new commissioners
shall begin their term after completion of the non-residential portion of the comprehensive
plan; second by Councilmember Watkins. The motion carried as follows:

Mayor Gates urged attendance of the new members to all meetings until such time as they are
serving.

Council Bill #122/Accessory Dwelling Units
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
WASHINGTON, AMENDING THE FEDERAL WAY ZONING CODE CHAPTER 22 BY
ADDING DEFINITIONS TO SECTION 22-1 RELATING TO ACCESSORY DWELLING
UNITS ("ADUs"), PRIMARY DWELLING UNITS AND SINGLE HOUSEKEEPING UNITS,
ALLOWING ADUs IN CITY OF FEDERAL WAY RESIDENTIAL ZONES AND
PROVIDING FOR LEGAL NONCONFORMING ADUs.

A NEW TITLE TO THE FEDERAL WAY CITY CODE AUTHORIZING THE
COLLECTION OF SCHOOL IMPACT FEES; PROVIDING FINDINGS AND DEFINITIONS;
PROVIDING FOR IMPACT FEE PROGRAM ELEMENTS AND FEE CALCULATIONS;
PROVIDING FOR FEE ASSESSMENTS; PROVIDING FOR EXEMPTIONS, CREDITS,
APPEALS, AND INDEPENDENT USES OF FUNDS, AND REFUNDS; AUTHORIZING AN

VIII. CITY MANAGER REPORT
Mr. Nyberg announced the City facilities would be closed on Friday, November 10, 1995.
Mr. Nyberg also announced the search for a Police Services Director has been narrowed to 15
people and background checks were being done at this point. Further, he stated the City is on
schedule in their search and should have a director by the end of January, 1996.
IX.
CITY COUNCIL REPORTS
Councilmember Park had no report.
Councilmember Priest announced the Land Use/Transportation meeting for November 6 was
canceled and the next meeting is set for November 20, 1995.
Council member Gintz announced the Finance Committee meeting has been reset from
November 16, 1995 to November 28, 1995.
Councilmember Dovey announced the next ParkslRecreation Committee meeting is set for
November 13, 1995.
Councilmember Elder announced the next Public Safety/Human Services Committee Meeting
is set for December 7, 1995.
Deputy Mayor Watkins announced representatives from the ACC and their law firm will be
meeting with Council.
Mayor Gates reminded Council of the Budget Special Session on November 9, 1995 from 12-
6 p.m. and November 14, 1995 with an invitation to Viacom as Council is to do a TV
Commercial that day for the upcoming holiday season. Finally, she announced the flowers on
the dias were presented to each Council member from Councilmember Elder.

ADJOURNMENT
There being no further business to come before the Council, Mayor Gates adjourned the
regular meeting of the Federal Way City Council at the hour of 8:41 p.m.
