MINUTES
I.
CALL MEETING TO ORDER
Mayor Priest opened the regular meeting of the Federal Way City Council at 7:00 p.m., in
Council Chambers, City Hall, Federal Way, Washington.
City Council present: Mayor Mahlon "Skip" Priest, Deputy Mayor Hope Elder, Councilmembers
Mary Gates, Phil Watkins, Jack Dovey, Ron Gintz and Michael Park.
City Staff present: City Manager Ken Nyberg, City Attorney Landi Lindell, City Clerk Chris
Green and Deputy City Clerk Bob Baker.
II.
PLEDGE OF ALLEGIANCE
Councilmember Michael Park led the flag salute.
III.
PRESENTATION

Deputy Mayor Elder proclaimed the month of May 1996, to be "Asian/Pacific American Heritage
Month" in Federal Way, and encouraged all residents to join in recognizing and celebrating the
many contributions of Asian and Pacific Americans to our community. Present to receive the
proclamation was Ross Papa, of the Federal Way Diversity Commission, He thanked the Council
for the proclamation and said thank you to the City Council and staff. David Della, Executive
Director for the Washington State Commission on Asian/Pacific-American Affairs, was also
present and stated he was pleased with the presentation of the proclamation and also stated the
Asian community members make a good portion of the City and are vibrant, intelligent, hard-
working individuals.

Mayor Priest announced the week of May 5 - 11 marks the 27th Annual Municipal Clerks Week.
The week officially recognizes the essential role clerks play in local government. The position
of clerk is one of governments oldes positions and they playa central and vital role in
government. Clerks are often described as the "hub of the wheel" in many jurisdictions.

Further, he publically acknowledged City Clerk Chris Green and Deputy City Clerk Bob Baker
and thanked each of them for their contribution to the success of our city.
IV.
CITIZEN COMMENT
Bob McKenzie spoke in opposition to gated communities and urged the Council to vote against
such a motion,

Dena Laurent spoke of suggested A WC resolutions as contained Council agenda packets this
evening. She reviewed and discussed, with Council, the resolution pertaining to Powers &
Standards of Review Used by Growth Management Hearing Board.
COUNCILMEMBER PHIL WATKINS MOVED TO DELETE THE FIRST BULLET, UNDER
THE RESOLUTION ENTITLED, "SUPPORTING PRACTICAL SOLUTIONS TO LAND USE
REGULATIONS ISSUES;" second by Councilmember Jack Dovey. The motion carried as

COUNCILMEMBER PHIL WATKINS MOVED TO APPROVE ALL SEVEN (7) PROPOSED
RESOLUTIONS AS PRESENTED; second by Councilmember Ron Gintz, The resolutions are:
1, Creation of Local Hotel/Motel Tax Options, 2. Opposing Unfunded Mandates, 3. Pertaining
to Powers and Standards of Review Used by Growth Management Hearing Boards, 4, Sales Tax
Exemption for Public Park and Public Cultural Arts Facility Construction, 5. Supporting
Continued Criminal Justice Funding, 6. Supporting Practical Solutions to Land use Regulations
Issues and 7, Transportation Funding Options for Local Governments,

Councilmember Gates spoke of a possible emerging issue being that of the financial impact on the
city budget, when an area which has been annexed generates less revenue than it costs to provide
the service to that area,
VIII. CITY MANAGER REPORT
City Manager Nyberg spoke of a May 8, 1996, 2:00 p.m., meeting with the Consul General of
Korea, Mayor Priest and City Manager Nyberg.
The current months report (update) on the Public Safety Department was distributed.
A reminder was given for the Transportation Forum, set for 5/14/96 at 6:30 p.m., in Council
Chambers.
Major Jackson Beard was introduced as the new Commander of Precinct 5. He spoke of his prior
work experience and stated his great love in life was his wife and 5 children.
An executive session is necessary this evening and is slated to last approximately 60 minutes with
action expected.
IX.
CITY COUNCIL REPORTS
Council member Gates thanked the City Council for working hard during tonights RTA
presentation. She distributed written reports which included a memo regarding transit fares issues,
a copy of a Seattle Times article regarding zone fares, another article regarding health issues, an
RT A Outreach Summary, a PSRC Board memo and an emerging issues article, She spoke of the
May 14, 1996, Transportation Forum and encouraged all Council members to be present.
Councilmember Dovey announced the next Parks/Recreation Committee Meeting is set on May
13, 1996, at 8:00 a,m., where they will discuss such items as Family Fest and trail issues,
Deputy Mayor Elder reported she'd spent time observing Drug Court and was quite impressed
with it and how it functions,
Councilmember Gintz announced the next Finance/Economic Development Committee Meeting
is set for 5/23/96 at 7:30 a.m.
Councilmember Watkins announced the Next Joint LUTC/CC of Whole meeting is set for
5/13/96, at 5:30 p.m.

Councilmember Park announced the PSHS Committee meeting set for 5/16/96 has been reset to
5/23/96 at 4:30 p.m., in Council Chambers.
Mayor Priest recessed the regular meeting at 7:53 p.m. to go into executive session.

At 8:57 p.m., Mayor Priest reconvened the regular meeting.
COUNCILMEMBER RON GINTZ MOVED TO INSTRUCT THE CITY MANAGER TO
DIRECT THE CITY ATTORNEY TO FILE SUIT AGAINST SONNY'S CASINO, INC., AND
ALL OTHER NECESSARY PARTIES, IN ORDER TO OBTAIN JUDGMENT ON A
PROMISSORY NOTE EXECUTED BY SONNY'S CASINO TO SECURE PAYMENT OF
UNPAID GAMBLING TAXES; second by Councilmember Deputy Mayor Hope Elder. The
motion carried as follows:
