MINUTES
I.
CALL MEETING TO ORDER
Mayor Priest opened the regular meeting of the Federal Way City Council at 7:05 p.m., in
Council Chambers, City Hall, Federal Way, Washington.
City Council present: Mayor Mahlon "Skip" Priest, Deputy Mayor Hope Elder, Councilmembers
Mary Gates, Phil Watkins, Jack Dovey, Ron Gintz and Michael park.
City Staff present: City Manager, Ken Nyberg, City Attorney Londi Lindell and Acting City
Clerk Bob Baker.

PLEDGE OF ALLEGIANCE
Boy Scout Troop 361 led the flag salute.
Councilmember Mary Gates announced Girl Scout Troop 1345 was visiting and she invited them
to return in the future to lead the flag salute.

Councilmember Jack Dovey introduced and presented certificates to the following Parks &
Recreation Commissioners: Karl Grosch, Barbara Reid and Jerry Bollen, Alternate Marion
Bartholomew received his certificate and Dini Duclos, another alternate, was not present.
IV.
CITIZEN COMMENT
Maria Margaris, owner of Hearthstone Condominium unit 1818C, spoke of the increased crime
(break-ins, domestic violence, meth. labs) at the nearby Windsor Court complex. Mr. Margaris
spoke on behalf of several Hearthstone home owners who asked the Council for whatever
assistance they may be able to render. Mayor Priest informed Ms. Margaris a City staff member
would contact her to discuss the matter in greater detail.

Herb Pollinger, President of the Community Council, announced plans have been made for
Family Fest '96 which include a parade and Scout-a-Rama.
Art Warner and Ron Buckner, leaders with the Boys Scouts of America, spoke in favor of the
upcoming Scout-a-Rama as part of Family Fest '96 and thanked the Parks & Recreation
Department, in advance, for allowing the sleep-out.

Item...(h}: Councilmember Dovey pulled this item for review with Council. The memorandum
includes the approval for the Boy Scouts of America to participate in a Scout-a-Rama as part of
Family Fest '96. Additionally, it provides authority for the scouts to camp overnight in Steel
Lake Park as part of the Scout-a-Rama experience. Overnight activity is normally prohibited
according to city ordinance. Administratively, Ordinance 91-82 states that exceptions may be
granted by the Department Director to allow sleep overs. Parks and Recreation Director Jennifer
Schroder approves and grants same. Finally, the memorandum will cover Scout-a-Rama as a
vendor to Family Fest and subjects them to comply with the necessary insurance requirements and
any other permits that may apply to its program. COUNCILMEMBER DOVEY MOVED

Councilmember Gintz inquired and was informed of the July 9,1996, Hearing Examiner's hearing
date and asked if it could be rescheduled to late Mayor early June. The City Attorney and City
Clerk's offices agreed to work together to arrive at an earlier date.
VII. CITY MANAGER REPORT
City Manager Nyberg announced the receipt of a 3-year grant in the amount of $ 1.4 million for
the establishment of the new police department. He announced the May 23, 1996, Tacoma/Pierce
County Economic Development Board Meeting scheduled to begin at 12:00 p,m. He introduced
Tom Chaney, one of two new Deputy Police Chiefs for the City of Federal Way. Mr. Chaney
thanked the City Manager and Council for the warm welcome and stated he looked forward to
serving the City and working in a brand new police department. Mr. Nyberg announced his
upcoming absence on Friday, 5/24/96, and relayed Mr. Keightley will serve as Acting City
Manager. Finally, he announced the necessity of a 30-minute executive session with anticipated
action.
vIll. CITY COUNCIL REPORTS
Councilmember Gates announced the Suburban Cities final report of the Audit Committee is due
out the 29th of May. She also stated Council will have the opportunity to vote on the elected
sheriff issue in the near future. She distributed a handout which included a memo regarding the
impact of E2SSB 5201 from the 1995 legislative session; concerns over the lack of information
to determine the impacts of the 1996 measures (SSB 6656 & HB 2484); and possible ways to

address these issues were included in a handout naming six (6) actions the Suburban Cities Board
can take to help the situations. The review of these items was referred to the Finance Committee.
Councilmember Dovey stated the next Parks and Recreation Committee Meeting is 6/17/96.
Deputy Mayor Elder reported her attendance at an 8-hour Law & Justice Committee Conference;
taking a bus tour that A Regional Coalition for Housing (ARCH) sponsored and she has been
attending housing meetings sponsored by the South King County Housing Forum. Next, as a
member of the Seattle/King County Board of Health, she reported teenage pregnancy is down.
She will be attending the Washington Council on Crime and Delinquency at the Crown Plaza on
5/29/96.
Councilmember Gintz announced the next Finance Committee Meeting is 5/23/96 at 7:30 a.m.
He also announced King County Council passed a recycling grant that came from the Regional
Policy Committee with the City of Federal Way receiving $ 95,000.00.
Councilmember Watkins reported the next Land Use Committee Meeting is 6/3/96. The zoning
code amendment and design guidelines proposed ordinance will come before the Council for first
reading on June 18, 1996. Next, he spoke of the grant received for the establishment of the Police
Department. He said Jim Murphy and Ken Nyberg were to be congratulated for the "aggressive
grantsmanship" in researching, obtaining and subsequent follow-up used in obtaining the grant.
As a representative of Congressman Randy Tate's office, he attended meetings with City Manager
Nyberg last year at the Department of Justice. It is clear to him, Mr. Nyberg built an on-going
relationship with that office and they have built confidence in him and the City of Federal Way.
Mayor Priest announced that "because of the complicated nature" of the zoning code and design
guideline amendment, discussion will be had at the introduction of the ordinance on June 18,
1996, so staff & Council will be able to "do additional work as necessary" before adoption of the
ordinance. He also spoke for the entire Council, when thanking Congressman Tate's "good
offices" in the initial stages of developing a good relationship with the Department of Justice.
Finally, he stated the art exhibit, located upstairs, is really good. He is impressed with the quality
of workmanship which went into the exhibit done by students from the Federal Way area high
schools.
Councilmember Park stated the next Public Safety Committee meeting is set on 5/23/96.
Councilmember Gates congratulated Michael Park for his appearance in Twilight 1992 -- The Los
Angeles Story at the Intiman Theater last week, in Seattle. She and Mayor Priest were present
and quite proud of Mike.

Mayor Priest recessed the regular meeting at 7:40 p.m. to convene the executive session.

MOVED TO DIRECT THE CITY MANAGER TO ENTER INTO A SETTLEMENT
AGREEMENT AND COVENANT AND ACCOMPANYING EASEMENTS BETWEEN
CERTAIN PROPERTY OWNERS AND THE CITY OF FEDERAL WAY IN CONNECTION
WITH ACQUIRING CERTAIN REAL PROPERTY NECESSARY FOR THE CITY TO
CONSTRUCT THE KITTS CORNER/336TH REGIONAL STORM DETENTION FACILITY;
second by Councilmember Park. The motion carried as follows:
