CALL MEETING TO ORDER Mayor Priest opened the regular meeting of the Federal Way City Council at 7:05 p,m., in Council Chambers, City Hall, Federal Way, Washington. City Council present: Mayor Skip Priest, Deputy Mayor Hope Elder, Councilmembers Jack Dovey, Mary Gates, Ron Gintz, Michael Park, Phil Watkins. City Staff present: City Manager Ken Nyberg, City Attorney Londi Lindell, City Clerk Chris Green. II. PLEDGE OF ALLEGIANCE Councilmember Gates led the flag salute. ill. PRESENTATIONS a. Group Recognition! Arts Program Contract for Services Councilmember Gintz recognized representatives from the Federal Way School District, Federal Way Philharmonic, Federal Way Chorale, Federal Way Community Council, Jet Cities Chorus, King County Library System, Federal Way Symphonic Band, pzazz and Puget Sound Musical Theatre. b. Special Commendation to Major Bob Evans, Outgoing Federal Way Police Chief Deputy Mayor Elder recognized Major Evans for his dedication to the City and Councilmember Park presented a plaque of appreciation. c. Special Commendation to Mark Freitas, Outgoing Planning Commission Chair Councilmember Watkins recognized Mark Freitas for his outstanding work on the Planning Commission, as both a member and chair, and presented him with a certificate of appreciation. d. Special Commendation to Joan Tabrum, Outgoing Arts Commission Chair (added) ORIGINAL FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES March 19, 1996 - Page 2 As an added item, Mayor Priest thanked Joan Tabrum, outgoing chair of the Arts Commission, for her service to the City, and Councilmember Gates thanked her for providing the English translation of the sister city song. IV. CITIZEN COMMENT Bob Piquette, as a volunteer at King County Police Precinct #5 the past five years, thanked Major Evans and his staff for their programs and service to the community. Marilyn Rogers of the Jet Cities Chorus thanked the Council for providing grant monies. Doug Johnson, President of Federal Way Philharmonic, thanked the Council and Arts Commission for their continued support of special events such as Family Fest. Sam Barker of the Puget Sound Musical Theater and Federal Way Chorale thanked the Council and urged support for a local performing arts facility. Tom Anderson, President of the Federal Way Symphonic Band, thanked the Council for their continued support. Don Barrows, Conductor of the Federal Way Chorale, thanked the Council for their support. Linda Hendrickson of the Federal Way School District thanked the City for summer arts funding and partnering with the School District for parks and parks security. Elaine Taylor thanked the Council and Arts Commission for the continued support of the Federal Way Coalition of the Performing Arts, and reported all the groups coming before Council tonight have started raising funds for a performing arts center. Alan McEachern, Boardmember of the Puget Sound Musical Theater, thanked the Council for their continued support. Larry Nordberg, 2nd Vice-President of the Federal Way Community Council, thanked the Council for supporting the arts; he opposes the City's sign code and feels the City should find funding to assist small businesses for sign costs. Mary Jo Torgeson, Manager of the 320th Street Library, thanked the Council for their support of the recent successful Korean celebration. CITY COUNCIL BUSINESS Motion by Councilmember Gintz to add an item to Council Business, in order to appoint the newly selected Arts Commissioners; second by Councilmember Watkins. Arts Commission Appointments (added) Councilmember Gintz explained that six of the seven Councilmembers were present earlier in the day to interview the Arts Commission applicants, and have concurred to make the appointments at this time. Motion by Councilmember Gintz to appoint the following Arts Commissioners and set their terms: Joann Piquette, Bob Ratcliff, Michael Martin and Donna Roe for terms ending 3/31/99; David Campbell for term ending 3/31/98; Peggy LaPorte (first alternate) and Pat Curran (second alternate) for terms ending 3/31/99; second by Council member Gates. Regional Issues Mayor Priest explained there are a number of regional issues which have been identified and that Councilmember Gates will be the lead in that area. Motion by Councilmember Gates to approve the proposed schedule, as outlined above; second by Deputy Mayor Elder. A copy of the legislative information and agenda formation process is attached hereto as "Exhibit A". Motion by Councilmember Gates to approve the proposed timeline and process for the City's Annual Legislative Agenda, as reflected in "Exhibit A"; second by Councilmember Dovey. CITY MANAGER REPORT City Manager Nyberg announced the schedule for tomorrow's city visit by King County Executive Gary Locke. In response to the Council direction to institute a communication plan for the City, staff has distributed a communications plan with a schedule of actions for the implementation of voice mail, city-generated and maintained homepage, cable community calendar and faxback. For the upcoming Youth Recognition Week, there will be a dedication of the "Stop the Violence" Mural #2 on April 22, and on April 24, at 7:30 p.m., there will be a Youth Recognition Night. Mr. Nyberg requested an executive session to discuss potential litigation, with action expected. FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES March 19, 1996 - Page 6 IX. CITY COUNCIL REPORTS Councilmember Gintz reported the next meeting of the Finance/Economic Development Committee will be March 28, at 7:30 a.m. CouncilmemberPark attended yesterday's meeting of the King County Jail Advisory Committee; it was reported that the jail population has increased dramatically, which reflects in additional costs to cities. The next regular meeting of the Public Safety/Human Services Committee is scheduled for March 21, at 4:30 p.m. Councilmember Watkins reported the next meeting of the Land Use/Transportation Committee is scheduled for April 1, at 5: 30 p. m., which meeting will be the first of three joint meetings with the Council of Whole to review non-residential code amendments, zoning maps and design standards. Recommendations coming out of these future meetings will be forwarded to the Planning Commission. He and Mayor Priest attended yesterday's meeting of the Aviation Sub- Committee of the U.S. House of Representatives, which met on the third runway issue in the City of Des Moines; he thanked Mayor Priest for speaking out so effectively as a witness on behalf of our City. Deputy Mayor Elder reported on her recent trip to the National League of Cities conference held in Washington, D.C., and will provide a more detailed report at committee level. She currently serves on the Public Safety/Crime Prevention Policy Committee for NLC, and has now been appointed to AWC's Juvenile Crime Board, After returning from Washington, D.C., she attended Washington State's Law and Justice Advisory Council and has made application to Senator Adam Smith for appointment to that council. While at the NLC Conference, she attended the Leadership Institute Training, where she received a door prize, on behalf of the City, which provides the registration fee for the next Leadership Conference. She attended and reported on this morning's SCATBd meeting--the focus of the discussion being bus service to South County areas, including Renton, Kent, Auburn and Federal Way. Councilmember Dovey said the Parks/Recreation Committee just had a timely meeting to discuss King County's proposed $215 million bond issue focused toward salmon, children and open parks; there will be a public hearing scheduled in Auburn for March 28 and another in Federal Way on April 8, which will allow citizen and City Council input. Parks Director Jenny Schroder reported she has received an application form to submit the city's projects. Councilmembers expressed their concern as to the actual benefit afforded the City by the County's proposed bond issue, especially after rejection of our parks bond last year. Councilmember Gates said she chaired last Wednesday's SCA on the County's proposed bond, at which time they took the position that until five basic questions were addressed, SCA would not support the bond. Appropriate discussion should center on how to protect the habitat, not FEDERAL WAY CITY COUNCIL REGULAR MEETING MINUTES March 19, 1996 - Page 7 let's go to a bond issue for parks without examining other issues! There was also a concern that King County would not be required to provide their application until after the bond issue is passed when other jurisdictions are being asked to submit theirs at this time--the double standard is not acceptable! Councilmember Gates reported that one agenda item from SCA is an amendment to the King County Charter to change the timing for appointment of a Redistricting Committee to redraw council districts from once every five years to ten years. There is concern that as populations shift, those districts may not be representative over a ten-year period. As informational to Council--there will be a drug court presentation at SCA on April 10; and, there will be a draft plan for the RTA on Friday; she will attempt to answer any questions that may arise. x. EXECUTIVE SESSION Potential Litigation/Pursuant to RCW 42.30. 110(i) Mayor Priest recessed the regular meeting at 8:20 p.m., and announced a one hour executive session to discuss potential litigation, with the possibility of action being taken at the conclusion of the session. At 9:20 p.m., Mr. Keightley announced a continuation of the executive session for an additional fifteen minutes. Mayor Priest adjourned the executive session at 9:35 p.m" and reconvened the regular meeting. Motion by Councilmember Dovey to direct the City Attorney to settle the contract claim made by Paul Brothers, Inc, against the City regarding construction of improvements at Adelaide Park by disbursing that portion of the remaining Adelaide Park project budget equal to $55,000, plus any interest which has accrued in the retainage account, which payment shall constitute the full and complete satisfaction of Paul Brothers, Inc's claims under Public Works contract No. 93- 104, including without limitation, its claims for any contract balance, retention and/or sales tax; second by Councilmember Watkins. A second motion by Councilmember Watkins to instruct the City Manager to execute an agreed order in connection with the quiet title action filed against the City by William A. Looney under King County Superior Court Cause No. 95-2-31591-7, which order shall state that the easterly half of that portion of 9th Avenue SW in Federal Way, between Lots 24-29 of the Kenwood Addition, has been vacated by operation of law pursuant to RCW 36.87.090; second by Councilmember Gintz. Issues for. the City's Annual Legislative Agenda. This schedule puts the City in a more proactive position to obtain support on issues of importance to Federal Way prior to each Legislative Session. February/March Continued briefings for City Council committees. Briefings would cover topics relevant to each Committee's area of responsibility. April Presentation to Regional Affairs Committee on just-completed Legislative Session Summary and Potential Issues for the next Legislative Session. Presentation made by staff and A WC. April Develop and approve Federal Way Priority Issues as resolutions for consideration by A WC's Resolutions Committee. April/May Attend Resolutions Committee meeting to present resolutions. (A WC Resolutions Committee dates are set for April 23 and May 10 in 1996.) June Attend Resolutions Committee meeting at Annual A WC Conference in the Tri-Cities. Participate in resolutions voting during Conference. (Dates for 1996 have been set for June 11-14 in Pasco.) September- November Attend A WC Legislative Committee meetings where A WC Resolutions are reviewed as potential A WC Legislative Agenda topics.
