Ord 90-021 0072.130.007 JEH/crd 01/15/90 ORDINANCE NO. 90-21 AN ORDINANCE OF THE CITY OF FEDERAL WAY, WASHINGTON, CREATING THE OFFICE OF COMMUNITY DEVELOPMENT DIRECTOR, PROVIDING FOR THE APPOINTMENT THEREOF AND PRESCRIBING THE DUTIES OF THE OFFICE. WHEREAS, the City of Federal Way will incorporate as a noncharter optional municipal code city organized under the Council-Manager form of government specified in Chapter 35A.13 RCW, and WHEREAS, RCW 35A.13.090 authorizes the City Council to create such departments, offices and employments as it deems advisable, now, therefore, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DO ORDAIN AS FOLLOWS: section 1. Office of the Community Development Director Established - Appointment. Pursuant to RCW 35A.13.090, there is hereby established for the City of Federal Way, the office of Community Development Director. Such office shall be appointive and all appointments to such office shall be made by the City Manager. In lieu of the appointment of an individual to hold the office of Community Development Director, the office may be filled by contract. section 2. Duties of Communitv Development Director. The Community Development Director shall oversee and administer all land use planning and regulatory functions of the City. The JEHO19950 -1- COpy Director shall provide advice and make recommendations to the ci ty Council and such other agencies, boards or commissions of the City requesting or needing assistance with land use planning or regulatory matters. The Community Development Director shall consult with and advise other City officials regarding planning and land use matters, and shall administer all land use permit processes establ ished by the City. The Community Development Director may, if the City Manager so designates, oversee and administer the City building code, and such other codes of technical regulations governing construction and development in the city. The Community Development Director shall also perform such other duties as may be assigned from time to time by the City Manager. Section 3. Severabilitv. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. section 4. Effective Date. This ordinance shall take effect upon the official date of incorporation of the City, which is more than five (5) days after the publication of the attached summary, which is hereby approved.
