CALL MEETING TO ORDER Mayor Jeanne Burbidge called the regular meeting of the Federal Way City Council to order at the hour of 7:02 p.m. Councilmember present: Mayor Jeanne Burbidge, Councilmember Jack Dovey, Eric Faison, Mary Gates, Linda Kochmar, and Mike Park. Staff present: City Manager David Moseley, City Attorney Pat Richardson, and City Clerk Chris Green. Mayor Jeanne Burbidge excused Deputy Mayor Dean McColgan. COUNCILMEMBER FAISON MOVED TO AMEND TONIGHTS AGENDA FOR THIS EVENING'S MEETING, TO ADD AND EXECUTIVE SESSION, "PROPERTY ACQUSITIONIPURSUANT TO RCW 42.30.110(1)(b); AND SALE OF PROPERTYIPURSUANT TO RCW 42.30.110(1)(c); COUNCILMEMBER DOVEY SECOND. Proclamation! Amateur Radio Week Mayor Burbidge read and presented the Amateur Radio Week proclamation to Mike McCoy, President of the Amateur Radio Club. Youth Commission/Appreciation Plaques (Outf!;oinf!; Commissioners) Although unable to attend tonight's meeting due to graduation ceremonies, Councilmember Kochmar read the list of outgoing Youth Commissioners. She noted their plaques would be given to them at a later date. c. Diversity Commission/Appreciation Plaques (Outf!;oinf!; Commissioners) Councilmember Kochmar thanked and presented appreciation plaques to Deborah Robinson, Maya Kumar, and Anel Mercado for their work on the Diversity Commission. d. Diversity Commission/Introductions & Certificates of Appointment Councilmember Kochmar was also pleased to introduce and present certificates of appointment to Bryan Cooper, Teresa Camacho, and Diana Gonzalez; all have been appointed to the Diversity Commission with terms through May 31, 2006. e. Ethics Board/Introduction & Certificate of Appointment Mayor Burbidge was pleased to introduce and present the certificate of appointment to Dennis Greenlee, Jr. to the Ethics Board with a term through June 30, 2006. f. Public Safety Awards Chief Anne Kirkpatrick was pleased to introduce and announce the following officers and volunteers for their following awards: Officer Kurt Schwan was awarded the Police Chief s Citation; Officer Gabe Castro was awarded the Certificate of Merit; Detective Casey Jones was awarded the Police Chiefs Commendation; Volunteer Susan Hemmer, Citizen Harry Westcott, Volunteer Gwen Lazzarini, and Volunteer Jan Evens received the Police Chiefs Citizen Commendation; Commander Krista Osborne, Lieutenant Melanie McAllester, and Officer Bill Drake, Officer Miguel Monico, and Commander Greg Wilson, received the Medal of Meritorious Service. Introduction of New Employees/City Manager City Manager David Moseley announced there were no new employees to introduce tonight. h. PUBLIC HEARING Formation of Proposed Steel Lake Management District Mayor Burbidge read into the record the procedures to be followed for the Public Hearing and opened the Public Hearing at 7:40 p.m. . Staff Report Public Works Department's ESAlSPDES Coordinator Leslie Ryan-Connelly gave a brief PowerPoint presentation to Council, and answered questions as requested. . Citizen Comment: Margaret Reyhner, 30-year resident of Steel Lake, spoke in favor of the Management District and urged Council to go ahead with the formation of the district. Federal Way City Council Regular Meeting Minutes June 17, 2003 - Page 5 of 9 Torn Dezutter, resident of Steel Lake, spoke in favor of establishing the Lake Management District; he noted this evenly distributes the management responsibilities of the lake. Tim Jenkins, spoke in favor of the Steel Lake Management District, noting this will help maintain the quality of the lake for all residents. Chuck Schukar, encouraged the Council to approve the Steel Lake Management District. He was impressed with the city staff involved with helping the residents moving this forward. Don Nack (did not complete sign in sheet) spoke to Council questioning the costs associated with the Management District, and asking what the city's role is in the formation of the district. Bob Radcliff, (did not complete sign in sheet) 30-year resident of Steel Lake, spoke about the poor condition of the lake in recent years. C.T. Purdom, spoke in support of the formation ofthe Steel Lake Management District. He noted the usage of the lake has increased dramatically. He noted the city and Department of Fisheries, also needs to be and stay involved with the lake. Phyllis Massey, (did not complete sign in sheet) spoke in support of the Management District, and noted the minimal amount is worth it to keep the quality of the lake for all who live on the lake and all residents who use the park. . City Council Deliberation/Direction Ms.. Ryan-Connelly reviewed Councilmembers questions including assessment information and the ten-year term set out in the Management District. She also noted the Advisory Board members would volunteer and be selected by the Council. Mayor Burbidge closed the Public Hearing at 8:08 p.m. COUNCILMEMBER FAISON MOVED TO DIRECT STAFF TO CREATE A RESOL TUION ESTABLISHING A PUBLIC VOTE TO THE OWNERS OF LAND WITHIN THE PROPOSED LAKE MANAGEMENT DISTRICT, INCLUDING PUBLICLY OWNED LAND, AND TO BRING THE REOLUTION BEFORE THE NEXT REGULAR SCHEDULED COUNCIL MEETING; COUNCILMEMBER DOVEY SECOND. CITY COUNCIL REPORTS yes excused yes Councilmember Gates updated Council on her attendance at various regional meetings, and congratulated John Hatcher, the city's caterer at Dumas Bay Centre on his recent accreditations. Federal Way City Council Regular Meeting Minutes June 17,2003 -Page 7 of9 Councilmember Kochrnar congratulated the many youth in the community who are partaking in graduation ceremonies! She also encouraged citizens to attend the Red, White, and Blues Festival at Celebration Park on July 4th. Councilmember Park announced the next meeting of the Finance/Economic Development/Regional Affairs Committee would be held June 24th at 2:00 p.m., and the Korean Community Leaders meeting would be held June 26th at 6:30 p.m. in Council Chambers. He noted he would be attending, with many other Councilmembers, the Association of Washington Cities Conference in Spokane. Councilmember Dovey noted he attended the Flag Day ceremony, which was a good presentation and very well attended. Councilmember Faison noted that due to June's calendar having five Monday's the next Land Use/Transportation Committee would be July 7th at 5:30 p.m. Mayor Burbidge reported on her attendance at various regional meetings, and encouraged citizenS to attend the many performing arts events in the community. x. CITY MANAGER REPORT City Manager David Moseley reported the "beautification" process of the downtown area has begun with decorative banners displaying the city's logo and flower baskets which have been attached to the light poles lining the 320th and Hwy 99 area. Mr. Moseley encouraged all to attend the "Grand Re-Opening" of the Kenneth Jones Pool, on June 25th. Many activities are planned, for more details please contact the Parks Department or access the city's website at www.cityoffederalway.com. He briefly updated Council on the New City Hall purchase. He noted the lenders are currently reviewing the documents and closing is anticipated for July 15th. City Manager Moseley noted the Architects for the new Community Center held a Study Session for the Council prior to this meeting, and are currently holding an open house at Dumas Bay Centre. He encouraged citizens to get involved in the process by attending some of the various meetings. He further reminded Council for the need for an Executive Session for the purpose of discussing Potential Litigation/Pursuant to RCW 42.30.110(1 )(i) and Property Acquisition/Pursuant to RCW 42.30.110(1 )(b); for approximately thirty minutes with action anticipated. At 8:23 p.m. Mayor Burbidge announced the Council would be recessing into Executive Session for the purpose of discussing Potential litigation/Pursuant to RCW 42.30.110(1)(b), and Property AcquisitionlPursuant to RCW 42.30.110(1)(b) for approximately thirty minutes with action anticipated. Council returned to Chambers at 8:48 p.m. COUNCILMEMBER FAISON MOVED TO DIRECT AND AUTHORIZE THE CITY MANAGER TO CLOSE THE ACQUISITION OF REAL PROPERTY FOR THE MAINTENANCE YARD EXPANSION PURSUANT TO THE TERMS OF THAT CERTAIN REAL ESTATE PURCHASE AND SALE AGREEMENT DATED MAY 27, 2003, BETWEEN THE CITY AS PURCHASER, AND NORRIS O. HAUGE, AS SELLER, COVERING CERTAIN REAL PROPERTY LOCATED NORTH AND CONTIGUOUS TO THE CITY'S MAINTENANCE YARD FOR A PURCHASE PRICE OF $110,000.00; COUNCILMEMBER PARK SECOND.
