Ord 91-087 ORDINANCE NO. 91-87 AN ORDINANCE OF THE CITY OF FEDERAL WAY, WASHINGTON, DEFINING IN-HOME CHILD DAY CARE AS A NEW CLASS OF HOME OCCUPATION, ESTABLISHING AN ADMINISTRATIVE COMPLIANCE PROCEDURE, AMENDING FEDERAL WAY ZONING CODE §3.10.1l0, §3.10.115, §3.10.276, §15.45, §20.35, §20.40, §35.20, §40.40, §45.70 AND §50.70, (ORDINANCE NO. 90-43). WHEREAS, amendments to the Federal Way Zoning Code text are authorized pursuant to the Federal Way Zoning Code §135 and §160; and WHEREAS, the Federa 1 Way Zoning Code § 13 5.15 contains the criteria for amending the text of the Zoning Code; and WHEREAS, a threshold review of this proposal was considered by the Federal Way City Council on August 13, 1990, pursuant to Federal Way Zoning Code §160.20; and WHEREAS, the Federal Way City Council, having determined the proposal to be meritorious, referred the proposal to the Planning Commission for its review and recommendation; and WHEREAS, the Planning commission considered the proposal at a public hearing on November 7, 1990, and all public notice was duly given pursuant to Federal Way Zoning Code §160.30 and §160.40; and WHEREAS, following public hearings, the Planning commission determined that certain proposed Zoning Code text amendments should be adopted and submitted Findings of Facts and Recommendations to the City Council; and COpy WHEREAS, the city Council considered such recommendations at a public meeting on December 5 1990; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The Findings of Fact of the Federal Way Planning Commission pertaining to the amendments are adopted by reference. section 2. A new §3.10.110 is added ,to the Federal Way Zoning Code as follows: Class I Home Occupation those home businesses that aualifv as home occuptions under the Federal Wav Zoninq Code except familv child care homes. Section 3. A new §3.l0.115 is added to the Federal Way Zoning Code as follows: Class II Home Occupation - those familv child care homes that aualifv under ~115.65.4 of the Federal Wav Zonina Code. section 4. A new §3.l0.276 is added to the Federal Way Zoning Code as follows: Familv child care home - a business reaularlv providina care durinq part of the twentv-four- hour day to twelve or fewer children lincludina the children of the dav care provider) in the family abode of the person or persons under whose direct care the children are placed. Section 5. Federal Way Zoning Code §15.45 is amended as set forth in Exhibit A incorporated herein by this reference. -2- section 6. Federal Way Zoning Code §20.35 is amended as set forth in Exhibit B incorporated herein by this reference. section 7. Federal Way Zoning Code §20.40 is amended as set forth in Exhibit C incorporated herein by this reference. section 8. Federal Way Zoning Code §35.20 is amended as set forth in Exhibit D incorporated herein by this reference. section 9. Federal Way Zoning Code §40.40 is amended as set forth in Exhibit E incorporated herein by this reference. Section 10. Federal Way Zoning Code §45.70 is amended as set forth in Exhibit F incorporated herein by this reference. section 11. Federal Way Zoning Code §50.70 is amended as set forth in Exhibit G incorporated herein by this reference. section 12. Federal Way Zoning Code §115.65 is amended as follows: 115.65 Home Occupations and Other Components of Residential Uses. Accessorv 1. General apply to city. The regulations of this section every residential use within the 2. Purpose - The purpose of this section is to allow commercial occupations incidental to residential uses to be located in residences while providing protection to all residents from excessive noise, excessive traffic, nuisance, fire hazard and other possible effects of commercial uses being conducted in residential areas. 3. Class I Home Occupation - A Home Occupation may be conducted subject to the following regulations: a. A Class I Home Occupation is permitted if it meets all of the following requirements - -3- b. 1) It is carried on exclusively by a family member who resides in the dwelling unit; 2) It has no outside storage, exterior indication or outside activity; 3) It uses no heavy equipment, power tools or power sources not common to a residence; 4) It has no pickup or commercial vehicles; delivery by 5) It does not include more than 4 persons per day coming to the subject property for goods or services; 6) It creates no noise, dust, glare, vibration, odor, smoke or other impact adverse to a residential area. A Class I Horne Occupation which does not meet the requirements of paragraph 3a of this section may be approved using Process II, if - 1) 2) 3) It will not harm the character of the surrounding neighborhood; It will not include outdoor storage and/or operation of building materials, machinery, commercial vehicles or tools, that will be visible or audible from or have an effect on other properties. It does not create a condition which injures or endangers the comfort, repose, health or safety of persons. Class II Horne Occupation - An in-home child care home occupation may be conducted subiect to the followinq requlations: 4. A family child care home is permitted if it meets all of the followinq requirements - h -4- .u .il 1.1 .ti a .§.l 1J.. The use must be operated as part of a principal residential use of the subiect propertv bv a resident of the subiect property. This use must be licensed to provide in-home child care services by the Washinqton State Department of social and Health Services. Lot size. buildinq size. setbacks. and lot coveraqe conform to those applicable to the zoninq district. If the lot is leqal. nonconforminq. it may be approved throuqh a Process I review. Not more than two pers"ons not a resident of the dwellinq unit mav work for the Class II Home Occupation at anyone time. One off-street parkinq space is provided for each non-resident or non-familY member emplovee in addition to the spaces required by the zoninq district for the residential use. The residential drivewav is acceptable for this purpose. The city mav require an on-site passenqer loadinq area. dependinq on the number and nature of the attendees and the extent and nature of existinq street improvements. If located on a maior arterial street. an off-street drop-off/pick-up area must be provided. In residential zones. no exterior alterations are allowed to accommodate the Class II home occupation. includinq siqnaqe. Onlv those interior alterations customary to residential use shall be made. -5- ill.. 2.1 The applicant shall provide documentation that residents livinq immediatelY adiacent to the proposal have been notified of the proposal or the applicant may provide stamped and addressed envelopes of the residents livinq immediatelv adiacent to the proposal and the city will notify the neiqhbors.
