Council MINS 08-03-1999 Regular FEDERAL WAY CITY COUNCIL Council Chambers - City Hall August 3, 1999 - 7:00 p.m. REGULAR MEETING ***** MINUTES I. CALL MEETING TO ORDER Mayor Gintz called the regular meeting of the Federal Way City Council to order at 7:05 p.m., in Council Chambers, City Hall. II. PLEDGE OF ALLEGIANCE Boy Scout Troop #361 led the flag salute. III. PRESENTATIONS a. Economic DeveloDment UDdate Economic Development Executive Debra Coates, provided an update on the city's sign incentive program, landscape architecture and GIS information for the proposed international district. She announced the next Oversight Committee will meet at city hall on August 11. b. Emer~in~ Issues City Manager Nyberg presented Police Lieutenant Steve Kelly, on behalf of the Public Safety Department SIU detectives, a pin and plaque representing exceptional performance of their duties from January 1997 to December 1998; during that period of time five members of the drug intelligence unit removed in excess of $2.3 million in narcotics from the streets of Federal Way. IV. CITIZEN COMMENT Walt Olsen, attorney representing T & A Video urged Council to consider citizen comments with regard to relocation of adult businesses. Alison Corrigan, President and CEO of the Greater Federal Way Chamber of Commerce, thanked the Council for CDBG funding of the proposed downtown international district. Tony Screws, representing the Washington State Youth Soccer Association, thanked Council and the Human Services Committee for their support of CDBG funds to support the association. ORIGINAL Federal Way City Councü Regular Meeting August 3, 1999 - Page 2 Ernie Londino, discussed the proposed adult entertainment ordinance, suburban growth management, housing and traffic. Michael Hellickson, spoke in opposition to allowing adult entertainment in the city, as he feels Federal Way is for families, schools and churches. Art Warner, on behalf of Federal Way Area Scouts, thanked the Council for their support of Family Fest and the Scout-a-Raffia at Steel Lake again this year. David Kronisch, spoke in favor of undergrounding all high tension power lines in the city. Diane Gale~os, Assistant Director of Habitat for Humanity of South King County, spoke in support of continual funding allocation for adequate housing and building of new homes within the City of Federal Way. Gary Benton, representing Auburn Youth Resources, thanked the Council for their continued support of their organization. Don Davisson, spoke in opposition to both proposed ordinances on adult entertainment code amendments; he feels the city center zone isn't appropriate for adult entertainment, and doesn't feel the zones in the second proposed ordinance are satisfactory; he feels the current sign code is adequate. Joel Marks, spoke in favor of clustering adult entertainment businesses in the southern most region of Federal Way. Barbara Reid, spoke in favor of Council reconsidering and tabling the proposed adult entertainment ordinance at this time; she doesn't feel there are currently any problems with the existing businesses. v. e. f. g. h. i. j. Councilmember Burbidge pulled Consent Item (d) - Council Bill #219/Adult Entertainment, Activity, Retail or Use. Councilmember Kochmar pulled Consent Item (e) - 2000 CDBG Fund Allocation. Council member Watkins pulled Consent Item (k) - 1999 COPS Universal Hiring Program Grant. The motion to approve Consent Items (a), (b), (c), (f), (g), (h), (i), G), (1), (m), (n) and (0) passed as follows: Burbidge Gates Kochmar Watkins yes yes yes yes Dovey Gintz Park yes yes yes Consent Item (d) - Council Bill #219/Adult Entertainment Activity Retail or Use - Community Development Services Director Stephen Clifton and City Attorney Londi Lindell presented information on the two proposed ordinances. Councilmember Burbidge thanked Mr. Clifton, Ms. Lindell and their staff for researching and clarifying all factors involved in this issue. MOTION BY COUNCILMEMBER BURBIDGE TO APPROVE THE ORDINANCE SET FORTH IN ATIACHMENT #2 OF THE COUNCIL PACKET, WHICH SELECTS BC (COMMUNITY BUSINESS) ZONING AND MAINTAINS 1,000' SEPARATION BETWEEN ADULT USES AND OTHER SENSITIVE USES SUCH AS SCHOOLS, RESIDENTIAL ZONES, PARKS AND CHURCHES, AND MAINTAINS 1,000' OF SEPARATION BETWEEN ADULT BUSINESSES; SECOND BY COUNCILMEMBER KOCHMAR. Consent Item (e) - 2000 CDBG Fund Allocation. MOTION BY COUNCILMEMBER DOVEY TO APPROVE THE 2000 CDBG PROPOSED USE OF FUNDS AS PRESENTED BY THE HUMAN SERVICES COMMISSION; SECOND BY COUNCILMEMBER GATES. Councilmember Kochmar read a statement regarding funding for low and moderate income citizens; she feels the monies used to fund the international district should come from the general fund not CDBG dollars. COUNCILMEMBER KOCHMAR MOVED AMENDMENT TO TAKE THE $74,526 EARMARKED FOR THE INTERNATIONAL DISTRICT, AND INSTEAD GRANT THOSE MONIES TO HABITAT FOR HUMANITIES FOR KING COUNTY; SECOND BY COUNCILMEMBER WATKINS. Councilmembers Burbidge, Gates, Mayor Gintz and Deputy Mayor Park said they all feel the current level of basic needs funding is adequate, so will oppose the proposed amendment. Consent Item (k) - 1999 COPS Universal Hirin~ Pro~ram Grant. MOTION BY COUNCILMEMBER WATKINS TO ACCEPT THE 1999 COPS UNIVERSAL HIRING PROGRAM GRANT FOR $600,000 TO BE AWARDED TO THE DEPARTMENT OF PUBLIC SAFETY TO FUND EIGHT NEW, ADDITIONAL FULL- TIME OFFICERS OVER A THREE- YEAR PERIOD; SECOND BY COUNCILMEMBER DOVEY. Federal Way City Council Regular Meeting August 3, 1999 - Page 5 Councilmember Watkins asked staff for clarification on FTE funding and requested a written report on the number of sworn officers with FTE status; Public Safety Director Ron Wood explained the grant has already been applied for and approved for eight positions..,the issue now is whether the Council will vote to accept the monies or any portion thereof. COUNCILMEMBER BURBIDGE MOVED TO AMEND THE MAIN MOTION TO READ, "SUBJECT TO THE APPROVAL OF THREE OFFICERS FOR THE TWIN LAKES AREA"; SECOND BY COUNCILMEMBER GATES. Councilmember Dovey spoke to the amendment expressing his concern the city might lose monies for a federal grant if a limitation is placed on the number of officers being funded; he feels the city should apply for all eight positions at this time, as we can always consider reducing the number of officers at a later date. Management Services Director Iwen Wang explained the Council can authorize acceptance of the grant for eight positions at this time, however, the drawdown of the grant amount can be subject to the Twin Lakes agreement or City Council agreement to add three positions. COUNCILMEMBER BURBIDGE WITHDREW HER PREVIOUS AMENDMENT AND MOVED FOR A SUBSTITUTE AMENDMENT TO MAKE THE APPROVAL OF THE UNIVERSAL HIRING GRANT FOR $600,000 TO FUND THE EIGHT ADDmONAL NEW OFFICERS OVER A THREE- YEAR PERIOD, WITH THE DRA WDOWN SUBJECT TO THE TWIN LAKES NEGOTIATIONS; SECOND BY COUNCILMEMBER GATES. MOTION BY COUNCILMEMBER WATKINS TO MOVE TO SECOND READING AND TO BE PLACED ON THE SEPTEMBER 7, 1999 MEETING AGENDA; SECOND BY COUNCILMEMBER GATFS. CITY COUNCIL REPORTS Councilmember Dovey reported the next regular meeting of the Parks/Recreation/Human Services/Public Safety Committee has been canceled due to lack of agenda items. Councilmember Watkins announced the next regular meeting of the Land Use/Transportation Committee will be held on August 5, 1999, at 5:30 p.m. Councilmember Burbidge said she is looking forward to attending the next South County Area Transportation Board meeting and also the Regional Law, Safety and Justice Committee meeting. Councilmember Gates reported the next regular meeting of the Finance/Economic Development! Regional Affairs Committee is scheduled for September 2, 1999, at 5:30 p.m.; in addition, she will be chairing the Sound Transit Finance Committee meeting on Thursday. She will be attending the celebration of the renovation of Laurelwood Gardens next week. Commencing August 20, she will be attending (at her own expense) the Women's Trade and Study Mission in Central Europe, organized by the Washington State Department of Community Trade and Development. Federal Way City Councü Regular Meeting August 3, 1999 - Page 7 Councilmember Kochmar reminded everyone of the upcoming Fusion event at Dumas Bay, and the Centerstage presentation of Steel M!\~nolias opening Tuesday at the Knutzen Family Theatre; she also mentioned the blueberry farm is now open. Councilmember Burbidge added that Steel Mal:nolias will be presented for three weeks. Deputy Mayor Park reported he attended the three day National Invitational Tournament event held on July 23-25, with approximately 2,000 people in attendance. He also reported the City Manager Search Committee will meet Thursday at 3:00 p.m., to select three to five finalists and to discuss the finalist process. Councilmember Dovey added the Federal Way Youth Soccer Association will host a boys and girls soccer tournament at Celebration Park the next two weekends, with an expected attendance of 3,000-4,000. Mayor Gintz reminded everyone of the cancellation of the August 17 regular Council meeting; he also announced he will be out of town for the next regular meeting and asked Deputy Mayor Park to convene over the meeting on September 7. He further wished all of the City Council candidates good luck in the upcoming elections. IX. CITY MANAGER REPORT City Manager Kenneth Nyberg reminded everyone of the upcoming Family Fest celebration scheduled for August 27 and 28; officials from our Sister City of Hachinohe will be present during the festival. He reported that he has invited City Council candidates to meet with him on August 10, at the hour of 5:30 p.m., to review the city's sign code, especially political sign requirements. X.
