Council MIN 11-05-1996 Regular FEDERAL WAY CITY COUNCIL Regular Meeting Council Chambers - City Hall November 5, 1996 - 7:00 p.m. MINUTES I. CALL MEETING TO ORDER Mayor Priest opened the regular meeting of the Federal Way City Council at 7:06 p.m., in Council Chambers, City Hall, Federal Way, Washington. City Council present: Mayor Mahlon "Skip" Priest, Deputy Mayor Hope Elder and Councilmembers Mary Gates, Phil Watkins, Jack Dovey, Michael Park and Ron Gintz. City staff present: City Manager Ken Nyberg, Deputy City Manager Philip Keightley, City Attorney Londi Lindell, City Clerk Chris Green and Deputy City Clerk Bob Baker. II. PLEDGE OF ALLEGIANCE Councilmember Mary Gates led the flag salute. III. PRESENTATION K¡:y Club Proclamation Mayor Skip Priest read the proclamation which recognizes Key Club Internationals Key Club Week, November 4-8. Federal Way, Decatur & Thomas Jefferson High Schools were presented with original proclamations. Bob Munroe introduced Key Club Presidents from the named schools and other visiting members. IV. CITIZEN COMMENT Diane Sweeney read a letter she wrote to Council opposing proposed cuts to the arts. H. David Kaplan thanked many people for their contributions to the development and cleaning of city parks and the Council for earnestly deliberating the City's budget. He stressed the importance of increased street-overlay projects, restoring a Parks Maintenance position, less of a reduction in outreach and human services funding. Sue Middleton spoke against cuts to the arts, Parks and human services. She said, "raise taxes," but don't take away services. Peter Townsend spoke in favor of continued funding toward the fight of the third runway, via the ACC, in the ORIGINAL CITY COUNCIL REGULAR MEETING MINUTES November S, 1996 - Page 2 of 7 amount of $100,000.00. Joan Tabrum invited all to attend the 5th Annual Federal Way Community Concert on Sunday, November 10, 1996, at 2:00 p.m. in the Decatur High School Gymnasium. Tom Taylor spoke in favor of raising taxes and increasing services. Richard Emerson, Deanna Emerson, Larry Van Schoiack and Bob Halverson spoke in support of Christmas Village. The motion carried as follows: Priest Gates Gintz Dovey yes yes yes yes Elder Watkins Park yes yes yes Item E: HUMAN SERVICES COMPREHENSIVE PLAN APPROVAL Councilmember Park presented a brief history of the compilation process used to create the City's first Human Services Comprehensive plan and recognized the efforts of those who have worked on the plan, including Human Services Manager, Ann Guenther. He then MOVED TO APPROVE THE ITEM AS PRESENTED TO THE COUNCIL; second by Deputy Mayor Elder. The motion carried as follows: Priest Gates Gintz Dovey yes yes yes yes Elder Watkins Park yes yes yes Item F: COUNCIL BILL #151/METRICOM FRANCHISE COUNCILMEMBER GINTZ MOVED TO POSTPONE SECOND READING/PASSAGE OF THE ORDINANCE UNTIL THE NOVEMBER 19, 1996, REGULAR COUNCIL AGENDA; second by Councilmember Gates. Discussion ensued. A conference call is scheduled between City Attorney Lindell and Metricom on November 13 to address concerns regarding some language contained in the proposed contract. If the issues are resolved, the item will be brought back to full Council for enactment on the November 19 regular meeting agenda. If the issues are not resolved, the item will be returned to the Finance/Economic Development Committee for further discussion. GMPC/Shared Commitment Funding Pro¡¡ram for Affordable Housin¡¡ Councilmember Park introduced Ms. Lori Michaelson, City Planner, who made a brief presentation to Council. Mr. Art Sullivan, program manager for ARCH, also gave an overview of the Shared Commitment Program and thanked the Council and staff for their efforts. Mr. Sullivan highlighted some major changes and summarized the key issues surrounding the program. Further he answered several questions and addressed concerns of the Council. COUNCILMEMBER HOPE ELDER MOVED TO SEND A LETTER TO SUBURBAN CffiES ASSOCIATION, ACCEPTING THE GMPC MOTION IN GENERAL, AND EXPRESSING COUNCIL RESERVATIONS WITH RESPECT TO: I) THE VOLUNTARY NATURE OF THE PROGRAM BEING PRESERVED ON A PERMANENT BASIS; 2) THE COUNCIL SEEKS ASSURANCE THAT JURISDICTIONS WILL NOT BE PENALIZED IN ANYWAY, ON THE BASIS OF NON-PARTICIPATION AND 3) THE COUNCILS DESIRE FOR THE PROVISION OF HUMAN SERVICES BEING ENSURED WITH PRODUCTION OF AFFORDABLE HOUSING INFRASTRUCTURE; SPECIFICALLY, THE NEEDS, AVAILABILITY AND AFFORDABILITY OF SUCH SERVICES ARE INCORPORATED INTO THE OVERALL ANALYSIS AND SELECTIONAL CRITERIA FOR INFRA- STRUCTURE PROJECT APPROVAL; second by Councilmember Gintz. COUNCILMEMBER WATKINS MOVED FOR COUNCIL TO APPROVE THE PLAN AS PRESENTED; second by Councilmember Gintz. Much discussion ensued. COUNCILMEMBER GINTZ MOVED TO MODIFY THE PRIORITY LIST BY COMBINING ITEMS #5 & #7; second by Councilmember Dovey. CITY MANAGER REPORT City Manager Nyberg announced a draft City video is available for review and city staff contact on this is Dena Laurent. Mr. Nyberg also reviewed the budget deliberation calendar. IX. CITY COUNCIL REPORTS Councilmember Park reported a Public Safety/Human Services Committee Regular Meeting on November 21 at 4:30 p.m. Councilmember Watkins reported a AWC Legislative Committee Meeting November 15; Land Use/Transportation Committee Regular Meeting November 18 at 5:30 p.m. CITY COUNCn.. REGULAR MEETING MINUTES November S, 1996 - Page 7 of 7 Deputy Mayor Elder reported a State Law & Justice Meeting November 7 Councilmember Dovey reported a Parks & Recreation Committee Regular Meeting to a rescheduled date of November 12 at 8:00 a.m. Councilmember Gates reported a special Board Meeting of Suburban Cities Association with a report on the Regional Governance and Finance Issues -- the ongoing study on the division of services between local and regional issues. Information relative to tunnel hour openings, previously discussed by Seattle City Council/Suburban Cities Association, has been placed in Councils' mail boxes and is reportedly being discontinued. The Suburban Cities Association General Membership meeting will take place on November 13 wherein the emerging issue of driving without a valid license will be discussed. Although still in draft form, the legislative agenda is slated to be adopted at that meeting. Mayor Priest reported the potential conflict of interest with Mr. Watkins serving as ACC representative; Mr. Watkins' desire to be relieved of his duties relative thereto and appointed Deputy Mayor Elder to fill the unexpired term. At 8:30 p.m., Mayor Priest recessed the regular meeting and Council went into executive session with no action anticipated. X. EXECUTIVE SESSION a. b. Evaluate Complaints or Charges/Pursuant to RCW 42.30. 110(t) Evaluate Qualifications of a Candidate/Pursuant to RCW 42.30. 110(g) At 9:00 p.m., City Manager Nyberg reported another :15 minutes were necessary. XI. ADJOURNMENT Mayor Priest reconvened the regular meeting. No action was taken from the executive session.
