ORDINANCE NO.
91-81
AN ORDINANCE OF THE CITY OF FEDERAL WAY,
WASHINGTON, RELATED TO REAL ESTATE EXCISE
TAX, PROPOSING AN EXCISE TAX OF ONE-QUARTER
OF ONE PERCENT ON EACH SALE OF REAL PROPERTY
IN FEDERAL WAY.
WHEREAS, the 1990 Legislature authorized cities to impose
an excise tax on each sale of real property located within the
corporate limits of the city at a rate not exceeding one-quarter of
one percent of the selling price to be used for local capital
improvements; and
WHEREAS, the City has determined and is in the process of
further determining its capital facilities needs; and
WHEREAS, the city Council has determined that the general
health and welfare of the citizens of Federal Way can be met by
imposing an excise tax in the amount of one-quarter of one percent
of the selling price of all real property for the purposes of
providing revenue for capital improvement needs of the City; NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY DOES HEREBY
ORDAIN AS FOLLOWS:
section 1.
The city Council imposes an additional
excise tax on each sale of real property in the corporate limits of
the City of Federal Way at a rate of one-quarter of one percent,
(1/4%) of the selling price in accordance with RCW 82.46.010, as it
now exists or may hereafter be amended'.
section 2.
All revenues from the tax imposed by this
ordinance received by the city shall be placed by the city Finance

Director in a fund.
Such revenues shall be used primarily for
financing capital projects specified in a capital facilities plan
element of the city comprehensive plan pursuant to RCW 82.46.010,
as it now exists or may hereafter be amended.
Section 3.
King County officials responsible for the
collection and disposition to the City of such taxes are hereby
requested to collect such tax in accordance with the requirements
of RCW 82.46.010, as it now exists or may hereafter be amended.
Section
3.
Severabilitv.
The provisions of this
ordinance are declared separate and severable.
The invalidity of
any clause, sentence, paragraph, subdivision, section, or portion
of this ordinance or the invalidity of the application thereof to
any person or circumstance shall not affect the validity of the
remainder of the ordinance, or the validity of its application to
other persons or circumstances.
Section 4.
Effective Date.
This ordinance shall be
effective five

days after passage and publication of the
ordinance or an approved summary thereof.
