ORDINANCE NO.
89-13
AN ORDINANCE OF THE CITY OF FEDERAL WAY,
WASHINGTON, ESTABLISHING A UNIFORM APPEAL
PERIOD IN THE ABSENCE OF SAID APPEAL PERIOD
BEING ESTABLISHED EITHER BY ORDINANCE OR BY
APPLICABLE STATE LAW.
WHEREAS, there is a necessity to establish a uniform time
period within which persons aggrieved by final decision of any
Board,
Commission,
Administrative,
city Councilor other final
decision of the City must by appealed, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. General Appeal Provision.
In the absence of a
specific provision in State statutes or in an applicable city
ordinance establishing an appeal period from any final action of a
hearing
examiner,
board,
commission,
city
council
or
other
administrative official for which there is no further right of
administrative appeal, a writ or other appropriate appeal action
must be filed with the court having jurisdiction over the matter
wi thin fourteen
(14)
days of the date of the final action or
decision being appealed from.
For purposes of this Section, final
action shall mean approval and adoption of formal findings and
conclusions where such are required or the issuance of the final
administrative
opinion
or
determination
where
findings
and
conclusions are not required.
section 2.
If any section, sentence, clause or phrase of
this ordinance should be held to be invalid or unconstitutional by

a court of competent jurisdiction, such invalidity or unconstitu-
tionality shall not affect the validity or constitutionality of
any other section, sentence, clause or phrase of this ordinance.
section 3.
This ordinance shall be effective as of the
date of
incorporation which is more than five
(5)
days after
publication of an approved summary consisting of the title to this
ordinance.
