AN ORDINANCE OF THE CITY OF FEDERAL WAY,
WASHINGTON, CREATING THE OFFICE OF PUBLIC
WORKS DIRECTOR, PROVIDING FOR THE
APPOINTMENT THEREOF AND PRESCRIBING THE
DUTIES OF THE OFFICE.
WHEREAS, the City of Federal Way will incorporate as a
noncharter optional municipal code city organized under the
Council-Manager form of government specified in Chapter 35A.13
RCW, and
WHEREAS, RCW 35A.13.090 authorizes the City Council to
create such departments, offices and employments as it deems
advisable, now, therefore,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Office of the Public Works Director
Established - ApAOintment. Pursuant to RCW 35A.13.090, there is
hereby established for the City of Federal Way, the office of
Public Works Director. Such office shall be appointive and all
appointments to such office shall be made by the City Manager.
In lieu of the appointment of an individual to hold the office of
Public Works Director, the office may be filled by contract.
Section 2. Duties of Public Works Director. The
Public Works Director shall manage the Public Works Department of
the City, and shall oversee and administer all engineering,
facilities, streets, water/sewer, maintenance, and public

improvement functions of the City. The Director shall provide
advice and made recommendations to the City Council and such
other boards and bodies of the City requesting or needing
assistance concerning public works matters. He or she shall
consult with and advise other City officials regarding
engineering and public works matters and shall perform such other
and further duties as may be assigned from time to time by the
City Manager. The Public Works Director may, if the City Manager
so designates, oversee and administer the City building code and
other uniform codes of technical regulations governing
construction and development within the City.
Section 3. Severabilitv. If any section, sentence,
clause or phrase of this ordinance should be held to be invalid
or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity
or constitutionality of any other section, sentence, clause or
phrase of this ordinance.
Section 4 . Effective Date This ordinance shall
take effect upon the official date of incorporation of the City,
which is more than five (5) days after the publication of the
attached summary, which is hereby approved.

y35A.13.090 Creation of departments, offices, and �,
employment—Compensation. On recommendation of
the city manager or upon its own action, the council may
create such departments, of�ces, and employments as it
may �nd necessary or advisable and may determine the
powers and duties of each department or of�ce. Com-
pensation of appointive officers and employees may be
fixed by ordinance after recommendations are made by '
the city manager. The appointive officers shall indude a ;
city clerk and a chief of police or other law enforcement �
of�cer. Pursuant to recommendation of the city man-
ager, the council shall make provision for obtaining legai
counsel for the city, either by appointment of a city at- `;
torney on a full time or part time basis, or by any rea- •�
sonable contractual arrangement for such professional ''i
