Re: Access Easement Improvements, 28208 Military Road, Permit No. BLD92-2600 VII
Dear Mr. Aadland:
The above referenced permit for a single family residence at the address of 28200 Military
Road S. in the City of Federal Way is still actively open and pending additional information
on the development of the access easement to the subject lot. An inquiry was made by Ms.
Kim Tso about what items still need to be submitted for review and approval before the
permit can be issued. These items are covered in the following paragraph.
The access easement for which plans were preliminarily prepared has been partially paved.
However, the pavement does not extend to the subject site and does not adequately handle
the runoff from the area. The development of the subject site will require the completion of
the access easement development by doing the following:
1. Extend the full width pavement section from its current terminus to the subject
property.
2. Install an extruded curb along the west side of the easement to control the runoff from
the site and direct it to the subject property.
3. Install a catch basin with an oil/water separator (turned down elbow) at the entrance
to the subject property and storm piping from the catch basin to the drainage ditch to
the east of the property.
4. Install a raised asphalt lip in the cul-de-sac to direct as much of the runoff in that area
to the drainage system to be installed.

Dear Mr, Aadland:
This permit application was previously reviewed under BLD#91-597NR. Based on that review,
the Public Works Department will need the following:
1. Two sets of revised prints will need to be provided for your driveway improvements (see
corrections noted on the enclosed check print); after all corrections have been made, we
will need two mylars. We we also need to have your engineer/architect submit an
estimate (on the enclosed form) for the improvement work so that a bond amount can be
computed.
2. A copy of the recorded easement for the storm drain line and drainage ditch needs to be
provided; the document needs to reflect the correct location of the line and ditch.
3. The enclosed "no protest" agreement needs to be signed/notarized and returned to us
along with a check for $8 made payable to the King County Records and Elections
Division.
The Building and Planning Departments may also have comments regarding your project and

On December 21,1995, the Federal Way City Council adopted Ordinance 95-249. This
authorizes the collection of school impact fees for Federal Way School District #210.
These fees are assessed and collected at the time the building permit is issued. The fee for a
single family dwelling is $1707 and will be collected along with other applicable permit fees.
A fee of $1423 is collected for each unit of a multi -family development.
Upon review of our records, we discovered that you have a pending building permit for a
single family dwelling. Since you may not have been informed previously of this fee and in
the spirit of fairness, we would like to offer you an opportunity to pick up your permit. We
are allowing a grace period to pick up your pending permit. Therefore, you have until
March 22, 1996 to address any outstanding issues and pick up your permit without being
assessed the school impact fee.

WAIVER OF PROTEST COVENANT
THIS COVENANT is made by William M. Aadland ("Property Owner") in favor of the City of Federal Way, a
Washington municipal corporation ("City").
A. The Property Owner owns certain real property commonly known as 28208 Military Road S, Federal Way, WA
98003 and legally described as follows: Lot 9, Block 2 of Ellenwood Manor, as recorded in volume 70 of plats,
page 22, records of King County, Washington ("Property").
B. The Property Owner has submitted a request for a building permit under Permit No. BLD92-2600 to construct
a single family residence on the Property which abuts a substandard City right-of-way known as Military Road S,
which project will impact and derive special benefits from the public right of way.
C. The City may, in the future, construct, reconstruct or improve Military Road S to City standards including, but
not limited to, curbs, gutters, sidewalks, driveways across sidewalks, storm drains, retaining walls, street
illumination, landscaping, slope protection and underground power, and necessary appurtenances consistent with
good street construction ("Improvements"), so as to benefit the Property, through the formation of a Local
Improvement District.
NOW, THEREFORE, the Property Owner agrees as follows:
1. Permit. The Property Owner may obtain a building permit for constructing a single family residence
without the installation of the Improvements so long as all other conditions of the permit, if any, are
complied with to the City's satisfaction.
2. No Protest. Pursuant to RCW 35.43.182 and in consideration of the City approving said permit, the
Property Owner agrees to participate in and not protest the formation of a Local Improvement District
pursuant to RCW 35.43.180.
3. Term. This Covenant shall be for a term of ten (10) years commencing on the date of execution hereof
and terminating ten (10) years thereafter.
4. Improvements. Nothing in this Covenant shall in any way absolve the Property Owner of any underlying
obligation to make any public improvements prior to the expiration date of this Covenant or upon eighty
(80) days written notice from the City if such public improvements are required pursuant to the Federal
Way City Code, any other permit application, or other applicable laws, rules, or regulations, as now
existing or hereafter adopted or amended. The Improvements may be necessary to mitigate the effects of
the development of the Property. This Covenant shall be construed only as providing an alternative means
for payment for necessary public improvements through the formation of a Local Improvement District.
5. Binding Lffcct. This Covenant is binding on the Property Owner, his successors in interest, heirs and

assigns, and is a covenant running with the land.
6. Filing. This Covenant shall be recorded by the City with the King County Office of Records and the
Property Owner shall pay all recording fees.
Limitation. Nothing in this Covenant shall be construed to waive the Property Owner's right to object to
the Property Owner's individual -assessment (including the determination of special benefits allocable to the
Property) or to appeal to the Superior Court the decision of the Federal Way City Council affirming the
final assessment roll.

I spoke with Public Works staff about your proposal to clear your lot of brush and alder trees in order to aid the
sale of property at South Military Road and South 282nd. You have a building permit application, number
BLD92-2600, that has not been issued.
All grading, clearing and filling activities of undeveloped lots are regulated by City Code. An issued building
permit would allow grading and clearing in association with lot preparation and construction activities, and a land
surface modification would not be necessary. However, if you wish to proceed with the clearing of the
undeveloped lot without an active building permit, the land surface modification will be required.
In order to do the proposed clearing prior to building permit issueance, you will need to apply for a land surface
modification, which reviews clearing or removal of trees, shrubs, ground cover and other vegetation and all
grading, excavation and filling activities proposed without a development permit. Unless permitted outright under
Article XIII, Division 7 (Section 1093)of the Federal Way City Code (FWCC), the land surface modification
requires approvals through Use Process I. In addition, any grade of fill activity that exceeds 500 cubic yards
requires a State Environmental Policy Act (SEPA) review. This review would precede the Use Process I review.
Land surface modification fee is $1190. Use Process I fee is #800, with a $40 fee for Fire Department review.
If SEPA is required, the fee is $350, with $17 for the Fire Department review. The review timeline following
complete application submittal is approximately six to nine weeks.
