ORDINANCE NO 89
AN ORDINANCE OF THE CITY OF FEDERAL WAY,
WASHINGTON, ESTABLISHING A GENERAL PENALTY
PROVISION FOR VIOLATION OF CITY ORDINANCES
WHERE A SPECIFIC PENALTY IS NOT OTHERWISE
PROVIDED.
WHEREAS, there is a need to establish a general penalty
for violation of City ordinances where a specific penalty is not
otherwise specified in applicable City ordinances, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Violation - Penalty.
A. Unless otherwise p�ovided, any person violating any
of the provisions or failing to comply with any of the mandatory
requirements of any ordinance of the City, or any rule or
regulation adopted by the City Council pursuant thereto, shall be
guilty of a misdemeanor or gross misdemeanor. Except in cases
where a different punishment is prescribed by any ordinance of the
City, any person convicted of a misdemeanor or gross misdemeanor
under the ordinances of the City shall be punished by a fine not
to exceed $5,000 or imgrisonment for a period of not more than one
year or by both such fine and imprisonment.
B. This ordinance shall not preclude and shall be
deemed to be in addition to administrative and civil remedies as
may be set forth in ordinances of the City.
C. Each and every day during any portion of which a
violation of any of the provisions of the ordinances of the City

is committed and continues shall be deemed to be a separate
offense.
Section 2. If any section, sentence, clause or phrase of
this ordinance should be held to be invalid or unconstitutional by
a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this ordinance.
Section 3. This ordinance shall be effective as of the
date of incorporation which is more than five (5) days after
publication of an approved summary consisting of the title to this
ordinance.
