Council MIN 03-04-1997 Regular FEDERAL WAY CITY COUNCIL Regular Meeting Council Chambers - City Hall March 4, 1997 - 7:00 p.m. MINUTES I. CALL MEETING TO ORDER Mayor Priest opened the regular meeting of the Federal Way City Council at 7:03 p.m., Council Chambers, City Hall, Federal Way, Washington. City Council present: Mayor Mahlon "Skip" Priest, Deputy Mayor Hope Elder; Councilmembers Phil Watkins, Michael Park and Mary Gates. Councilmember Jack Dovey's absence was excused and Council member Gintz arrived at 7: 12 p.m. City staff present: City Manager Ken Nyberg, Deputy City Manager Philip Keightley, City Attorney Londi Lindell, City Clerk Chris Green and Deputy City Clerk Bob Baker. II. PLEDGE OF ALLEGIANCE Councilmember Gates led the flag salute. III. PRESENTATIONS Mayor Priest thanked Cary Roe and others responsible for the traffic signal being operational near the King County Aquatic Center. Pony Lea¡¡:ue Baseball/Proclamation Deputy Mayor Elder read and proclaimed this an evening to recognize the Federal Way Pony All Star Team of 1996 for accomplishing an amazing first year record while playing 66 total games (44/22) and encouraged the community to support the efforts of the athletes. The proclamation was presented to John Sugg. Joe Ganem was recognized for assisting in the gathering of the facts for the proclamation. Mr. Sugg thanked the Council and the people in the community for the fields and the chance to play ball and encouraged people to get involved however possible. Diversity Commission Replacement/Certificate of Appointment Councilmember Park announced the appointment of former alternate Abiodun A. Aina, not present, as commissioner and stated his Certificate of Appointment would be mailed to him. ORIGINAL City Council Regular Meeting Minutes March 4, 1997 - Page 2 IV. CITIZEN COMMENT Greg Valleton addressed the Council regarding his inability to afford the paving of an entire road at 3rd Avenue (off 371st). He bought property seven years ago with intent to build and when he began the permitting process recently, he was advised of the requirement to pave the entire road before building. He suggested an LID would be a win/win situation wherein all 21 homes on the street would contribute to the paving of the street and thus making the building of his dream home possible. He stated that without an LID (or some other like measure) his property would be worthless and useless as he would be unable to build. Mayor Priest informed Mr. Valleton staff is aware of the issue and is working on it. Mark Freeland addressed the Council after he and Friends of the Hylebos reviewed the So. 356th St. Widening Project as it relates to the Blueberry Farm. He and the those who reviewed the project believe it is being done in a way which is conducive to the environment and thereby support its adoption by Council. H. David Kaplan addressed the Council and explained the So. 356th St. Widening Project was also reviewed and is being endorsed by those on the Parks & Recreation Commission. Mary Hall, a resident of unincorporated King County addressed the Council regarding the proposed project of renaming 320th St. & Pacific Highway South. She said driving into Federal Way on the City's roads is dangerous. She is concerned with the corner of 304th & Military and stated 62 auto accidents have taken place since the City's incorporation. She is concerned with the amount of money necessary to rename the streets and instead believes Council should consider safety first. Mayor Priest informed Ms. Hall this is one of the bond projects our citizens approved by way of voting and the City is moving ahead with the project. V. j. CONSENT AGENDA a. b. c. d. METRO 6- Y ear Plan/Soundin¡¡: Board Recommendation City staff member Rick Perez provided possible alternatives to the Council on the developments which are being considered for suggestion to the King County Metro South County Sounding Board. The Sounding Board is seeking possible alternatives or adjustments to the service routes and census of the Land Use/Transportation Committee at their regular meeting on March 3, 1997, was in favor of Alternative A which included the discontinuation of DART services and replacement with a grid of fixed routes, allowing more transfer points between the routes and including an amended start time of the Kent route from 6:00 a.m. to 5:30 a.m., retirement housing areas being served and gaps being filled in the routes. Adoption of this alternative would also include a caveat which states DART services would be restored should Alternative A not prove successful. Council considered this alternative as well. Diane Harper of Metro Services was present and able to answer miscellaneous questions of the Council. R¡:¡¡:ional ISTEA Prqject Applications (1999-2000) City staff member Ken Miller addressed the Council informing them requests for ISTEA Project funds are due by March 10, 1997. He spoke of the City submitting a jointly-clustered application (from Tukwila, SeaTac, Des Moines and Kent) for funding of improvements to Pacific Highway South; approving a city match of $101,250.00 if the grant application is successful; and the approval of Mayor Priest Gointly) signing a letter to PSRC in support of the application with mayors from other cities named. Renamin¡¡: of So 320th St & Pacific Hi¡¡:hway So Public Works Director Cary Roe appeared before Council seeking direction on the next step in the process of renaming So. 32Oth St. & Pacific Highway So. He answered various questions of the Council regarding the process options and reviewed possible recommendations. COUNCILMEMBER WATKINS MOVED TO ADOPT THE RECOMMENDATIONS OF STAFF WITH ONE MODIFICATION TO THE PROCESS (DELETING THE OPTION OF PROVIDING FOR A 15-DA Y APPEAL PERIOD FOLLOWING THE FINAL DECISION); second by Council member Gintz. The steps to be taken are: 5) I) Direct Staff to prepare and mail to all abutting property owners, a self- addressed/stamped survey on renaming the streets Establish a dedicated telephone "hot line" to receive comments, questions, and concerns from the community; Coordinate with the Federal Way News and Tacoma News Tribune to run a series of articles designed to inform readers and prompt responses to the City; Coordinate with the Federal Way and Korean Chambers of Commerce to place the topic of renaming these streets on their monthly agendas for discussion and feedback to the City; Assess the feedback obtained to determine if there is any clear support or opposition 2) 3) 4) City Council Regular Meeting Minutes March 4, 1997 - Page 5 6) to the proposed changes; make decision whether or not to move forward; Hold two formal Public Hearings on consecutive City Council meetings dates; allow for a written comment period of 15 days following the second Public Hearing; Issue a final Council decision; 7) If the Council decision is affirmative: 8) 9) Formally adopt the decision by Ordinance or Resolution; Notify businesses, emergency service providers, post offices, utility companies, etc., of final decision and schedule. CITY MANAGER REPORT City Manager Nyberg reported Chief Wood gave the commencement address today at the Basic Law Enforcement Officers Graduation Ceremony at the training center in Burien. Two Federal Way Police Officers graduated -- Larry Murray & Mike Chi. Mr. Nyberg also announced he and all Department Directors will attend a restructuring retreat this Friday, March 7, 1997, in Seattle. Saturday, March 8, 1997, marks the date for Celebrate Hachinohe Celebration from 11:00 a.m. to 7:00 p.m. at Barnes & Noble. Finally, he announced the necessity of a :30 minute executive session with action anticipated. VIII. CITY COUNCIL REPORTS Council member Park announced the next Public Safety & Human Services Committee regular meeting is set for March 6, 1997, at 5:30 p.m. He also announced his attendance at a Regional Finance & Governance Human Services Roundtable meeting. Councilmember Watkins announced the next Land Use!Transportation Committee regular meeting is set for March 17, 1997, at 5:30 p.m. City Council Regular Meeting Minutes March 4, 1997 - Page 6 Council member Gintz announced the next Finance/Economic Development Committee regular meeting is set for March 27, 1997, at 7:30 a.m. The next Parks & Recreation Committee regular meeting is set for March 17, 1997, at 8:00 a.m. Deputy Mayor Elder exclaimed the volunteer recognition dinner was absolutely wonderful. The volunteers are the "heart and soul" of this City and she is so proud. Councilmember Gates announced the Suburban City Board of Directors have confirmed the appointments for all Councilmembers as reported at the last regular Council meeting. She also stated an agreement that the Governance & Finance Principles are, at least, the place to start for the Growth Management Planning Council which is being "handed off' to Mayor Priest. Next, she reported the Regional Transit Committee is to meet with new King County Councilmember Dwight Pelts on March 6, 1997, to get to know him and explain issues so he understands Suburban Cities concerns on regional transit. Next she reported to City Manager Nyberg "rumor through the grapevine" both from a legislative standpoint as well as from some of the committees she's heard from, that the Cities are to take the entry level people when the work requirement goes into effect. This may become an emerging issue. Finally, SB 5816 has been amended and is trying to make major changes in the RTA legislation with representation and governance. She stated there is support from the Federal Way Chamber of Commerce against the bill unequivocally opposing the legislation changes that reconstitute the RTA governance structure and abridge its power to implement the program citizens voted upon. She is positive this is about a breach of faith with voters. Mayor Priest recessed the regular meeting at 8:02 p.m. and council went into executive session. IX. EXECUTIVE SESSION Property Acquisition/Pursuant to RCW 42.30. I 1O(1)(b) Potential Litigation/Pursuant to RCW 42.30. 110(1)(i) At 8:51 p.m., Mayor Priest and Council returned to Council Chambers and reconvened the regular meeting. At which time, COUNCILMEMBER GINTZ MOVED APPROVAL TO DIRECT AND AUTHORIZE THE CITY MANAGER TO CLOSE THE ACQUISITION OF AN EASEMENT INTEREST IN CERTAIN REAL PROPERTY REQUIRED BY THE CITY IN CONNECTION WITH THE CONSTRUCTION OF THE BELMOR MOBILE HOME PARK REGIONAL RETENTION/DETENTION FACILITY PROJECT (SEATAC MALL, PHASE I) PURSUANT TO THE TERMS OF A CERTAIN EASEMENT PURCHASE AND SALE AGREEMENT DATED DECEMBER 18, 1996, BETWEEN THE CITY, AS PURCHASER, AND BELMOR HOLDINGS, LTD., AS SELLER, COVERING CERTAIN REAL PROPERTY City Council Regular Meeting Minutes March 4, 1997 - Page 7 LOCATED AT 2101 So. 324TH, FEDERAL WAY, WASHINGTON, FOR A PURCHASE PRICE OF $26,000.00 PLUS CLOSING COSTS; second by Deputy Mayor Elder.
