ORDINANCE NO.
89-9
AN ORDINANCE OF THE CITY OF FEDERAL WAY,
WASHINGTON, DECLARING THE INTENT OF THE CITY TO
JOIN AND BE ANNEXED BY THE KING COUNTY LIBRARY
DISTRICT, REQUESTING THE CONCURRENCE OF THE
DISTRICT BOARD OF TRUSTEES, AND REQUESTING THE
COUNTY COUNCIL TO CALL A SPECIAL ELECTION IN THE
CITY AND THE DISTRICT FOR FEBRUARY 6, 1990 FOR
THE PURPOSE OF SUBMITTING THE ANNEXATION TO THE
VOTERS.
WHEREAS, RCW 35.02.130 authorizes the City Council of
the City of Federal Way to submit ballot propositions to the
voters of the City in order to authorize annexation of the city
by a library district effective immediately upon the date of
incorporation, and
WHEREAS,
pursuant to RcW 27.12.360,
the process of
annexation must be initiated by an ordinance of the City stating
the City's
intent to join the District and finding that the
public interest will be served thereby, and
WHEREAS, the State Librarian has been notified of this
proposed ordinance pursuant to RcW 27.12.360, now, therefore,

WASHINGTON, DO ORDAIN AS FOLLOWS:
section 1.
Declaration of Intent and Findinq.
The
City of Federal Way hereby declares its intent to join and be
annexed by the King county Library District effective immediately
upon the date of incorporation of the city.
Haying weighed the
options for providing library service to the citizens within the

City, the City Council finds that the public interest will be
best be served by annexation to the said District.

2.
Transmittal
to District
- Reauest
for
Concurrence.
Pursuant to RCW 27.12.360,
the ci ty Manager is
hereby directed to forward a certified copy of this Ordinance to
the Board of Trustees of the King County Library District.
The
City Council requests that the Board of Trustees concur in the
proposed annexation of the City by the District.
section 3.
Transmittal to County Council - Reauest for
Special Election.
Pursuant to RCW 27.12.360 and. 370,
if the
Board of Trustees concurs in the annexation, the City Manager is
hereby directed to notify, and to send a certified copy of this
Ordinance and a copy of the District's concurrence, to the King
County Council.
The King County Council is hereby requested to
call a special election to be held in the City of Federal Way on
February
6,
1990,
which
is
the
next
date
proyided
in
RCW
29.13.010 and is not less than forty-fiye (45) days from the date
of this declaration and finding.
The King County Council is also
requested to give notice of the election as provided for in RCW
29.27.080.
The purpose of the election shall be to submit to the
qualified
voters
within
the
city
of
Federal
Way
a
ballot
proposition in substantially the following form:

section 4 .
Annexation.
If a majority of persons
voting on the annexation proposi tion shall vote in favor of
annexation, then the City of Federal Way shall be annexed to and
constitute a part of the King County Library District effective
immediately upon the date of incorporation of the city.
section 5.
Effective Date.
Pursuant to the authori-
zation for submission of ballot propositions set forth in RCW
35.02.130, this ordinance shall become effective five (5) days
after
its
passage
and
publication
of
the
attached
summary
consisting of its title, which is hereby approved.

AGREEMENT FOR LIBRARY SERVICES
PENDING ANNEXATION INTO
LIBRARY DISTRICT
Date and Parties This agreement, for reference puposes only, is dated
the 5th day of December, 1989, and is entered into by and between King
County Rural Library District, hereinafter referred to as the "District," and
the City of Federal Way, hereinafter called the "City."
WHEREAS, the King County Rural Library District provides a library
building, materials, staff and services at 848 South 320th Street, and the
City may annex back into the District as of the date of incorporation or at a
later date, now, therefore,
The parties agree as follows:
1) The District agrees that if the City chooses to annex to the District,
the District will fund future operations, maintenance and utility costs at the
libraries on two future sites (a 25,000 square foot library on the Panther
Lake Elementary School site, and a 10,000 square foot building at a site yet
to be determined and in or adjacent to northem Federal Way), and
2) The District will maintain and renovate the existing library at 848
South 320th Street as a third site or relocate the library in the same
general proximity.
General Recitals:
1) This agreement is to define the rights and obligations of the parties
in the event annexation of the City to the District is approved at the special
election to be held on February 6, 1990 or a subsequent election in 1990. If
annexation of the City to the District is not approved at any such election,
this Agreement shall be of no further force or effect. and the District will
continue to receive revenue from property tax assessments in Federal Way
through the calendar year 1990.
2) In the event the City chooses to appoint a Library Board of Trustees
during any time period when the City is annexed to the District, the District
shall regularly solicit input from the Board on issues relating to all aspects of
library services and facilities for the residents of Federal Way.
