91-97
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF FEDERAL WAY, WASHINGTON, ESTABLISHING
PARKING REQUIREMENTS FOR COMMERCIAL VEHICLES
IN RESIDENTIAL AREAS ZONED SE, RS AND RMo
WHEREAS, the City Council of the City of Federal Way has
determined that there should be regulation for the parking of
commercial vehicles in residential areas during certain hours; and
WHEREAS, this ordinance is in the interest of the public
health, safety and welfare; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,
HEREBY ORDAINS AS FOLLOWS:
section 1.
No person shall park ~ commercial vehicle
which is more than 80 inches wide overall on any street or alley in
residential areas zoned SE, RS and RM between the hours of midnight
and 6:00 a.m.
section 2.
Unless
another
penalty
is
expressly
provided by law, any person found to have committed an act which
violates a provision of this ordinance shall be guilty of a traffic
infraction and shall be punished by a penalty of not more than
$250.00.
section 3.
If any section, sentence, clause or phrase
of this ordinance shall be held to be invalid or unconstitutional
by
a
court
of
competent
jurisdiction,
such
invalidity
or
unconstitutionality
shall
not
affect
the
validi ty
or
the
constitutionality of any other section, sentence, clause or phrase
of this ordinance.

Section 4.
The City Council hereby declares that
there is a public emergency necessitating that this ordinance be
effective immediately upon its passage in order to preserve the
public health, safety and public peace.
